RESOLUTION NO.00-23
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF SANTA ANA APPROVING CON-
DITIONAL USE PERMIT NO. 00-08 TO PERMIT A
SCHOOL FACILITY FOR THE DEVELOPMENTALLY
DISABLED AT THE CHURCH OF CHRIST LOCATED
AT 3922 WEST FIFTH STREET
WHEREAS, this Commission held a public hearing on June 12, 2000, on Conditional Use
Permit Application No. 00-08, to allow a school facility for the developmentally disabled at the
Church of Christ located at 3922 West Fifth Street.
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE
CITY OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid hearing, this Commission finds and
determines as follows:
A. Will the proposed use provide a service or facility which will contribute to the general well
being of the neighborhood or the community?
The proposed school will provide a facility to actively and successfully provide
~` physically and mentally disabled persons the training and life skills necessary to
integrate into the community. In this respect the school will provide a service that
will contribute to the general well being of the community.
B. That the proposed use will not, under the circumstances of the particular case, be
detrimental to the health, safety, or general welfare of persons residing or working in the
vicinity.
The school has been limited to a training facility for physically and/or mentally
disabled adults that do not drive but are brought to the facility by separate
transportation. This, and the fact that the proposed school use exceeds the City's
parking requirements, should reduce potential parking impacts to persons residing
and working in the vicinity since students will be provided transportation to and
from the facility. Any future school that does not meet this criterion would
require a new conditional use permit approval.
In addition, a proposed condition of approval for the project requires that the
school and the church operate on different days of the week. This condition
should help to eliminate overflow parking into the neighborhood since each of the
proposed uses meet City parking code requirements and will not operate at the
• same time. Finally, the hours of operation for the school have been limited to no
earlier than 8:00 a.m. or later than 7:00 p.m. Monday through Friday. These
conditions are proposed to help ensure that the school remains a good neighbor.
Given the conditions imposed on this project, it is not anticipated that the
proposed school use, under the circumstances of this particular case, will be
detrimental to the health, safety, or general welfare of persons residing or working
in the vicinity.
C. That the proposed use will not adversely affect the present economic stability or future
economic development of property in the sunrounding area.
The addition of the school will maximize the use of the property Monday through
Friday when the church is not in operation. The school will provide a benefit to the
community by providing a learning facility where physically and mentally
disabled persons are taught the life skills necessary to successfully integrate into
the community. The school will enhance the economic stability and future
economic development of property in the surrounding area by maintaining the
property and providing a needed service to the community at large.
D. That the proposed use will comply with the regulations and conditions specified in this
chapter for such use.
The proposed school use will comply in all respects with all applicable sections of
the Santa Ana Municipal Code, the California Administrative Code, the Uniform
Fire Code, the Uniform Building Code, and all other applicable regulations. The
school use requires the approval of a conditional use permit which has been
conditioned to minimize impacts that might be associated with the proposed
project.
E. That the proposed use will not adversely affect the general plan of the city or any specific
plan applicable to the area of the proposed use.
The proposed use will not have an adverse affect on the General Plan of the City.
The zoning is consistent with the General Plan designation for the area and the use
is permitted with an approved conditional use permit.
2. Conditional Use Permit No. 00-08 is hereby approved as conditioned in Attachment A,
attached hereto and incorporated herein.
