A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF SANTA ANA APPROVING
CONDITIONAL USE PERMIT NO. 01-07 TO ALLOW
AFTER HOURS OPERATIONS OF MORTON'S OF
CHICAGO RESTAURANT LOCATED AT 1641 WEST
SUNFLOWER AVENUE
WHEREAS, Ordinance No. NS-2213 requires a conditional use permit for any eating
establishment open any time between the hours of 12:00 a.m. and 5:00 a.m. and within 150 feet of a
residentially zoned or uses property;
WHEREAS, the applicant, Morton's of Chicago Restaurant, is to be relocated within 150
feet of a residential project,
WHEREAS, Conditional Use Permit No. 01-07 came before the Planning Commission for
a public hearing on April 23, 2001, to allow after hours operation at a new Morton's of Chicago
Restaurant to be located at 1641 West Sunflower Avenue;
WHEREAS, following said public hearing, the Planning Commission determined to
approve Conditional Use Permit No. 01-07, subject to conditions;
• NOW, THEREFORE, BE IT RESOLVED BY THE ZONING ADMINISTRATOR OF
THE CITY OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid hearing the Planning Commission
finds and determines as follows:
A. Will the proposed use provide a service or facility which will contribute to the general well
being of the neighborhood or community?
The restaurant currently serves the community by providing an upscale eating
establishment within awell-maintained village setting. The ability to operate
between midnight and 2:00 a.m. will allow the restaurant to provide a service to
patrons desiring to dine after midnight during holidays and special occasions.
B. Will the proposed use under the circumstances of the particular case be detrimental to the
health, safety or general welfare of persons residing or working in the vicinity?
The proposed late night operation will not be detrimental to persons residing and
working in the area as the use, as conditioned, will not create any negative or
adverse impacts such as noise or loitering.

C. Will the proposed use adversely affect the present economic stability or future economic
development of properties surrounding the area?
The 17.2 acre site is an existing retail shopping development that is suitable for the
restaurant project. The allowance of the late night hours will complement the
economic stability of the area by providing additional opportunities for generating
revenues for the restaurant and the Village through the attraction of additional
patrons.
D. Will the proposed use comply with the regulations and conditions specified in Chapter 41
for such use?
The proposed project will be in compliance with all applicable conditions and
regulations specified in Specific Development Plan No. 48 (SD-48), Chapter 41 of
the Santa Ana Municipal Code, and all other State and local regulations.
E. Will the proposed use adversely affect the General Plan or any specific plan of the City?
The proposed project will not adversely affect the General Plan. Restaurants are
permitted within the General Commercial (GC) General Plan designation.

2. Conditional Use Permit No. 01-07 is hereby approved, subject to conditions, as set forth
in Attachment A, attached hereto and incorporated herein
