L_T`r' I Q?~T .NQ - 0 0 -17 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA ANA APPROVING A VARIANCE FOR RELIEF FROM THE REQUIRED PARKING STANDARDS AND RELIEF FROM THE REQUIRED LANDSCAPING STANDARDS FOR A CHURCH LOCATED AT 1100 SOUTH CENTER WHEREAS, the applicant is seeking a variance from Santa Ana Municipal Code Sections 41-1411 and 41-627, to allow a reduction in parking and. landscaping standards for a church located at 1100 South Center. NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing this Commission finds and determines as _follows: A. That because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the zoning - ordinance is found to deprive the subject property of privileges not otherwise. at variance with the intent and purpose of the provisions of this chapter; The Immaculate Heart of Jesus Catholic Church site is a contained site surrounded by single-family neighborhoods. It was originally developed with the intention of adding the permanent church on a vacant pad on the corner of McFadden -and Center. The location and current development on the site makes it infeasible to add more land to the project. The configuration of the existing development provides the opportunity for a trade in landscape areas in order to satisfy the intent of the code. B. That the granting of a variance is necessary for 'the preservation .and enjoyment of one or more substantial property rights;. The project fulfills the original master plan concept envisioned for the site at the time of original development. C. That the granting of a variance will not be materially detrimental to the public welfare or injurious to .surrounding .property; The existing church has demonstrated that the vehicle occupancy pattern for this neighborhood is higher than 1 Pa a 229 31 ^ A ^ ~_._.. ~- - - - __ _ v _~ _ __ _ _ _ _ - - _. _____ _t_ _ --_ - =- --- _--_ -- -- - ----- normal, pedestrian trips are higher and the location and orientation of the new church mitigates potential impacts on the area. D. That the granting of a variance will not adversely affect the General Plan of the City; The granting of a reduction in the parking and landscaping standards is consistent with the goals and objectives of the City's circulation element of the General Plan. 2. Variance No. 00-03 is hereby approved as conditioned in Attachment A, attached hereto and incorporated herein. RESOLUTION NO. 00-17 APRIL 24, 2000 PAGE 1 OF 2 Conditions of Approval Variance No. 00-03 is approved subject to compliance, to the reasonable satisfaction of the Planning Manager, with all applicable sections of the Santa Ana Municipal Code, the California Administrative Code, the Uniform Fire Code, the Uniform Building Code, and all other applicable regulations. The applicant must comply in full with each and every condition listed below prior to exercising the rights conferred by this Variance. A. Planning Division 1. The applicant must remain in compliance with all conditions listed below throughout the life of the conditional use permit. Failure to comply with each and every condition may result in the revocation of the conditional use permit. 2. Comply with the conditions and requirements of DP No. 99-059 and the staff report exhibits. 3. There shall be no more than 1,200 seats or occupancy of the church at any time. 4. The parish shall remove any graffiti occurring on the property within 48 hours and clean up litter on the premises within three hours of any assembly activity. 5. The use of the property is limited to a church and related parish buildings and activities. No thrift shops, food distribution programs, nor rehabilitation programming may occur out of the premises, nor may outside pushcart or other vendors vending from the premises. 6. After project occupancy, landscaping is to be maintained to include the minimum levels of plant materials installed at the time of occupancy. 7. Public payphones, if provided, may only be located within buildings or in the interior of the site. ATTACHMENT A RESOLUTION NO. 00-17 APRIL 24, 2000 PAGE 2 OF 2 8. The school field is to be used for overflow parking on Sunday and other special event occasions. 9. The Parish shall send out mailings and hand out announcements requesting parishioner cooperation in walking, carpooling, and/or attending earlier or later Masses, and refraining from parking in the residential neighborhoods. 10. The Parish Hall shall not be used for a separate assembly activity when the main sanctuary is in use. Parish facilities are not to be scheduled for one-half hour prior and after regularly scheduled masses so as not to conflict with the use of the sanctuary. 11. All new trees in the required front landscape setback abutting streets, along entry drive aisles and lining the play field shall be 24-inch box size or larger. 12. The following parking lot landscaping shall be maintained as tradeoffs for a reduction in the number of parking lot planters: a. Tree wells shall be placed in the parking lot areas so as to not conflict with playground activities. b. The play field shall be lined with a hedgerow of trees abutting the parking lot. c. The entry driveway from McFadden Avenue shall include enhanced landscaping with 24-inch box trees. B. Police Department 1. The existing buildings and parking lot lighting must conform to the provisions of Chapter Eight, Article II, Division Three of the Santa Ana Municipal Code (Building Security Ordinance). These code conditions will require that the existing project's lighting, door/window locking devices, and addressing be upgraded to current code standards. Lighting standards cannot be located in required landscape planters.
