A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF SANTA ANA APPROVING A
VARIANCE TO ALLOW A 4,200 SQUARE FOOT
OUTDOOR STORAGE AND CUSTOMER PICK UP
AREA AND A REDUCTION IN PARKING FOR THE
ORCHARD SUPPLY HARDWARE STORE LOCATED
AT 1975 EAST SEVENTEENTH STREET
WHEREAS, the applicant is seeking a variance from Santa Ana
Municipal Code Section 41-425(a), to allow a 4,200 square foot
outdoor storage and customer pick up area, and a variance from
Santa Ana Municipal Code Section 41-1340, for a 3 percent
reduction in parking to accommodate said area.
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF
THE CITY OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid
hearing this Commission finds and determines as follows:
A. That because of special circumstances applicable to the
subject property, including size, shape, topography, location or
surroundings, the strict application of the zoning ordinance is
found to deprive the subject property of privileges not otherwise
at variance with the intent and purpose of the provisions of this
chapter.
Due to the location of the business on the rectangular shaped
parcel and the nature of the hardware business, an outdoor
storage and loading area is critical to the success of the
project and can only be achieved by a minor reduction from
the Code with regards to parking requirements and is not
otherwise at variance with the intent and purpose of this
chapter.
B. That the granting of a variance is necessary for the
preservation and enjoyment of one or more substantial property
rights.
Granting of the requested variance would allow Orchard Supply
Hardware to compete with other hardware businesses, providing
OSH with the enjoyment of substantial property rights as well
as the flexibility to meet the intent of the code in a manner
that produces no adverse impact to adjacent land uses or
properties.
C. That granting of a variance will not be materially
detrimental to the public welfare or injurious to surrounding
property.
Granting the requested variance will not be materially
detrimental to the public welfare or injurious to surrounding
property. The outdoor storage is partially screened and
provides visibility for security purposes. Further, the
reduction in parking is supported by analysis which indicates
no impacts to other uses on the site or surrounding
properties.
D. That the granting of a variance will not adversely affect the
General Plan of the City.
Granting the requested variance will not adversely affect the
General Plan of the City. Due to the design of the project and
the analysis of the parking impacts, no adverse impacts are
anticipated from the outdoor storage. The project as proposed, is
consistent with land use, urban design and economic development
policies of the general plan and will be an overall asset to the
community.
2. Variance No. 98-02 is hereby approved as conditioned in
Attachment A, attached hereto and incorporated herein.
