A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF SANTA ANA APPROVING CON-
DITIONAL USE PERMIT NO. 00-13 TO PERMIT
CONSTRUCTION OF A RECYCLING FACIIITY
LOCATED AT 1035 EAST FOURTH STREET
WHEREAS, Santa Ana Municipal Code Section 41-489.5(0) allows construction of
recycling facilities in a M-2 zone district, subject to a conditional use permit; and
WHEREAS, Santa Ana Municipal Code Section 41-472.5(a) allows office uses occupying
more than 30 percent of the gross floor area of an industrial facility, subject to a conditional use
permit; and
WHEREAS, this Commission held a public hearing on August 28, 2000, on Conditional
Use Permit Application No. 00-13, to allow construction of a recycling facility, located in a M-2
zone, and office uses occupying more than 30 percent of the gross floor area of an industrial facility
located at 1035 East Fourth Street.
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE
CITY OF SANTA ANA AS FOLLOWS:
1. The Mitigated Negative Declaration and Monitoring Program for Environmental Review
No. ER 00-071 is hereby approved and adopted.
2. Based upon the evidence submitted at the abovesaid hearing, this Commission finds and
determines as follows:
A. Will the proposed use provide a service or facility which will contribute to the general well
being of the neighborhood or the community?
The proposed recycling facility will contribute to the general well being of the
community by providing a service to handle the recycling needs of the community.
B. Will the proposed use under the circumstances of the particular case be detrimental to the
health, safety, or general welfare of persons residing or working in the vicinity?
The recycling facility proposed will meet the city's development and operational
requirements for such facilities. A 10-foot block wall is proposed at the perimeter
of the property to screen the visual and noise impact to the surrounding properties.
C. Will the proposed use adversely affect the present economic stability or future economic
development of properties surrounding the area?
The proposed project meets the city's development standards for a recycling facility.
The site is currently vacant and the proposed use of the property is consistent with
the surrounding area. The development of this site is in conformance with the City's
requirements and will help the economic stability of the area.
D. Will the proposed use comply with the regulations and conditions specified in Chapter 41
for such use?
The proposed use meets the City's development standards for the type of use
proposed. Specifically, parking, landscaping, fencing, and circulation are proposed
in compliance with code.
E. Will the proposed use adversely affect the General Plan or any specific plan of the City?
The proposed recycling facility is designed to be compatible with the surrounding
environment, which will not adversely affect the General Plan and is consistent with
the goals and objectives of the Industrial (IND) General Plan designation.
3. Conditional Use Permit No. 00-13 is hereby approved as conditioned in Attachment A,
attached hereto and incorporated herein.

Conditional Use Permit No. 00-13 is approved subject to compliance, to the
reasonable satisfaction of the Planning Manager, with all applicable
sections of the Santa Ana Municipal Code, the California Administrative
Code, the Uniform Fire Code, the Uniform Building Code and all other
applicable regulations.

submitted to the Planning Division for review.
2. The grading plan for the site shall be approved by the
Public Works Agency and the case planner prior to approval
of the landscape plan. An approved copy of the grading plan
must be submitted with the landscape plan.
3. After project occupancy, landscaping is to be maintained to
include the minimum level of plant materials installed at
the time of occupancy.
4. The required 24-inch boxed trees along both Fourth and Sixth
Streets frontage shall be upgraded to 36-inch boxed trees.
5. The site shall be maintained free of litter and any other
undesirable materials, and will be cleaned of loose debris
on a daily basis.
6. Public payphones, if provided, may only be located within
buildings or in the interior of the site.

Mitigation Measures
7. Building plans for the proposed project shall reflect that on-
site lighting on the property is located in such a manner that
the direct rays of the lighting are confined to the property.
8. Grading plans for the proposed project shall reflect that during
demolishing, earthwork and hauling activities, the contractor
shall control fugitive dust emissions by regular watering, or
other dust-preventive measures to the extent feasible to comply
with SCAQMD Rule 403:
• All material excavated or graded will be sufficiently watered
to prevent excessive amounts of dust. Watering with complete
coverage shall occur at least twice daily, once in the late
morning and once after work is done for the day.
• All clearing and earthwork activities shall cease during
• period of high winds (winds greater than 25 mph averaged over
one hour) or during Stage 1 or Stage 2 smog episodes.
• Streets surrounding the project site should be cleaned at the
end of each day of construction.
• All material transported offsite shall either be sufficiently
watered or securely covered to prevent excessive amounts of
dust.
• The amount of area disturbed by clearing and earthwork
activities shall be minimized at all times.
• To the extent feasible equipment engines shall be maintained
in good condition and in proper tune according to
manufacturer's specifications.
• To the extent feasible, gasoline powered equipment shall be
used for onsite and offsite construction activities.
9. In the event unknown archaeological resources or unknown human
remains are discovered during construction activities, all
• construction activity within the area of the finding shall halt
and the City's Environmental Coordinator shall be contacted for
appropriate action.

10. Prior to the building permits, the applicant shall provide to
the City a copy of the General Industrial NPDES permit and a
detailed storm water pollution prevention plan.
11. Prior to the issuance of building permits, the applicant shall
submit for approval a surface drainage/grading/erosion control
plan. The drainage plan shall reflect structural Best
Management Practices to minimize surface water runoff impacts.
12. Grading, Demolition, and Building Plans for the proposed
project shall specify that construction activities shall be
limited to the hours of 7:00 a.m. to 8:00 p.m. Monday through
Friday, Saturday 8:00 a.m. to 8:00 p.m. and not permitted on
Sundays or federal holidays.
13. The applicant shall comply with all mitigation measures of
Negative Declaration, Environmental Review No. 00-071.
