HomeMy WebLinkAbout1998-48• RESOLUTION NO. 98-48 GAS: B/14/98 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA ANA APPROVING VARIANCE NO. 98-07, TO ALLOW RELIEF FROM CERTAIN PROVISIONS OF THE SIGN CODE RELATED TO THREE FREESTANDING SIGNS FOR THE SUPERIOR SUPER WAREHOUSE LOCATED AT 1700-1720 SOUTH MAIN STREET WHEREAS, Santa Ana Municipal Code Section 41-638 provides for the granting of a variance from the provisions of the Santa Ana Municipal Code; and WHEREAS, this Commission held a public hearing on August 24, 1998, on Variance Application No. 98-07, to allow: 1. Section 41-862 (b)(2) requires any freestanding sign to be located in a landscaped planter not less than four feet in any direction: this sign is located in the concrete sidewalk in the front of the store. • 2. Section 41-862 (c) (2) states that no freestanding sign shall be higher than seven feet as measured from the curb, the overall height plus the overall width shall not exceed 16 linear feet and the sign face shall not exceed 45 square feet: the proposed sign structure is 38 feet high, has a linear dimension of 96 feet and the combined sign face area is approximately 427 square feet. 3. Section 41-862 (d) (2) states the copy area shall not exceed 40 percent of the signable area: there is no solid copy area as this sign is suspended on a steel frame . 4. Section 41-862 (d) (3) states that the sign shall be for the name of the center or business and contain no more than eight items of information: the proposed sign has 9 items of information. Three words for the name of the business, three words describing products (meats, produce and bakery) and three pictorial symbols, or icons, representing these three products. NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISION OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing this Commission finds and determines as follows: 1 A. That because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges not otherwise at variance with the intent and purpose of the provisions of this chapter. Due to the shape of the parcel, mixture of uses in the area and the buildings location on the rear portion of the property the variances for the proposed signage are the .only means available for effective advertising for this location. Without the variances, signage for virtually any business on the site would be ineffective, depriving the property owner of the use of the property for retail sales. B. The granting of a variance is necessary for the preservation and enjoyment of one or more substantial property rights. The variances are necessary to increase the visibility and advertising for this business as designed. Without effective advertising, the property owner is limited in the uses available for this site. C. The granting of a variance will not be materially detrimental to the public welfare or injurious to surrounding property. Approving the variances, as conditioned, will ensure success of the proposed retail center by providing the required advertising necessary. The retail center will provide a benefit to the community by eliminating a current vacant and abandoned building, and act as a catalyst for additional development to occur in this area. D. The granting of a variance will not adversely affect the general plan of the city. The variance, as conditioned, will have no adverse affect on the general plan. 2. The applicant must comply in full with each and every condition listed below prior to exercising the rights conferred by this conditional use permit. The applicant must remain in compliance with all conditions listed below throughout the life of the conditional use permit. Failure to comply with each and every condition may result in the revocation of the conditional use permit. A. Planning Division 1.
