HomeMy WebLinkAbout2001-20RESOLUTION NO.O1-20 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA ANA APPROVING VARIANCE NO. 01-02 IN PART TO ALLOW A FREESTANDING SIGN AND WALL SIGNS AND DENYING A FREEWAY PYLON SIGN FOR THE PROPERTY LOCATED AT 2901 TECH CENTER DRIVE WHEREAS, Variance No. 01-02 came before the Planning Commission for a public hearing seeking approval for a freestanding sign not within the four foot landscaping requirement and exceeding the maximum length and area allowed; for wall signs to be located above the first story; and for a freeway pylon sign over 100 square feet and locate more than 300 feet from a freeway exit; WHEREAS, Mitigated Negative Declaration and Mitigation Monitoring Program, Environmental Review No. 00-171 has been prepared for this Project; WHEREAS, Santa Ana Municipal Code Section 41-638 authorizes the Planning Commission to grant a variance upon making certain findings; • NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the above-said hearing, the Planning Commission finds and determines as follows: A. That because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, that the strict application of the zoning ordinance is found to deprive the subject property of privileges not otherwise at variance with the intent and purpose of the provisions of this Chapter. The project site is irregular in shape and has limited frontage along Tech Center Drive, which prohibit the flexibility of building placement and circulation. The variance for setback and landscape buffer reduction is necessary in order to allow this property to be utilized in a manner that is consistent with similar surrounding industrial use. B. That the granting of a variance is necessary for the preservation and enjoyment of one or more substantial property rights. The granting of the variance for freestanding sign is necessary for the preservation and enjoyment of one or more substantial property rights since the proposed • freestanding sign will allow proper identification of the development to visitors without further interrupting the 10-foot setback with another sign structure. The • sign is designed in a way to be non-intrusive and consistent with other industrial business park in the vicinity. The granting of the variance for wall sign is necessary for the preservation and enjoyment of one or more substantial property rights since the proposed wall signs will allow the tenant the ability to identify the name of the business to visitors without removing the entry canopies. The variance for the freeway pylon sign is not necessary to preserve property rights, as the tenant will maintain the ability to install wall signs, therefore allowing the ability to identify the business. C. That the granting of a variance will not be materially detrimental to the public welfare or injurious to surrounding property. The granting of variances for a freestanding sign and wall signs will not be materially detrimental to the public welfare or injurious to surrounding property as proposed since conditions of approval has been added that will limit the size of wall signs allowed on the site which will assist in minimizing the visual clutter found on structures with multiple wall signs. The granting of a variance for the freeway pylon sign may be detrimental to the • area by allowing excessively large signage on the site that may contribute to adverse aesthetic impacts along the State Route 55. In an effort to improve the overall aesthetics and reduce sign blight along one of the Freeways, it is critical to only permit freeway pylon signs that fully comply with code. D. That the granting of a variance will not adversely affect the General Plan of the City. The granting of Variance No. 01-02 will not adversely affect the General Plan of the City since the proposed industrial park was designed in conformance with City Zoning, Development, and General Plan requirements. Signage is ancillary to the project and a necessary component of an industrial development. 2. Mitigated Negative Declaration and Mitigation Monitoring Program, Environmental Review No. 00-171, is hereby approved and adopted. Pursuant to Title XIV, California Code of Regulations ("CCR") § 735.5(c)(1), the Planning Commission has determined that, after considering the record as a whole, there is no evidence that the proposed project will have the potential for any adverse effect on wildlife resources or the ecological habitat upon which wildlife resources depend. The proposed project exists in an urban environment characterized by paved concrete, roadways, surrounding buildings and human activity. Therefore, pursuant to Fish and Game Code § 711.2 and Title XIV, CCR § 735.5(a)(3), the payment of Fish and Game Department filing fees is not required in conjunction with this project. • • 3. Variance No. 01-02 is hereby approved in part as to the freestanding sign and wall signs, subject to conditions, as set forth in Attachment A, attached hereto and incorporated herein. 4. Variance No. 01-02 is hereby disapproved in part as to the request for a freeway pylon sign. Norman Assistant City Attorney • 3 ~~SOLUTION NO.Ol-20 AY 29, 2001 PAGE 1 OF 1 Conditions for Approval Variance No. 2001-02 is approved subject to compliance, to the reasonable satisfaction of the Planning Manager, with all applicable sections of the Santa Ana Municipal Code, the California Administrative Code, the Uniform Fire Code, the Uniform Building Code and all other applicable regulations. The applicant must comply in full with each and every condition listed below prior to exercising the rights conferred by this variance. The applicant must remain in compliance with all conditions listed below throughout the life of the variance. Failure to comply with each and every condition may result in the revocation of the variance. A. Planning Division 1. Any modifications to this variance must be submitted to the Planning Division for review. • 2. The letter height for the wall signage shall be reduced to 30 inches. 3. No signs shall be placed on the first floor. Mitigation Measures 4. The applicant shall coordinate with the Orange County Airport Land Use Commission prior to approval of the final subdivision map. • ATTACHMENT A
