A-2008-075-02-01 <br />R <br />t <br />l: <br />FIRST AMENDMENT TO AGREEMENT <br />NOV 0 5 2010 <br />THIS FIRST AMENDMENT TO AGREEMENT is entered into this day of <br />J-eJY)6f_fs 2010, by and between County of San Luis Obispo <br />("Sub-Recipient") and the City of Santa Ana, a charter city and municipal corporation of <br />the State of California ("Grant Administrator"). <br />Recitals: <br />V\ --I. <br />C-- A. The parties entered into Agreement #A-2008-075-02, dated 08/26/08 , (hereinafter <br />"said Agreement") to assist public safety agencies in the acquisition of, deployment <br />lsl? of or training in the use of regional interoperable communications systems for FY07 <br />Public Safety Interoperable Communications (PSIC). <br />Q B. The Grant Administrator previously adopted a resolution authorizing the City Manger <br />and the Chief of Police to execute a grant award agreement with the State of <br />California Emergency Management Agency (previously the Office of Homeland <br />Security (OHS) for the FY2007 Public Safety Interoperable Communications (PSIC) <br />funding program in the amount of $12,748,170. <br />C. The Grant Administrator was awarded additional funding in the amount of $196,774 <br />from the California Emergency Management Association (previously the Governor's <br />Office of Homeland Security) for the PSIC Grant Program, which was accepted by <br />the Santa Ana City Council in Resolution No. 2009-054, which also authorized and <br />directed the City Manager and Chief of Police, or their designees, to accept and <br />authorize the additional grant award, and to take any necessary action to obtain this <br />funding and sub-grant the same. <br />D. In accordance with the terms and conditions of said Agreement, the parties wish to <br />extend the term of said Agreement and update the reimbursement to the Sub- <br />Recipients based upon the remaining funding and the federal government's extension <br />of the term of the grant. <br />Wherefore, in consideration of the covenants contained in said Agreement, and subject <br />to all the terms and conditions of the Agreement, except those amended in this First <br />Amendment to Agreement, the parties agree as follows: <br />1. Section 201, TIME OF PERFORMANCE, shall be amended to extend the term of <br />said Agreement to end on June 30, 2011 or upon the final disbursement of the Grant <br />Amount (as defined in Section 201) and any additional period of time as is required to <br />complete any necessary close out activities. <br />2. Except as hereinabove modified, all terms and conditions of said Agreement shall <br />remain in full force and effect.
