HomeMy WebLinkAbout2001-39• RESOLUTION NO. 01-39 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA ANA APPROVING CONDITIONAL USE PERMIT NO. 2001-26 TO ALLOW A PRIVATE ELEMENTARY SCHOOL LOCATED AT 1440 EAST SANTA CLARA AVENUE IN THE SINGLE-FAMILY RESIDENCE (R1) ZONE BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The Planning Commission does hereby find, determine and declare as follows: A. Conditional Use Permit No. 2001-26 has been filed with the City of Santa Ana seeking to allow a private elementary school for the property located at 1440 East Santa Clara Avenue in the Single Family Residence (R1) Zone, in the City of Santa Ana, as a conditional use. • B. Santa Ana Municipal Code Section 41-638 authorizes the Planning Commission to grant a conditional use permit upon making certain findings. C. The Planning Commission held a duly noticed public hearing on August 27, 2001, and on September 24, 2001, for Conditional Use Permit No. 2001-26. Section 2. The Planning Commission approves Conditional Use Permit No. 2001-26 as conditioned in Exhibit "A" attached hereto and incorporated herein. Section 4. The Planning Commission makes and adopts the written findings of fact attached hereto as Exhibit "B" and incorporated herein, in rendering its decision to approve Conditional Use Permit No. 2001-26. Norman Assistant City Attorney • RESOLUTION NO. 01-39 Page 3 • EXHIBIT "A" CONDITIONS OF APPROVAL FOR CONDITIONAL USE PERMIT NO. 2001-26 Conditional Use Permit No. 01-26 is approved subject to compliance, to the reasonable satisfaction of the Planning Manager, with all applicable sections of the Santa Ana Municipal Code, the California Administrative Code, the Uniform Fire Code, the Uniform Building Code and all other applicable regulations. The applicant must comply in full with each and every condition listed below rip or to exercising the rights conferred by this conditional use permit. The applicant must remain in compliance with all conditions listed below throughout the life of the conditional use permit. Failure to comply with each and every condition may result in the revocation of the conditional use permit. A. Planning Division 1. The project must remain in compliance with the provisions of Site Plan Review No. DP 01-39 and the attached exhibits. 2. The storage sheds and truck trailer located at the southwest corner of the • site must be removed and be replaced with parking stalls and landscaping per the approved plans for the site. 3. Enrollment for the Orange County Christian Academy shah be limited. to a maximum of 198 K-6 grade students. (Modified by the Planning Commission on September 24, 2001) 4. A working group consisting of the Portola Park Neighborhood Association and the Orange County Worship Center must be created. This group shall meet on asemi-annual basis or as necessary to discuss any and all issues of common concern including, but not limited to, noise and traffic. (Modified by the Planning Commission on September 24, 2001) 5. Access and egress to the site is prohibited from the Wright Street driveway. (Modified by the Planning Commission on September 24, 2001) 6. This project shall be reviewed annually every July in order to monitor potential noise and traffic issues. (Modified by the Planning Commission on September 24, 2001) • RESOLUTION NO. 01-39 Page 4 • B. Public Works Agency Provide funding for a traffic study no later than one month after project approval. The study will be conducted in accordance with City policy and procedures. The applicant will be solely responsible for implementing any and all mitigation measures recommended in the study. • • RESOLUTION NO. 01-39 Page 5 • EXHIBIT "B" FINDINGS OF FACT FOR CONDITIONAL USE PERMIT NO. 2001-23 A. Will the proposed use provide a service or facility which will contribute to the general well being of the neighborhood or the community? The proposed private school will provide an additional educational opportunity for elementary level students that reside in the community. B. Will the proposed use under the circumstances of the particular case be detrimental to the health, safety, or general welfare of persons residing or working in the vicinity? The proposed use will not be detrimental to the health and safety of the surrounding area as the school students will be contained within the interior area of the site. All school functions, including the outdoor playground, have been designed to operate away from surrounding streets. C. Will the proposed use adversely affect the present economic stability or future • economic development of properties surrounding the area? The project will have no affect on the economic stability of the surrounding community. The private school is a noncommercial enterprise affiliated with a nonprofit church facility. D. Will the proposed use comply with the regulations and conditions specified in Chapter 41 for such use? The proposed school had been designed to be in compliance with the requirements specified in Chapter 41 of the Santa Ana Municipal Code. E. Will the proposed use adversely affect the General Plan or any specific plan of the City? The proposed project is in compliance with the Low Residential District (LR-7) land use designation of the General Plan. This district permits the operation of private schools with an approved conditional use permit. •
