HomeMy WebLinkAbout2007-31• RESOLUTION NO. 2007-31 KO - 6/26/07 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA ANA DENYING NEIGHBORHOOD PROJECT REVIEW NO. 2007-06 TO ALLOW TWO HORIZONTAL SLIDING WINDOWS ON THE FRONT ELEVATION AT 517 SOUTH ROSS STREET LOCATED IN THE SPECIFIC DEVELOPMENT 40 ZONE (SD-40) (HENINGER PARK) BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The Planning Commission of the City of Santa Ana hereby finds, determines and declares as follows: A. The property owner is requesting approval of Neighborhood Project Review No. 2007-06 to allow two horizontal sliding windows on the front elevation at 517 South Ross Street, which is located within the Specific Development 40 Zone (SD-40) (Heninger Park). B. The applicant is proposing the replacement of two windows along the street facing elevation. The applicant is requesting to replace two original wood windows with new horizontal sliding vinyl windows, as well as a reduction in the size and shape of the existing openings.. C. The Heninger Park Architectural Review Committee reviewed and commented on the project and is requesting that the windows be returned to their original style and method of operation. D. Santa Ana Municipal Code Section 41-593.5(c) requires the Planning Commission to review all plans within a Specific Development Plan area to ensure that the project is in conformity with the approved Specific Development. E. On July 9, 2007, the Planning Commission conducted the necessary review pursuant to Santa Ana Municipal Code Section 41-593.5(c). F. After considering all of the evidence submitted, the Planning Commission finds and determines that Neighborhood Project Review No. 2007-06 is inconsistent with both the Heninger Park • Design Guidelines and the Citywide Design Guidelines in regards to architectural style and method of operation. Resolution No. 2007-31 Page 1 of 4 • 1. The replacement of the original wood windows with horizontal sliders is not consistent with the character defining features of a California Bungalow style home according to the Heninger Park Design Guidelines. 2. The Heninger Park Design Guidelines identify the most common window type for this style of home as large, prominent double-hung or casement wood windows, often in three parts. G. This project was reviewed in accordance with the Guidelines for the California Environmental Quality Act. The recommendation is exempt from further review pursuant to Section 15270. This exemption applies to projects which a public agency disapproves. Statutory Exemption Environmental Review No. 2007-72 will be filed for this project. Section 2. The Planning Commission hereby approves Neighborhood Project Review No. 2007-06. This decision is based upon, but is not limited to: the Request for Planning Commission Action dated July 9, 2007 and exhibits attached thereto, and the public testimony, all of which are incorporated herein by this reference.
