HomeMy WebLinkAbout1999-31RESOLUTION NO. 99-31 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA ANA APPROVING CON- DITIONAL USE PERMIT NO. 99-11 TO PERMIT TWO GROUP HOMES FOR THE DEVELOPMENTALLY DISABLED LOCATED AT 217-219 SOUTH BIRCH STREET GAS:6/9/99 WHEREAS, this Commission held a public hearing on June 14, 1999, on Conditional. Use Permit Application No. 99-11, to allow.. two group homes for the developmentally disabled located at 217- 219 South Birch Street. NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing, this Commission finds and determines as follows: A. Will the proposed use provide a service or facility which will contribute to the general well being of the neighborhood or the community? The proposed group homes for the developmentally disabled will provide a service to the neighborhood by allowing the construction of homes that will provide the disabled residing in the area an opportunity to establish independent living. B. Will the proposed use under the circumstances of the particular case be detrimental to the health, safety, or general welfare of persons residing or working in the vicinity? The proposed use will not be detrimental to the health or safety of persons living or working in the area as the group homes have been determined to be compatible with the surrounding mixture of low and medium density residential development. Additionally, residents in these homes will be required to have individual support plans that clearly delineate any support needed in order for the persons to safely reside in the homes with assurances that the support will be available and adequately funded. C. Will the proposed use adversely affect the present economic stability or future economic development of properties surrounding the area? The proposed use is compatible with the surrounding uses and will not adversely affect the economic viability in the area. The economic viability of the area will increase due to the construction of residences on lots that are currently vacant. D. Will the proposed use comply with the regulations and conditions specified in Chapter 41 for such use? The group homes will be in compliance with the regulations and conditions identified in Chapter 41 as well as Specific Plan No. 40 (Heninger Park Historic District) development standards. E. Will the proposed use adversely affect the General Plan or any specific plan of the City? The proposed group homes will not adversely affect the General Plan as the single-family residential product proposed is consistent with the goals and objectives of the Low Density Residential (LR7) General Plan designa- tion. 2. Conditional Use Permit No. 99-11 is hereby approved as conditioned in Attachment A, attached hereto and incorporated herein. ADOPTED this 14 day of following vote: June 1999, by the AYES : Commissioners Verino, Mordo, Nalle, Solorio, Cribb, and Richardson NOES: Commissioners Nore ABSENT: Commissioners None ABSTENTIONS: Commissioners noughts ATTEST: ~~ Kenneth Adams Planning Manager Planning and Building Agency Ly nette Verino Chairperson APPROVED AS TO FORM: Gary' A~, S ista3~t( City attorney RESOLUTION NO. 99-31 JUNE 14, 1999 PAGE 1 OF 2 Conditions for Approval Conditional Use Permit No. 99-11 is approved subject to compliance, to the reasonable satisfaction of the Planning Manager, with all applicable sections of the Santa Ana Municipal Code, the California Administrative Code, the Uniform Fire Code, the Uniform Building Code and all other applicable regulations. The applicant must comply in full with each and every condition listed below prior to exercising the rights conferred by this conditional use permit. The applicant must remain in compliance with all conditions listed below throughout the life of the conditional use permit. Failure to comply with each and every condition may result in the revocation of the conditional use permit. A. Planning Division 1. All proposed site improvements, including all landscaping as shown on the site plan, must conform to the Site Plan review approval of DP No. 99-6. 2. The conditional use permit becomes null and void if the City Council does not approve Zoning Ordinance Amendment No. 99-05. 3. This conditional use permit will not become effective until 30 days after the second reading of the ordinance approving Zoning Ordinance Amendment No. 99-05. 4. Each residence must contain an individual front sitting porch. 5. The joint wheelchair ramp is not an acceptable alternative, with each residence required to have a wheelchair ramp. 6. All siding for the project, including clapboards and shingles, must be wood. 7. All windows on the residences must be wood and wood-sashed with wood trim. B. Police Department 1. Occupancy of the structures is restricted to developmentally disabled adults only. ATTACHMENT A RESOLUTION NO. 99-31 JUNE 14, 1999 PAGE 2 OF 2 2. Provide light fixtures along the rear walkway and provide light at a minimum level of one footcandle. C. Public Works Agency 1. Revise the site plan to depict the correct dimensions from the Birch Street centerline to the curb line and from the curb line to the property line. 2. Provide the correct dimensions from the Pine Street centerline to the curb line and from the curb line to the property line. 3. Revise the site plan to label the current 7-foot by 7-foot corner cut-off dedication at the existing right-of-way lines at the northeast corner of Pine and Birch Streets. 4. Depict a 10-foot by 10-foot property line corner cut-off for alley dedication purposes at the northwest corner of the alley and Pine Street. 5. Provide the correct alley dimension from the centerline of the alley to the new property line. 6. Depict the widening of the westerly portion of the alley apron to match the alley widening and relocate the existing power pole impacted by the widening. 7. Depict the relocation of the existing power pole in the alley to be located at the alley right-of-way line near the corner cut-off area. 8. Depict the easement on the northeast portion of the property for ingress and egress purposes as noted on the current title report.
