RESOLUTION NO. 97-20
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF SANTA ANA APPROVING
VARIANCE NO. 97-14 TO ALLOW A VARIANCE
FROM THE SIGN CODE FOR THE PACIFICARE
OFFICE BUILDINGS LOCATED AT 3100, 3110
AND 3120 WEST LAKE CENTER DRIVE
WHEREAS, this Commission held a public hearing on October 27,
1997, on Variance Application No. 97-14, to allow variances from
zoning code standards for major identification wall signs at 3100,
3110 and 3120 West Lake Center Drive;
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF
THE CITY OF SANTA ANA AS FOLLOWS:
1. Variance No. 97-14 is hereby granted for the signs at
3100, 3110 and 3120 West Lake Center Drive with respect to the
following items.
a. Relief from Santa Ana Municipal Code Section 41-
867(e)(1) regarding letter height.
2. With respect to the variance items approved in section 1
of this Resolution, and based upon the evidence submitted at the
abovesaid hearing, this Commission finds and determines as follows:
A. That because of special circumstances applicable to the
subject property, including size, shape, topography, location or
surroundings, the strict application of the zoning ordinance is
found to deprive the subject property of privileges not otherwise
at variance with the intent and purpose of the provisions of this
chapter.
The use of 42 inch upper case letters within the text of the
sign allows motorists to identify the signs more rapidly and
safely.
B. That the granting of a variance is necessary for the
preservation and enjoyment of one or more substantial property
rights.
The strict application of the Sign Code in regards to major
building signage would require signage not in keeping with the
established trade identification for PacifiCare and SecureHorizon.
Approval of a variation from the Municipal Code would allow for
identification of the businesses in an aesthetically appealing
manner.

C. That granting of a variance will not be materially detrimental
to the public welfare or injurious to surrounding property.
Granting a variance will not be detrimental to the public or
surrounding properties. The approval will allow the proposed
signage to be legible and therefore maintaining a safe condition
for the motoring public.
D. That the granting of a variance will not adversely affect the
general plan of the city.
The granting of the variance will not adversely affect the
City's General Plan designation for the area of Industrial (IND).
The signage proposed will not affect .the Industrial Land Use
designation.
3. Variance No. 97-14 is hereby approved, subject to the
conditions set forth in Attachment A, attached hereto and
incorporated herein.
ADOPTED this 27 day of October , 1997, by the
following vote:
AYES: Commissioners Oli~zer, Doughty, Hanna, MacDowell, and
Solorio
NOES: Commissioners None
ABSENT: Commissioners. Nalle and Verinc~

Conditions of Approval
Should Variance No. 97-14 be approved, the project shall comply with all
applicable sections of the Santa Ana Municipal Code, the California
Administrative Code, the Uniform Building Code, and all other applicable
regulations:
A. General Conditions
1. The applicant must comply in full with each and every condition
listed below ,prior to exercising the rights conferred by this
variance.
2. The applicant must remain in compliance with all conditions listed
below throughout the life of the conditional use permit. Failure
to comply with each and every condition may result in the
revocation of the conditional use permit.
B. Planning Division
Prior to issuance of Building permits, complete the following:
• 1. Submit and have approved a sign program for 3100, 3110 and 3120
West Lake Center Drive.
2. All signage on the site must remain in compliance with the City's
sign code.
