HomeMy WebLinkAbout1999-34RESOLUTION NO. 99-34 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA ANA APPROVING CON- DITIONAL USE PERMIT NO. 99-12 TO ALLOW DRIVE THRU LANE AND A CAR WASH LOCATED AT 700 EAST DYER ROAD GAS:6/9/99 WHEREAS, this Commission held a public hearing on June 14, 1999, on Conditional Use Permit Application No. 99-12, to allow a drive through lane and car wash located at 700 East Dyer Road. NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing, this Commission finds and determines as follows: A. Will the proposed drive through lane and car wash provide a service or facility which will contribute to the general well being of the neighborhood or community? The proposed drive-through facilities will provide additional convenience for the fast food restaurant customers thereby contributing to the long term success of the facilities and additional service to the community. The proposed car wash on this site is consistent with and supports the industrial, hotel, and commuter character of the uses along Dyer Road and SR- 55. B. Will the proposed use under the circumstances of the particular case be detrimental to the health, safety or general welfare of persons residing or working in the vicinity? The circulation design and layout which include landscaping to screen the drive-through lane and car wash approach lane will not create impact or be detrimental to the overall site or neighborhood. C. Will the proposed use adversely affect the present economic stability or future economic development of property in the surrounding area? The drive through and car wash uses and their design provides a visual upgrade and new economic activity to this area of East Dyer Road. The economic viability of the fast food restaurant and the overall development is increased with the addition of the proposed drive- through facilities. The overall economic stability of the area will be strengthened with commercial services in the area. D. will the proposed drive through lane and the car wash comply with the regulations and conditions specified in this chapter for such a use? As conditioned, both the proposed drive-through lane and the car wash facility meet the letter and intent of the zoning code and design standards for such facilities. E. Will the proposed use adversely affect the General Plan of the City or any specific plan applicable to the area of the proposed use? The drive-through lane at a fast food restaurant and car wash facility at this location is consistent with the General Plan. The proposed activities on the site and zoning are consistent with the General Plan of Santa Ana. 2. Conditional Use Permit No. 99-12 is hereby approved as conditioned in Attachment A, attached hereto and incorporated herein. The applicant must comply in full with each and every condition listed below prior to exercising the rights conferred by this conditional use permit. A. Planning Division 1. The applicant must remain in compliance with all conditions listed below throughout the life of the conditional use permit. Failure to comply with each and every condition may result in the revocation of the conditional use permit. 2. The project shall be built in compliance with Site Plan Review (DP 98-070) and the staff report exhibits. 3. The project is subject to the development standards and fees in effect at the time of permit issuance. 4. Building permits for each of the proposed uses shall be issued within two years of the date of the conditional use permit approving the uses. ~ . All outdoor play land or equipment and its enclosure are to be reviewed .and approved by the Planning Commission prior to permit issuance and/or installation. 7. The drives through lane and car wash access lane are to be screened from view by a solid hedge along the lane perimeter. ATTACHMENT A RESOLUTION NO.99-34 JUNE 14, 1999 PAGE 2 OF 3 8. The building architecture for any of the uses in this development is to maintain the architectural vocabulary established in the exhibits. 9. There is to be no exposed downspouts, overflow drains, electrical or mechanical lines on the exterior of any of the buildings in this development except in existing buildings. 10. The drive through lane is to be clearly identified by directional signage. 11. Exterior trash receptacles are to be provided and maintained around all food uses on-site and within adjacent parking areas. 12. Public payphones may only be located within buildings within clear view of the counter. No exterior payphones are permitted. 14. The buildings and site shall remain free of promotional banners and flags. Permanent signage must be maintained in compliance with the Santa Ana Municipal Code. 15. After project occupancy, landscaping is to be maintained to include the minimum levels of plant materials installed at the time of occupancy. 16. No vending or reverse vending machines may be located on the exterior of any structure on the property unless required by State mandate upon which such machines are to be located below the building canopy and screened. 17. The private street shall be installed in accordance with approved street plans. 18. Security/limited access gates at driveways or interior property line fencing to divide the site are prohibited. Each trash enclosure shall have a minimum six inch concrete slab in front of the enclosure that is at least the same dimensions as the trash enclosure. ~ (Modified by the Planning Commission June 14, 1999) . .................. ...................
