HomeMy WebLinkAbout2001-16i RESOLUTION NO.O1-16 A RESOLUTION OF THE ZONING ADMINISTRATOR OF THE CITY OF SANTA ANA RECOMMENDING APPROVAL OF TENTATIVE PARCEL MAP NO. 2000-106, TO SUBDIVIDE THE PACIFICENTER MARKET PLACE INTO FIVE PARCELS LOCATED AT 1750 EAST EDINGER AVENUE (TPM N0.2000-106) WHEREAS, Tentative Parcel Map No. 2000-106 has been filed to subdivide the existing 16.2 acre PacificCenter Markertplace parcel into 5 parcels located at 1750 East Edinger Avenue (the "Project"); WHEREAS, the design and improvement proposed for Tentative Parcel Map No. 2000-106 is consistent with the objectives, policies, general land uses, and programs specified in the City of Santa Ana General Plan; WHEREAS, Mitigated Negative Declaration and Mitigation Monitoring Program for Environmental Review No. 2000-23 has been prepared for the Project; WHEREAS, the Zoning Administrator held a duly noticed public hearing, on May 9, 2001, on Tentative Parcel Map No. 2000-106 for the Project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the above said hearing, the Zoning Administrator finds and determines as follows: A. The proposed project, as conditioned, and its design and improvements are consistent with the Industrial (I) designation of the General Plan and are otherwise consistent with all other elements of the General Plan. Tentative Parcel Map No. 2000-106 will have no adverse affect on the land uses as prescribed by the General Plan. The project will only create new property lines and will not otherwise alter the project as approved. B. The proposed project, as conditioned, conforms to all applicable requirements of the zoning and subdivision codes as well as other applicable City ordinances. Tentative Parcel Map No. 2000-106 is in keeping with the provisions of Specific Development Plan No. 69 (SD-69) which outlines the allowed uses and development standards for the site. The project has been reviewed by City staff who has found that the project is consistent with SD-69 and Chapter 34 of the Santa Ana Municipal Code. These provisions pertain to the subdivision of land and development standards for the site. • . The proposed lot sizes meet the minimum required size of 25,000 square feet as outlined in the specific development plan. Four of the subject parcels have been previously approved for development. There are no physical constraints on the site to preclude development of the fifth parcel. D. The design and improvements of the proposed project will not cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. The parcel map will not cause any environmental damage nor injure fish or wildlife as the site is currently occupied by commercial structures. In addition, no fish or wildlife was identified as residing on the project site during the environmental review of this project. E. The design or improvements of the proposed project will not cause serious public health problems. No alterations are proposed to the development project that will lead to serious damage or create public health problems. Prior approvals for this site to allow the construction of a new Home Depot and garden center, Staples office supply and two fast food restaurants have previously been analyzed to ensure that no environmental or health problems would be created. As a result, approval of Tentative Parcel Map No. 2000-106 will not affect the health or safety of persons residing in the vicinity. ~. The design or improvements of the proposed project will not conflict with the easements acquired by the public at large for access through or use of property within the proposed project. Approval of the tentative parcel map will not create any conflicts with existing easements found on the site. As a condition of approval of the parcel map, conditions, covenants and restrictions (CC&R's) were reviewed and approved and will be recorded with the final map. These CC&R's will ensure that the appropriate easements such as access, egress, drainage, utility and other necessary easements are maintained over the five parcels. 2. Mitigated Negative Declaration and Mitigation Monitoring Program for Environmental Review No. 01-24 is hereby approved and adopted. Pursuant to Title XIV, California Code of Regulations ("CCR") § 735.5(c)(1), the Zoning Administrator has determined that, after considering the record as a whole, there is no evidence that the proposed project will have the potential for any adverse effect on wildlife resources or the ecological habitat upon which wildlife resources depend. The proposed project exists in an urban environment characterized by paved concrete, roadways, surrounding buildings and human activity. Therefore, pursuant to Fish and Game Code § 711.2 and Title XIV, CCR § 735.5(a)(3), the payment of Fish and Game Department filing fees is not required in conjunction with this project. 3. Tentative Parcel Map No. 2000-106 is hereby recommended for approval, as conditioned in attachment A, attached hereto and incorporated herein. 2 • ADOPTED this 4th day of May, 2001. Norman Assistant City Attorney r~ ~J • RESOLUTION NO.Ol-16 • MAY 9, 2001 PAGE 1 OF 2 Conditions for Approval Should Tentative Parcel Map No. 2000-106 be approved, the project shall comply with all applicable sections of the Santa Ana Municipal Code, the California Administrative Code, the Uniform Fire Code, the Uniform Building Code and all other applicable regulations. The applicant must comply in full with each and every condition listed below prior to exercising the rights conferred by this parcel map. The applicant must remain in compliance with all conditions listed below throughout the life of the parcel map. Failure to comply with each and every condition may result in the revocation of the parcel map. A. Planning Division 1. Comply with Development Review Committee comments dated August 25, 1999 for Site Plan Review DP No. 99-060. • 2. The Final Map and Approved CC&R's must be recorded within two years of the date of approval of the tentative map by the City Council. 3. Two copies of the recorded Final Map and CC&R's must be submitted each to the Planning Division and Public Works Agency within 10 days of recordation. 4. All development within the area of the map is subject to development and permit fees in effect at the time of permit issuance. 5. All development within the area of the map is subject to all design and development standards in effect at the time of permit issuance. 6. The tentative map, final map and all improvements required to be made or installed by the subdivider will be in accordance with the design standards and specifications of the Santa Ana Municipal Code and the requirements of the State Subdivision Map Act. • ATTACHMENT A RESOLUTION NO.OI-16 MAY 9, 2001 PAGE 2 OF 2 7. Project landscaping must be maintained and include the minimum levels of plant materials required on the approved landscape plan. 8. Project Architecture for all the uses in this development shall maintain the architecture established and approved through DP 98-138. Mitigated Measures 9. Prior to approval of a Final Subdivision Map, the applicant shall coordinate with the Orange County Airport Land Use Commission. • •
