HomeMy WebLinkAbout1999-33RESOLUTION NO. 99-33 GAS: 6/9/99 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA ANA APPROVING TENTATIVE PARCEL MAP NO. 97- 156, TO SUBDIVIDE A 4.8 ACRE LOT INTO FOUR PARCELS LOCATED AT 700 EAST DYER ROAD (TPM NO. 97-156) WHEREAS, Tentative Parcel Map No. 97-156 has been filed to subdivide an existing 4.8 acre parcel into 4 lots, located at 700 East Dyer Road (the "Project"); and WHEREAS, the design and improvement proposed for Tentative Parcel Map No. 97-156 is consistent with the objectives, policies, general land uses, and programs specified in the City of Santa Ana General Plan; and WHEREAS, the Environmental Evaluator of the City Of Santa Ana has prepared a Mitigated Negative Declaration and Monitoring Program for Environmental Review No. 97-173, pursuant to the California Environmental Quality Act, for the Project; and WHEREAS, the Planning Commission held a duly noticed public hearing, on June 14, 1999, on Tentative Parcel Map No. 97-156 for the Project. NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing, the Planning Commission finds and determines as follows: A. The proposed project, as conditioned, and it's design and improvements are consistent with the General Commercial land use designation of the General Plan and are otherwise consistent with all other elements of the General Plan and any applicable specific plans. The proposed subdivision is consistent with the Industrial designation and will have no adverse affect on the surrounding manufacturing, business and hotel development. B. The proposed project, as conditioned, conforms to all applicable requirements of the zoning and subdivision codes, as well as other applicable City ordinances. The proposed subdivision conforms to the minimum lot size and street frontage requirements, as well as meeting the intent of the State of California Subdivision Map Act provisions. C. The project site is physically suitable for the type and density of the proposed project. Each proposed parcel site exceeds the minimum required lot size for industrial and commercial development. There are no 1 physical constraints on the site to preclude development. D. The design and improvements of the proposed project will not cause substantial environmental damage or substantially and avoidably injure fish and wildlife or their habitat. No fish or wildlife will be affected by the approval of the map or by the design and improvements of the project. Environmental Review No. 97-173 has been prepared for the project and has identified mitigation measures aimed at substantially reducing any environmental impacts associated with the project to insignificant levels. Pursuant to Title XIV, California Code of Regulations ~ 735.5(c}(1), after considering the record as a whole, there is no evidence that the proposed project will have the potential for any adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, pursuant to Fish and Game Code ~ 711.2 and Title XIV, CCR § 735.5(a)(3), the payment of Fish and Game Department filing fees is not required in conjunction with this project. E. The design or improvements of the proposed project will not cause serious public health problems. The projects proposed for this subdivision of land meet or exceed City development standards. As conditioned, future development is required to be in compliance with the applicable industrial or commercial zoning district requirements. F. The design or improvements of the proposed project will not conflict with easements necessary for public access through or use of the property within the proposed project. The applicant will be dedicating 10 feet of property in the form of a street easement for public right-of-way purposes to mitigate impacts of the project. Further, a private street is proposed to be recorded to provide street frontage and access to parcel 1 and the rear of the adjacent property. 2. The mitigated negative declaration for Project No. ER 97-173 is hereby approved. 3. The Mitigation Monitoring Program attached hereto as Attachment A and incorporated herein by reference is hereby approved and adopted for Project No. ER 97-173. 4. Prior to approval and recording of the final Parcel Map, have reviewed, approved and installed the private street along the west property line. 7. No barbed wire may be visible from any public or private street or State Highway. 8. CC&R's for reciprocal parking, access, drainage, and maintenance between the parcels shall be recorded with the map. B. Police 1. The existing buildings and parking lots must conform with the provisions of Chapter 8, Article II, Division 3 of the Santa Ana Municipal Code (Building Security Ordinance). These code conditions will require that the existing project's lighting, door/window locking devices and addressing be upgraded to current code standards. Lighting standards cannot be located in required landscape planter. C. Public Works 1. File, process and record CC&Rs over parcels 1, 2, 3, & 4. The CC&Rs will address issues including ingress/egress, cross-lot drainage, utilities, parking, emergency vehicle access, common area maintenance and irrigation, etc. Additionally the CC&Rs will address use and maintenance responsibility for the existing 8" sewer main in the private street. 2. File, process, and record a private street easement in the alignment that has been approved by the City. The easement must allow all uses and purposes as necessary for the proposed developments (drainage, utilities, access, monitoring wells, etc.) 3. File, process, and record an easement for public sewer and water purposes and traffic signal purposes in the location of the private street. 4. File, process, and record quitclaims of existing easements which are no longer necessary or which will become obsolete when new easements are placed in the private street RFSOLU7~'ION N0.99-33 JUNE 14, 999 PAGE 3 4 5. File, process, and record an irrevocable offer of dedication to widen Dyer Road to a width of 60 feet from centerline with a 25' X 25' corner cut-off at the private street intersection. (Can be on the final map.) 6; File, process, and record a pop-out dedication to accommodate the relocation of the existing bus shelter on Dyer Road. (Can be on the final map.) 7~ Submit and have approved a hydrology/run-off study. Submit and have approved a plan showing how and where the site run- off will be directed. 8.1 Provide evidence that parcels one through four have the legal right to drain the run-off across the ITT site to the OCFCD channel. If there is no existing documentation then file, process, and record appropriate documents. 9. Construct all improvements identified as follows: (All improvements subject to approved plans and studies.) a) Remove/demolish all existing improvements and construct the new private street in its entirety including all utilities, storm drains, curb, gutter, sidewalk, driveways, landscaping, paving, lighting, etc. b) Demolish the three buildings identified on the plan. c) Construct all drainage improvements including storm drain, catch basins and connection to the channel per an approved hydrology report. d) Reconstruct and modify the signal at the intersection of Dyer Road and private street (as needed to accommodate the roadway construction.) RESOLU71'ION NO. 99-33 JUNE 14, 999 PAGE 4 4 e) Adjust to grade and/or relocate as required; water meters, vaults, utility manholes and facilities, fire hydrants, pull boxes, and sewer manholes. f) Stripe private street per approved channelization plans. g) Complete installations and/or relocations of all utility facilities needed to provide direct services to provide directly services to the existing buildings on parcel 1.
