HomeMy WebLinkAbout2001-28• RESOLUTION NO.O1- 28 A RESOLUTION OF THE ZONING ADMINISTRATOR OF THE CITY OF SANTA ANA APPROVING CONDITIONAL USE PERMIT N0.2001-17 TO ALLOW A TYPE 41 ALCOHOL BEVERAGE CONTROL LICENSE AT RUBIO' S BAR AND GRILL LOCATED AT 2 EAST HUTTON CENTER DRIVE, SUITE 200 WHEREAS, Conditional Use Permit No. 2001-17 came before the Zoning Administrator for a public hearing on June 13, 2001, to allow a Type 41 Alcohol Beverage Control License for on- premise consumption of beer and wine at Rubio' Bar and Grill located at 2 Hutton Center Drive, Suite 200, Santa Ana; WHEREAS, a Mitigated Negative Declaration and Mitigation Monitoring Program for Environmental Review No. 00-164 has been prepared for the project; and NOW, THEREFORE, BE IT RESOLVED BY THE ZONING ADMINISTRATOR OF THE CITY OF SANTA ANA AS FOLLOWS: A. Will the proposed use provide a service or facility which will contribute to the general well being of the neighborhood or community? • The proposed use will provide an ancillary service to the restaurant and thereby benefit the community by providing an additional food related amenity at an eating establishment. Cond%xiova~ have been placed on the Alcoholic Beverage Control license which will mitigate ~~ry potential impacts created by the use and ensure that the use will not negati :rely affect the surrounding community. B. Will the proposed use under the circ;~~::~ristances of the particular case be detrimental to the health, safety, or general welfare of ~aersons residing or working in the vicinity? The proposed use, the addition of the Alcoholic Beverage Control license to the existing restaurant, will not be detrimental to persons residing or working in the area because the use, as conditioned, will not create any negative or adverse impacts. The sale of alcoholic beverages will occur inside of the premises and is incidental to the restaurant use. Moreover, conditions are imposed to mitigate any potential impacts to those in the vicinit~~. C. Will the proposed use adversely affect the present economic stability or future economic development of properties su`°rcunding the area? • 1 The 1.5-acre site is a commercial retail center that is suitable for the proposed use. The addition of alcoholic beverages to the menu at Rubio's Baja Grill should increase the patronage to the restaurant, thereby enhancing the profitability of the business and identifying the use and site as economically stable and viable for the surrounding properties in the area. D. Will the proposed use comply with the regulations and conditions specified in Chapter 41 for such use? As conditioned, the proposed project will be in compliance with all applicable regulations and conditions imposed on a restaurant selling beer and wine, pursuant to Chapter 41 of the Santa Ana Municipal Code. E. Will the proposed use adversely affect the General Plan or any specific plan of the City? The proposed use will not adversely affect the General Plan. Restaurants and ancillary uses such as Alcoholic Beverage Control licenses are permitted within the General Commercial (C2) zoning district and the General Commercial (GC) General Plan designation. Additionally, the use as conditioned is in compliance with the regulations identified in the zoning code. 2. The Mitigated Negative Declaration and Mitigation Monitoring Program for • Environmental Review No. 00-164 is hereby approved and adopted. Pursuant to Title XIV, California Code of Regulations ("CCR") § 735.5(c)(1), it has been determined that, after considering the record as a whole, there is no evidence that the proposed project will have the potential for any adverse effect on wildlife resources or the ecological habitat upon which wildlife resources depend. The proposed project exists in an urban environment characterized by paved concrete, roadways, surrounding buildings and human activity. Therefore, pursuant to Fish and Game Code § 711.2 and Title XIV, CCR § 735.5(a)(3), the payment of Fish and Game Department filing fees is not required in conjunction with this project. 3. Conditional Use Permit No. 2001-17 is hereby approved, subject to conditions, as set forth in Attachment A, attached hereto and incorporated herein.
