RESOLUTION NO. 01-42
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SANTA ANA APPROVING VARIANCE NO. 2001-06
IN PART TO ALLOW A SECONDARY WALL SIGNAGE BUT
DENYING NON-CONFORMING MONUMENT SIGNS AT
THE TARGET STORE LOCATED AT 1330 EAST
SEVENTEENTH STREET
BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF
SANTA ANA AS FOLLOWS:
Section 1. The Planning Commission does hereby find, determine and declare as
follows:
A. Variance No. 2001-06 has been filed with the City of Santa
Ana seeking to allow a secondary wall sign on the primary elevation of a Target
store and to allow two non-conforming monument signs to remain on the property
located at 1330 East Seventeenth Street.
• B. Santa Ana Municipal Code Section 41-638 authorizes the
Planning Commission to grant a variance upon making certain findings.
C. The Planning Commission held a duly noticed public hearing on
September 24, 2001, for Variance No. 2001-06.
Section 2. The Planning Commission approves Variance No. 2001-06 in part to
allow secondary wall signage as conditioned in Exhibit "A" attached hereto and
incorporated herein.
Section 3. The Planning Commission denies Variance No. 2001-06 in part to
allow non-conforming monument signs.
Section 4. The Planning Commission makes and adopts the written findings of
fact attached hereto as Exhibit "B" and incorporated herein, in rendering its decision to
approve in part and deny in part Variance No. 2001-06.

CONDITIONS OF APPROVAL FOR VARIANCE NO. 2001-06
Variance No. 01-06 is approved in part subject to compliance, to the reasonable
satisfaction of the Planning Manager, with applicable sections of the Santa Ana
Municipal Code, the California Administrative Code, the Uniform Fire Code, the Uniform
Building Code, and all other applicable regulations. In addition, it shall meet the
following conditions of approval:
The applicant must comply with each and every condition listed below rip or to exercising
the rights conferred by this variance.
The applicant must remain in compliance with all conditions listed below throughout the
life of the variance. Failure to comply with each and every condition may result in the
revocation of the variance.
A. Plannin Division
Secondary signage for Target cannot exceed one item of information.
2. The secondary signage for Target cannot exceed a maximum of 56 square
• feet.
3. Prior to issuance of permits for the secondary signage, the existing
monument signs must be removed from the premises.

FINDINGS OF FACT FOR VARIANCE NO. 2001-06
A. That because of special circumstances applicable to the subject property,
including size, shape, topography, location, or surroundings, the strict application
of the zoning ordinance is found to deprive the subject property of privileges not
otherwise at variance with the intent and purpose of the provisions of this chapter.
Due to the relative size of the lot and the setback of the building from the
street, the installation of additional wall signage will allow Target the ability
to identify new uses and services available within the store. The variance
will also allow Target the ability to use the property in a manner that is
consistent with similar sized uses.
No special circumstances exist on the site that deprives the site of
privileges for the monument signs. Other similar sized projects along the
Seventeenth Street corridor have installed monument signage that is in
compliance with the Sign Code.
B. That the granting of a variance is necessary for the preservation and enjoyment of
one or more substantial property rights.
• The granting of the variance for secondary signage will allow the tenant
the ability to identify a new activity that will be provided within the store.
The variance for monument signage is not necessary to preserve property
rights as the tenant will still maintain the ability to install monument signs,
therefore allowing the ability to identify the business.
C. That the granting of a variance will not be materially detrimental to the public
welfare or injurious to surrounding property.
The secondary signage will not be detrimental to the surrounding area
as a condition of approval has been added that wi11 limit the amount of
secondary signage allowed on the site. This will assist in minimizing the
visual clutter found on structures with multiple wall signs.
The granting of a variance for the monument signage may be detrimental
to the area by allowing excessively large signage on the site that may
contribute to adverse aesthetic impacts along the corridor.
D. That the granting of a variance will not adversely affect the General Plan of the
City.
The granting of the variance will not adversely affect the City's General
• Plan in any way as the land use designation of General Commercial (GC)
allows signage in conjunction with retail uses in the land use designation.
