HomeMy WebLinkAbout2007-01RESOLUTION NO. 2007-01 KO -1 /3/07 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA ANA AMENDING SITE PLAN REVIEW NO. 2004-05 AS CONDITIONED TO ALLOW MODIFICATION TO THE COMMERCIAL PLAZA FOR THE PROPERTY AT 2775 NORTH MAIN STREET WHICH IS WITHIN SPECIFIC DEVELOPMENT NO. 59 (SD-59) BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The Planning Commission of the City of Santa Ana hereby finds, determines and declares as follows: A. The Applicant is requesting approval of amendment to Site Plan Review No. 2004-05 to allow modifications to the commercial component plaza design for the property located at 2775 North Main Street which is within Specific Development No. 59 (SD-59). B. Section 41-593.5(c) of the Santa Ana Municipal Code requires a review by • the Planning Commission of all plans within a specific development plan area to ensure the project is in conformity with the Specific Plan. C. Applicant proposes to replace the amphitheater design with a more flexible plaza design allowing a more efficient programmable space. D. The amendment to Site Plan Review No. 2004-05 came before the Planning Commission of the City of Santa Ana on August 14, 2006. The Planning Commission continued the plaza modification request to allow the applicant an opportunity to respond to several questions. Those items included: a better delineation of space; operationally, the use and non-use of the entertainment space; spillover noise; renderings portraying events and non-events; and a list of events. E. On January 8, 2007 the amendment to Site Plan Review No. 2004-05 came back before the Planning Commission. F. The site plan review amendment is in compliance with the provisions of Specific Development No. 59 (SD-59) zoning district G. In accordance with the Guidelines for the California Environmental Quality Act, the proposed art and plaza plans has been determined to have no significant impact to Environmental Impact Report 2004-01 that was • certified. The Planning Commission of the City of Santa Ana hereby amends Site Plan Review No. 2004-05 as conditioned in Exhibit A attached hereto and incorporated as though fully set forth herein. This decision is based upon the evidence submitted at the abovesaid hearing, which includes but is not limited to: the Request for Planning Commission Action dated August 21, 2006 and exhibits attached thereto; and January 8, 2007 and exhibits attached thereto; and the public testimony, all of which are incorporated herein by this reference. Date: lam' p~ Planning Commission Secre City of Santa Ana Resolution No. 2007-01 Page 3 of 5 c- Conditions of Approval for Site Plan Review No. 2004-05 Site Plan Review No. 2004-05 is approved subject to compliance, to the reasonable satisfaction of the Planning Manager, with applicable sections of the Santa Ana Municipal Code, the California Administrative Code, the Uniform Fire Code, the Uniform Building Code, and all other applicable regulations. In addition, it shall meet the following conditions of approval: The applicant must comply with each and every condition listed below rip or to exercising the rights conferred by this site plan review. The applicant must remain in compliance with all conditions listed below throughout the life of the development project. Failure to comply with each and every condition may result in the revocation of the site plan review approval. A. Planning Division The project must remain in compliance with the project's Site Plan Review comments (DP No. 03-48). 2. Any amendment to this plan must be submitted to the Planning Division for review. At that time, staff will determine if administrative relief is available or the SD-59 must be amended.
