RESOLUTION NO. 2005-76
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF SANTA ANA DENYING CONDITIONAL USE
PERMIT NO. 2005-26 TO ALLOW ESTABLISHMENT OF A
LAUNDROMAT FACILITY FOR THE PROPERTY
LOCATED AT 702 WEST SEVENTEENTH STREET
BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF
SANTA ANA AS FOLLOWS:
Section 1. The Planning Commission of the City of Santa Ana hereby finds,
determines and declares as follows:
A. The applicant is requesting approval of Conditional Use Permit No. 2005-
26 to allow acard-operated Laundromat facility within an existing
commercial building to be located at 702 West Seventeenth Street, Suite
B.
B. Conditional Use Permit No. 2005-26 came before the Zoning
• Administrator of the City of Santa Ana for a public hearing on October 26,
2005.
C. On November 14, 2005, the Planning Commission voted to set the matter
for public hearing. On November 28, 2005 the Planning Commission held
a duly noticed public hearing on Conditional Use Permit No. 2005-26
D. Pursuant to Santa Ana Municipal Code Section 41-199, Laundromats are
permitted in the Community Commercial (C1) zoning district subject to the
issuance of a conditional use permit.
E. Santa Ana Municipal Code Section 41-638 authorizes the Zoning
Administrator to grant a conditional use permit upon making certain
findings.
1. Will the proposed use provide a service or facility which will
contribute to the general well being of the neighborhood or the
community?
i. The proposed Laundromat will not contribute to the general
well being of the community because there is already a
Laundromat located on Seventeenth Street approximately
one block from the applicant's location that already provides
this community service to individuals who live and work in
the area. Despite the fact that conditions could have been
placed on the Laundromat, designed to mitigate potential

impacts created by the use and ensure that the use will not
• negatively affect the surrounding community, testimony
demonstrates that the existing Seventeenth Street
Laundromat and others in the City are not meeting the
Laundromat standards and are a detriment to its
neighborhood.
2. Will the proposed use under the circumstances of the particular
case be detrimental to the health, safety, or general welfare of
persons residing or working in the vicinity?
The proposed Laundromat would create negative or adverse
impacts to the surrounding community because the use,
when located in other areas of the City, has demonstrated
impacts that affect the health, safety, or general welfare of
persons residing or working in the vicinity.
3. Will the proposed use adversely affect the present economic
stability or future economic development of properties surrounding
the area?
The site as developed is suitable for more upmarket uses
than the proposed use. Seventeenth Street is a critical
arterial in the City and many tens of thousands of vehicles
traverse it each morning and evening. Based on the City's
. experiences with Laundromats that share a single, integrated
development site (such as the Laundromat located across
Seventeenth Street), other uses would better enhance the
economic stability of surrounding properties in the area.
4. Will the proposed use comply with the regulations and conditions
specified in Chapter 41 for such use?
Chapter 41 of the Santa Ana Municipal Code requires a
conditional use permit for the establishment of a Laundromat.
The conditional use permit requirement recognizes that a
case-by-case review of each proposed use, following a
noticed public hearing, is necessary before such a use can
be established in a particular location, even though the use
is permitted within the zoning district. A conditional use
permit is designed to provide flexibility within a zoning
district. Another traditional purpose of the conditional use
permit is to enable a city to control certain uses which could
have detrimental effects on the community Placing two
Laundromats on Seventeenth Street in such close proximity,
and along one the City's most important arterials, would be
contrary to the policy behind the conditional use permit
requirement.

5. Will the proposed use adversely affect the General Plan or any
specific plan of the City?
Goal 2.0 of the Land Use Element of the City's General Plan
provides that the City shall "promote land uses which
enhance the City's economic and fiscal viability." Approval
of this application would adversely affect the City's ability to
achieve this Goal, as well as Land Use Element Policy
Numbers 2.2, 2.5 and 2.8.
F. In accordance with Public Resources Code section 21080(a)(5), the
proposed project is exempt from further review under the California
Environmental Quality Act because this project is disapproved.
Section 2. The Planning Commission after conducting the public hearing hereby
denies Conditional Use Permit No. 2005-26. This decision is based upon the evidence
submitted at the abovesaid hearing, which includes but is not limited to: the Request for
Planning Commission Action dated November 28, 2005 and exhibits attached thereto;
and the public testimony, all of which are incorporated herein by this reference.
