HomeMy WebLinkAbout2001-06 RESOLUTION NO.O1-06 • A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA ANA APPROVING A CONDITIONAL USE PERMIT TO ALLOW AN ADULT DAY CARE FACII.ITY IN THE SINGLE-FAMILY RESIDENTIAL ZONING DISTRICT LOCATED AT 2000 NORTH FAIRVIEW STREET WHEREAS, Santa Ana Municipal Code section 41-232.5 and Zoning Ordinance Amendment No. 00-08 require a conditional use permit to allow an adult day care facility in the single-family residential zone; and WHEREAS, this Commission held a public hearing on March 26, 2001, on Conditional Use Permit Application No. 01-02, to allow an adult day care facility in the single-family residential zoning district located at 2000 North Fairview Street. NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing, this Commission finds and determines as follows: A. Will the proposed use provide a service or facility which will contribute to the general well being of the neighborhood or the community. The proposed use is a service use operating within an existing church facility, Wintersburg Presbyterian Church. The adult day care program is a non- denominational not-for-profit program that provides adult support service to the community. The program assists adults 55 years or older with basic activities or daily living. The family support services operate on a daily basis from 8:00 a.m. to 5:00 p.m. Monday through Friday. Although the Wintersburg property is zoned residential, no neighborhood traffic impacts will be generated by this use since access to the site is from Fairview Street, a major arterial street. The 328 parking spaces on the site will satisfy the parking requirements of the weekday operation of the church and the adult day care. B. Will the proposed use, under the circumstances of the particular case, be detrimental to the health, safety or general welfare of persons residing or working in the vicinity. The adult day care use will not negatively impact the residents or workers in the area since the day care program operates exclusively on the site surrounded by walls and fences for the safety of the participants and staff. Keiro Services offers a comprehensive program providing a variety of health, social, and activities in a • • • protective environment. The adult day care service program is monitored by the Department of Social Services, the Department of Education, an advisory council, and the management and Board of the parent organization, Keiro Services. The provider may service approximately 40 to 44 adults with a minimum staff to client ratio of not less than one staff member providing care and supervision for each 15 clients present according to the California Department of Social Services. ~...~ C. Will the proposed use adversely affect the present economic development of property in the surrounding area. The adult day care facility is a service use that will not affect the economic viability of the surrounding residential and commercial properties. The facility will serve approximately 40 adult clients brought to the site by their families or the Keiro van to participate in a variety of supervised activities. D. Will the proposed use comply with the regulations and conditions specified in this chapter for such use. Prior to exercising the conditional use permit, the applicant must comply with the California Building Code handicap and building safety requirements. Additionally, the Planning Division and the Public Works Agency have conditions • that must be met prior to releasing the certificate of occupancy. Once the improvements have been completed, the proposed use will be in compliance with the regulations and conditions in the Santa Ana Municipal Code, the conditional use permit will be valid. E. Will the proposed use adversely affect the general plan of the city or any specific plan applicable to the area of the proposed use. The proposed adult day care use is consistent with the General Plan's Land Use Element policy to "encourage the development of commercial and nonprofit recreational facilities and services". This program offers support to families with adult members requiring supervised care and recreational activities. 4. Conditional Use Permit No. 01-02 is hereby approved as conditioned in Attachment A, attached hereto and incorporated herein. Norman Assistant City Attorney u • • RESOLUTION NO. 01-06 • MARCH 26, 2001 PAGE 1 OF 1 Conditions of Approval Should the Planning Commission approve Conditional Use Permit No. 01-02 the approval is subject to compliance, to the reasonable satisfaction of the Planning Manager, with all applicable sections of the Santa Ana Municipal Code, the California Administrative Code, the Uniform Building Code and all other applicable regulations. The applicant must comply in full with each and every condition listed below prior to exercising the rights conferred by this conditional use permit. The applicant must remain in compliance with all conditions listed below throughout the life of the conditional use permit. Failure to comply with each and every condition may result in the revocation of the conditional use permit. A. Planning Division • 1. Comply with all conditions and requirements as stated in DP 00- 12 and the exhibits of this conditional use permit. 2. File and record a Lot Line Adjustment to consolidate the two lots into one development parcel. 3. Construct a client drop-off/loading zone. 4. Keiro Services may serve up to 45 adult clients Monday through Friday from 8:00 a.m. to 5:00 p.m. B. Building Division 1. Compliance with the California Building Code for change in occupancy classification. C. Police Department 1. The existing building and parking lot, within 60 feet of the building, must conform with the provision of Chapter 8, Article II, Division 3 of the Santa Ana Municipal Code. • ATTACHMENT A
