RESOLUTION NO. 00-32
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF SANTA ANA APPROVING CON-
DITIONAL USE PERMIT NO. 99-07 TO ALLOW A
SERVICE STATION LOCATED AT 1700-1720 EAST
DYER ROAD
WHEREAS, this Commission held a public hearing on October 9, 2000, to allow
modifications to Conditional Use Permit Application No. 99-07.
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE
CITY OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid hearing, this Commission finds and
determines as follows:
A. Will the proposed use provide a service or facility which will contribute to the general
well being of the neighborhood or community?
A new service station providing gasoline sales, food and office space will provide
a benefit to the surrounding area and the motoring public by furnishing food and
• automobile services adjacent to State Route 55.
B. Will the proposed use under the circumstances of the particular case be detrimental to the
health, safety or general welfare or persons residing or working in the vicinity?
The site will be designed as to not interfere with off-site circulation and allow
ingress and egress from the site in a safe manner. The new facility will meet code
requirements and standards for a service station, food use and office use.
C. Will the proposed use adversely affect the present economic stability of future economic
development of properties surrounding the area?
The currently vacant office building will be demolished to allow the construction
of a new state of the art service station and parking area. Anew service station
with a food use and office component will provide services to the adjacent
industrial areas and boost the economic revitalization to the area.
D. Will the proposed use comply with the regulations and conditions specified in Chapter 41
of the Santa Ana Municipal Code for such a use?
The project has been designed to meet all Municipal Code requirements for a
• service station with a food and office component.
• E. Will the proposed use adversely affect the General Plan or any specific plan of the City?
A commercial use such as a service station with a food and office use is consistent
with the General Plan land use designation of General Commercial.
2. Modifications to Conditional Use Permit No. 99-07 is hereby approved as conditioned in
Attachment A, attached hereto and incorporated herein.

Conditions for Approval
Modifications to Conditional Use Permit No. 99-07 is approved subject to
compliance, to the reasonable satisfaction of the Planning Manager, with
all applicable sections of the Santa Ana Municipal Code, the California
Administrative Code, the Uniform Fire Code, the Uniform Building Code and
all other applicable regulations.
The applicant must comply in full with each and every condition listed
below prior to exercising the rights conferred by this conditional use
permit.
The applicant must remain in compliance with all conditions listed below
throughout the life of the conditional use permit. Failure to comply with
each and every condition may result in the revocation of the conditional
use permit.

~ 1. Comply with the revised plans submitted for Conditional Use
Permit No. 99-07 in this report and all conditions and
requirements from the Development Review Committee (DRC} for
the development project (DP No. 97-67) (Modified by the
Planning Commission October 9, 2000).
2. All future development is subject to the fees in effect at the
time of permit issuance.
3. Reciprocal access easement agreement shall remain in effect in
accordance with tentative Parcel Map No. 97-221 between Parcels
one and two and the Carl's Jr. restaurant site located at 1720
East Dyer Road.
4. Grading, Demolition, and Building Plans for the proposed
project shall specify that construction activities shall be
limited to the hours of 7:00 a.m. to 8:00 p.m. Monday through
Friday, Saturday 8:00 a.m. to 8:00 p.m. and not permitted on
Sundays or federal holidays.
