A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF SANTA ANA APPROVING
CONDITIONAL USE PERMIT NO. 2003-09 TO
EXPAND THE BOUNDARIES OF AN EXISTING
SCHOOL IN THE SINGLE FAMILY RESIDENTIAL
DISTRICT TO INCREASE ON-SITE PARKING
BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF
SANTA ANA AS FOLLOWS:
Section 1. The Planning Commission of the City of Santa Ana hereby
finds, determines and declares as follows:
A. Conditional Use Permit No. 2003-09 came before the Planning
Commission of the City of Santa Ana for a duly noticed public
hearing on May 12, 2003.
• B. The applicant is requesting approval of Conditional Use Permit No.
2003-09 to expand the boundaries of an existing school use to
increase on-site parking in the Single Family Residential (R-1)
district at 1436 West Washington Avenue.
C. Santa Ana Municipal Code Section 41-638 authorizes the Planning
Commission to grant a conditional use permit upon making certain
findings.
1. Will the project provide a service or facility, which will
contribute to the general well being of the neighborhood or
the community?
The property boundaries of the school are being
expanded to accommodate additional on-site parking
spaces for the approved school use. The new
parking lot will contribute to the well being of the
neighborhood by adding eight additional on-site
parking spaces to the property, thus bringing parking
for the approved school facility into closer compliance
with City parking standards. The additional on-site
. parking will reduce the number of cars that will park
on the surrounding residential streets.

• 2. Will the proposed use under the circumstances of the
particular case be detrimental to the health, safety, or
general welfare of persons residing or working in the
vicinity?
The school for religious study has been operating on
this site since 1980 without any known complaints to
the City from persons residing or working in the
vicinity. Expanding the boundaries of the facility so
that additional parking can be provided on-site will not
be detrimental to the health, safety or general welfare
of the community. The parking lot has been designed
to meet or exceed City code and design standards.
An eight-foot high block wall and afive-foot landscape
buffer is being provided between the new parking lot
and R-1 zoned property to help minimize any potential
impacts from car lights and noise that may be
associated with the parking lot being constructed
adjacent to single-family residences. In addition,
parking lot lighting will be limited to 15-feet in height
and will be designed to shine away from adjacent
houses.
• 3. Will the proposed use adversely affect the present economic
stability or future economic development of properties
surrounding the area?
Expanding the boundaries of the school property to
allow additional parking will not adversely affect the
economic development or economic stability of
properties in the surrounding area. Parking is
ancillary to any use or business. The addition of on-
site parking will bring the existing facility into closer
conformance with City parking requirements.
4. Will the proposed use comply with the regulations and
conditions specified in Chapter 41 of the Santa Ana
Municipal Code for such use?
The new parking lot meets all City code and design
standards. While the approved school facility is under
parked as the result of the parking variance approved
in 1979, the addition of the new parking lot improves
on-site vehicular circulation by eliminating dead-end
parking and brings the school into closer compliance
• with City parking standards.

• 5. Will the proposed use adversely affect the General Plan of
the City or any specific plan applicable to the area of the
proposed use?
Expanding the boundaries of the existing school will
have no affect on the City's General Plan. Schools are
permitted within the Low Density Residential (LR)
General Plan designation and are allowed with a
conditional use permit in the Single-Family Residential
(R-1) zoning district. There are no Specific Plans that
have an affect on this project or properties in the
immediate area.
D. In accordance with the California Environmental Quality Act,
Mitigated Negative Declaration and Mitigation Monitoring Program,
Environmental Review No. 2003-94 is approved and adopted .
Section 2. The Planning Commission of the City of Santa Ana
hereby, approves Conditional Use Permit No. 2003-09 as conditioned in Exhibit "A"
attached hereto and incorporated herein.

Conditions for Approval for Conditional Use Permit No 2003-09
Conditional Use Permit No. 2003-09 is approved subject to compliance, to the
reasonable satisfaction of the Planning Manager, with all applicable sections of the
Santa Ana Municipal Code, the California Administrative Code, the Uniform Fire
Code, the Uniform Building Code and all other applicable regulations.
The applicant must comply in full with each and every condition listed below prior
to exercising the rights conferred by this conditional use permit.
The applicant must remain in compliance with all conditions listed below
throughout the life of the conditional use permit. Failure to comply with each and
every condition may result in the revocation of the conditional use permit.
A. Planning Division
1. Any amendment to this conditional use permit must be submitted to the
Planning Division and Police Department for review. At that time, staff
will determine if administrative relief is available or the conditional use
permit must be amended.
• B. Mitigation Measures
1. Building plans for the proposed project shall reflect that an eight-foot high
masonry wall shall be provided between the proposed parking lot and
adjacent residential areas.
2. Building plans for the proposed project shall reflect that light standards
adjacent to residential property shall be no higher than 15 feet and shall
be directed away from residential areas.
3. Construction plans for the proposed project shall reflect the following
notes:
a. All material excavated or graded will be sufficiently watered to
prevent excessive amounts of dust.
b. All clearing and earthwork activities shall cease during period of high
winds (winds greater than 25 mph averaged over one hour) or during
Stage 1 or Stage 2 smog episodes.
c. Streets surrounding the project site should be cleaned at the end of
each day of construction.

• d. All material transported offsite shall either be sufficiently watered or
securely covered to prevent excessive amounts of dust.
e. The amount of area disturbed by clearing and earthwork activities
shall be minimized at all times.
f. To the extent feasible equipment engines shall be maintained in good
condition and in proper tune according to manufacturer's
specifications.
g. To the extent feasible, gasoline powered equipment shall be used for
onsite and offsite construction activities.
4. In the event unknown cultural resources are encountered, all earthwork
activities in the area of the finding shall halt and the City of Santa Ana
Environmental Coordinator shall be contacted for appropriate action.
5. Prior to issuance of a street work permit, the project applicant shall
submit and have approved a grading plan showing the direction and
.means of flow to the adjacent street. The plan must include all applicable
routine and special structural best management practices needed to
ensure N.P.D.E.S and D.A.M.P program compliance. The plans shall
• incorporate post-construction Storm Water Management Plan by
reference. The plan is to include existing and proposed elevations at and
adjacent to all property lines.
6. Construction Plans for the proposed project shall specify that
construction activities shall be limited to the hours of 7 AM to 8 PM
Monday through Friday, 8 AM to 8 PM Saturday, and not permitted on
Sundays or federal holidays.
7. The new and existing parking lot shall be slurry coated to repair any
deteriorated paving and shall be striped to City standards.
C. Police Department
1. The existing building and parking lot lighting must conform to the
provisions of Chapter 8, Article II, Division 3 of the Santa Ana
Municipal Code (Building Security Ordinance). These code
conditions will require that the existing project's lighting, door/window
locking devices and addressing be upgraded to current code
standards. Lighting standards cannot be located in required
landscape planters.
