HomeMy WebLinkAbout2002-16• RESOLUTION N0.2002-16 kdo/06/13/02 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA ANA APPROVING VARIANCE NO. 02-06 FOR THE PROPERTY LOCATED AT 1607-1609 SOUTH SYCAMORE STREET AND 1606 SOUTH MAIN STREET BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The Planning Commission of the City of Santa Ana hereby finds, determines and declares as follows: A. Variance No. 2002-06 came before the Planning Commission of the City of Santa Ana for a duly noticed public hearing on June 10, 2002. B. Applicant is requesting a variance from the Santa Ana Municipal Code • Section 41-1347 (a) and (b), in order to allow a reduction in the parking, to allow less than five parking spaces per 1,000 square feet of gross floor area and to count vehicle repair bays at 1607-1609 South Sycamore Street and 1606 South Main Street. C. The Planning Commission determines that the following findings, which must be established in order to grant a variance from the provisions of the Santa Ana Municipal Code, have been established: 1. That because of special circumstances applicable to the subject property, including size, shape, topography, location, or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges not otherwise at variance with the intent and purpose of the provisions of this chapter. The applicant has operated an automotive body shop along the Main Street property for the past 15 years and has become a fixture along the south Main corridor. The unique nature of the auto body business is such that the strict interpretation of the parking requirements is not appropriate. The auto body business is such that the building is utilized for much of the operation as opposed to automotive repair businesses that require the use of outside parking spaces to • store vehicles. The property has maintained swell-kept Resolution No. 2002-16 Page 1 of 3 • appearance and has long been an example of success along the corridor. 2. That the granting of a variance is necessary for the preservation and enjoyment of one or more substantial property rights. The approval of the variance request is necessary to enjoy the use of the property and in order to accommodate the unique nature of the applicants business, automotive body repair and its operation. The additional floor space on the second floor will be broken down into office and storage, as well as restrooms and a stairwell allowing the applicants successful business to continue to grow. The office and storage uses are considered relatively low in parking impacts and therefore result in a lower parking dependence. Further, the applicant has identified six vehicle repair bays (parking spaces) within the new building. The nature of the auto body business is such that vehicles cannot be left exposed to the elements of Mother Nature and therefore operates differently than other automotive repair businesses. As such, vehicles will not be left outside, occupying open parking spaces. 3. That the granting of a variance will not be materially detrimental to the • public welfare or injurious to surrounding property. The granting of a variance, given the unique nature of the business will not be detrimental or injurious to the surrounding properties. Further, the second floor addition with a mixture of office and storage space utilizes uses that require less parking demand than that of automotive repair. 4. That the granting of a variance will not adversely affect the General Plan of the City. The requested variance will not adversely affect the General Plan, as it does not have a negative impact on the goals and policies expressed in that document. Specifically, the Land Use Element Goal 2: Promote land uses which enhance the City's economic and fiscal viability; and Goal 3: Preserve and improve the character and integrity of neighborhoods will be supported through the approval of the variance request. D. In accordance with the California Environmental Quality Act, the proposed project is exempt from further review. Categorical Exemption Environmental Review No. 2001-130 will be filed for this project. • Section 2. The Planning Commission of the City of Santa Ana after conducting the public hearing hereby approves Conditional Use Permit number 2002-06. Resolution No. 2002-16 Page 2 of 3 • This decision is based upon the evidence submitted at the abovesaid hearing, which includes but not is not limited to: the Staff report and exhibits attached thereto; and the public testimony; all of which are incorporated herein by this reference. Section 3. The action of the Planning Commission is final following consent of .the City Council unless an appeal is filed pursuant to Santa Ana Municipal Code Section 41-645. Once this decision is final, it is subject to judicial review pursuant to California Code of Civil Procedure section 1094.6.
