MINUTES RECOMMENDATION: Approve the minutes of the regular meeting of June 13, 2005. (Commissioner Leo abstained on this item) RECORDING SECRETARY REPORT Pursuant to the Brown Act, the June 13, 2005 Agenda for the Regular Meeting was posted on the door of the City Hall Council Chambers at 22 Civic Center Plaza on June 9, 2005 at 4:23 p.m. RECOMMENDATION: Instruct the Commission Secretary to enter posting into the minutes. CONDITIONAL USE PERMIT NO. 2005-14 (Ann Ni) Filed by La Chiquita Restaurant, to upgrade an existing liquor license from a Type 40 (on-sale beer) to a Type 41 (on sale beer and wine) in the General Commercial (C2) zoning district at 906 East Washington Avenue. COMMISSIONER COMMUNICATION DISCLOSURE (REGARDING AGENDIZED PROJECTS) Chair Mondo met with Discovery Science Center representatives to review environmental matters on Item E. ENVIRONMENTAL REVIEW NO. 2005-126 (Ann Ni) Discovery Science Center is requesting an environmental determination for the proposed future installation of a Delta III rocket within the Specific Development No. 65 (SD-65) zoning district at 301 North Main Place Drive. RECOMMENDATION: Direct the Executive Director of the Planning and Building Agency or its designees to file a Notice of Exemption with the Orange County Clerk's Office at appropriate time. Associate Planner, Ann Ni presented the staff report and recommendation. AMENDMENT TO VARIANCE NO. 2005-01 Filed by Hossein Malakooti, to request modifying Variance No. 2005-01 to facilitate the construction of a new two-story office building at 801 North Ross Street. PUBLISHED IN THE ORANGE COUNTY REPORTER: June 17, 2005 PUBLICLY NOTICED: June 17, 2005 RECOMMENDTION: Adopt a resolution approving amendment to Variance No. 2005-01 as conditioned. Assistant Planner, Pedro Guillen presented the staff report and recommendation. Commission discussion ensued regarding ceiling heights and the landscape proposal. Public Comments (for items not on the agenda) No public comments were made. STAFF AND COMMISSION COMMENTS 3. Staff Comments Ms. Haluza commented on the City Council Workshop held on June 24 at the Bowers Museum facilitated by Steve Pon Tell, consultant with the La Jolla Institute. The City Council reviewed policy and vision direction regarding development issues. A comprehensive report to implement a strategy will be forthcoming to the Planning Commission. At that time, Mr. Trevino offered to entertain questions from the Commission. 4. Planning Commission Comments Commissioner De La Torre • No comments Commissioner Cribb • Requested removal of a dying Palm tree at Pacific Center off Grand Avenue and St. Andrews Street. • Commented that someone is living in a parked black van at 2511 N. Valencia (east side). Vehicle was parked on the street, license number 010MML. • Park Santiago neighborhood residents noticed that City did not close the park gates on Sunday, June 26. Submitted notification to CDA - Regan Candelario to have gates closed. • Commented that the Planning Commission would like to have input on consultant selection. • Commented that annexation of Tustin Island should be reconsidered. Mr. Trevino provided background information on annexation. • Requested removal of couch left on sidewalk at Imperial Promenade on south side of street by MacArthur Blvd. • Requested status of Bagel Me, South Coast Winery in Bombay Bicycle Club and Starbucks projects. Commissioner Leo • Inquired about timeline for City Place tower. Mr. Trevino and Mr. Kaufman responded with current status. • Inquired if developers submitted plans for Farmers Site? Is it gated? Mr. Trevino provided information. • Inquired if City Council considered WIFI (wireless Internet access) in downtown. Mr. Kaufman provided update on City Council technology committee discussions. • Inquired about pending cases involving the City from Supreme Court. Mr. Kaufman indicated there are none-pending. Planning Commission Minutes - 3 - June 27, 2005 • Inquired as to update with Tustin & 17t" Street annexation between Orange County and City of Santa Ana. Mr. Trevino confirmed the on-going communications with the County staff regarding the proposed development. • Requested an update on Bowers expansion. Ms. Haluza provided status on the project. • Inquired about possible tenants for One Broadway Plaza. Mr. Trevino indicated none are known at this time. Commissioner Lutz • Requested removal of burned RV parked at northeast corner at First and Western. • Requested removal of couch left on northwest corner sidewalk at Flower and 10t"Street. Chair Mondo • No comments 5. Excuse of Absences Commissioner Cribb motioned to excuse the absences of Commissioner Gartner and Commissioner Nalle, Seconded by Commissioner De La Torre and unanimously approved by the Commission. 6.
