A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF SANTA ANA APPROVLNG
VARIANCE NO. 97-12 TO GRANT RELIEF FROM
PARKING AND FREESTANDING SIGN
REQUIREMENTS FOR THE VALLEY SHOPPING
CENTER LOCATED AT 5015-5127 WEST EDINGER
AVENUE
WHEREAS, this Commission held a public hearing on October 13,
1997, on Variance Application No. 97-12, to allow a variance from
the parking and freestanding sign requirements imposed by the Santa
Ana Municipal Code for an existing shopping center located at 5015-
5127 West Edinger Avenue;
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF
THE CITY OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid
hearing, this Commission finds and determines as follows:
A. That because of special circumstances applicable to the
subject property, including size, shape, topography, location or
• surroundings, the strict application of the zoning ordinance is
found to deprive the subject property of privileges not otherwise
at variance with the intent and purpose of the provisions of this
chapter.
As shown in the attached plans, the existing shopping center
is a built-out facility that cannot be designed to accommodate
additional parking. To preserve the viability of the center and
allow the re-use of the structures, it is appropriate to grant the
parking variance for retail uses. The granting of the variance
will provide the applicant the opportunity to utilize the center in
a manner consistent with other nonconforming facilities. The
approval of the sign variance will permit the installation of signs
consistent with similar shopping centers granted variances for free
standing signs.
B. That the granting of a variance is necessary for the
preservation and enjoyment of one or more substantial property
rights;
The granting of the variance will preserve the applicant's
ability to lease the shopping center for uses in keeping with the
General Commercial (C1) district regulations and thereby allow the
applicant to maintain the economic viability of the center.
C. That granting of a variance will not be materially
detrimental to the public welfare or injurious to surrounding

property;
By limiting the uses of the remaining spaces in the center to
retail operations, the variance will reduce potential impacts from
spill over parking. In addition, as demonstrated in the parking
demand analysis, the parking need for the center is less than the
code requirement.
D. That the granting of a variance will not adversely affect
the general plan of the city.
The General Plan land use designation for this site is
Commercial, the variance to allow the continued operation of the
commercial center is consistent with the General Plan.
2. Variance No. 97-12 is hereby approved for a parking
variance and a freestanding sign variance at the Valley Shopping
Center located at 5015-5127 West Edinger Avenue, subject to the
conditions set forth in Attachment A, attached hereto and
incorporated herein.
