APPROVAL OF MINUTES RECOMMENDATION: Approve the minutes from the regular meeting of June 10, 2002 n B. RECORDING SECRETARY REPORT RECOMMENDATION: Instruct the Commission Secretary to enter into the minutes. The June 10, 2002 Agenda was posted at the City Hall Council Chambers on June 6, 2002 at 12:45 p.m. B. CONDITIONAL USE PERMIT NO.2002-09 Filed by Yakiharu Kaku, Misen USA, to request approval for the issuance of a Type 41 ABC On-sale Beer and Wine License at an existing establishment located at 2901 W. MacArthur Boulevard, Suite 108, within amulti-tenant center. RECOMMENDATION: Receive and file the staff report approving Conditional Use Permit No. 2002-09. ADDITIONS TO ACCESSORY STRUCTURES Sergio Klotz, Senior Planner, provided the definition of what is considered an accessory structure and outlined the current regulations. He noted that there have been permits requested for additions to garages that concern staff due to their size and style. He advised that staff was proposing to require a Conditional Use Permit for the construction of anything larger than 100 square feet to allow for a more thorough review, and that staff was requesting direction from the Commission. Discussion was held regarding fees, methods for determination of appropriate structur4es by counter staff, and the possibility of utilizing Conditions, Covenants, and Restrictions as a deterrent to illegal occupancy. The Commission expressed concerns with the cost of a Conditional Use Permit for an accessory structure addition and directed staff to prepare a program for review. E. PLANNING COMMISSION MINUTES 3 July 8, 2002 Bill Apple, Associate Planer, provided the staff report and recommendation. Chairman Nalle disclosed that he had met with the applicant. Commissioners Richardson and Mondo disclosed that they had met with Mr. Sundstrom, Mr. Birtcher, and Mr. Ober. Commissioner Leo advised that he had spoke with Mr. Sundstrom on the phone. Discussion was held regarding the possibility of the project including showrooms on the side facint the freeway to attract business. Chairman Nalle opened the public hearing. Robert Sundstrom, representing the applicant, advised the Commission that the applicant concurred with all conditions of approval. He also advised that landscape architects had reviewed the project to ensure that the landscaping would not block the view from the freeway. The trees will be specifically located so that the view would not be blocked if showroom space was desired in the future. Clarification was provided on the window spacing and placement. Commissioner Leo requested clarification regarding the payment of water fees for landscaping. Mr./ Sundstrom advised that those costs were included in the Association fees. There were no additional speakers on the matter. Chairman Nalle closed the public hearing. Motion to recommend that the City Council: 1. ARMSTRONG RANCH DRAFT ENVIRONMENTAL IMPACT REPORT N0.2000-01 Filed by C.J. Segerstom and Sons to receive public comment on the Draft Environmental Impact report for the proposed Armstrong ranch development project located at 1801-2001 West MacArthur Boulevard. PUBLISHED IN THE REGISTER: June 28, 2002 PUBLICLY NOTICED: June 28, 2002 RECOMMENDATION: Receive and file the public comments on Draft Environmental Impact Report No. EIR 2000-01 for the proposed Armstrong Ranch project. Vince Fregoso, Senior Planner, presented the staff report. Written comments from Jim Walker, Santa Ana resident, were provided to Chairman Nalle. Chairman Nalle opened the public hearing. There were no speakers on the matter. Chairman Nalle closed the public hearing. Discussion was held regarding proposed improvements, setbacks, entrances to various areas within the project, traffic flow, and proposed price of the homes. Motion to receive and file public comments on the Draft Environmental Impact Report No. EIR 2000-01 for the pOroposed Armstrong Ranch project. Comments from the Planning Commission Commissioner Doughty • Asked when the next meeting with CalTrans regarding maintenance issues was scheduled. Commissioner Cribb Noted that litter is still at all off-ramps and there has not been any noticeable difference since the meeting. Requested that staff find out when the "No U Turn" sign at Fourth and Birch Streets would be installed. Noted that he had called Code Enforcement on the weekend regarding litter at the northbound 5 freeway and they were unable to refer him to the appropriate staff. Ms. Nelson requested that the Commissioners leave a message regarding their concerns on the Planning Commission Secretary's voice mail so they can be forwarded to appropriate staff and the resolution tracked. Commissioner Verino • Noted disappointment regarding increase in illegal fireworks in the city and the litter that was left. She suggested that an education process in the future could aid in clean-up efforst and discouraging illegal fireworks. • Also noted there appeared to be an increase in car sales at residences. She will forward addresses to staff. Commissioner Mondo • Requested staff to facilitate removal of graffiti from the stop sign at Birch and Columbine and the traffic signal at Flower and MacArthur. Commissioner Leo • Noted that neighborhoods are being overrun by traffic being diverted from the freeway and asked in any studies had been done and what could provide relief. Ms. Nelson advised that there had not been a comprehensive traffic analysis done. Staff will refer concerns to ETAC • Requested status on the proposed Starbucks at Memory Lane and Bristol. Advised they are still in site plan review and she will request an update. • Asked if drought resistant plants were considered for landscaping projects. Ms. Nelson advised that they are and that staff is available who specialize in that area. Commissioner Richardson • Requested that staff provide a presentation on the North Main Street (City Place West) project to allow an opportunity for Commission discussion.
