RESOLUTION NO. 97-11
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF SANTA ANA APPROVING
VARIANCE NO. 97-11 TO ALLOW VARIATIONS
FROM THE SIGN CODE FOR THE PLANET
HOLLYWOOD RESTAURANT LOCATED AT 1641
WEST SUNFLOWER AVENUE
WHEREAS, this Commission held a public hearing on August 25,
1997, on Variance Application No. 97-i1, to allow variances from
zoning code standards for signs at 1641 West Sunflower Avenue;
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF
THE CITY OF SANTA ANA AS FOLLOWS:
1. Variance No. 97-11 is hereby granted for the signs at 1641
West Sunflower Avenue with respect to the following items.
a. Relief from Santa Ana Municipal Code Section 41-
860(a)(3) to allow a sign that incorporates
mechanical movement; and
b. Relief from Santa Ana Municipal Code Section 41-
862(c)(2) to allow a freestanding sign that exceeds
• the 15 foot height limit; and
c. Relief from Santa Ana Municipal Code Section 41-
863(d)(1) to allow a wall sign.
2. With respect to the variance items approved in section 1
of this Resolution, and based upon the evidence submitted at the
abovesaid hearing, this Commission finds and determines as follows:
A. That because of special circumstances applicable to the
subject property, including size, shape, topography, location or
surroundings, the strict application of the zoning ordinance is
found to deprive the subject property of privileges not otherwise
at variance with the intent and purpose of the provisions of this
chapter.
The Planet Hollywood Restaurant is located in a retail and
entertainment corridor that allows a unique opportunity to provide
a major landmark in the City. This project is a regional
attraction that contrasts with the surrounding developments and
strengthens the landmark status of the project. Additionally, the
project is located at the City's southern entrance and serves as a
major visual gateway into the City.
B. That the granting of a variance is necessary for the
. preservation and enjoyment of one or more substantial property

rights;
The cinema themed restaurant provides an architectural design
concept that contrasts with the surrounding structures, yet
provides an economic benefit to the property owner, surrounding
businesses, and the City.
C. That granting of a variance will not be materially detrimental
to the public welfare or injurious to surrounding property;
The proposed signage will be designed to not negatively impact
surrounding properties. Since the majority of the uses in the area
are commercial, these uses will be compatible with the proposed
signage since the intent of the Planet Hollywood signage is to
attract customers to the area. Additionally, the lighting levels
of the signage will be at a low level in order to minimize impacts
to pedestrians and vehicles travelling along the corridors.
Finally, the signage is located within a commercial area and is not
directed towards nearby residential uses, thereby not impacting
these uses at night when the signage will be most visible.
D. That the granting of a variance will not adversely affect the
general plan of the city.
The granting of the variance will not adversely affect the
• City's General Plan in any way as the land use designation of
General Business District encourages the operation of restaurant
facilities which increase employment and tax revenue.
Additionally, the General Plan encourages the improvement of
facilities in existing centers as well as the creation of a
positive visual appearance in the City.
3. Variance No. 97-11 is hereby approved, subject to the
conditions set forth in Attachment A, attached hereto and
incorporated herein.
4. Site plan review of the proposed project to amend the
project within a Specific Development site is hereby approved.

Variance No. 97-11 is approved subject to compliance, to the reasonable
satisfaction of the Planning Manager, with applicable sections of the Santa
Ana Municipal Code, the California Administrative Code, the Uniform Fire
Code, the Uniform Building Code, and all other applicable regulations. In
addition, it shall meet the following conditions of approval:
A. Planning Division
1. The applicant must comply with each and every condition listed
below Urior to exercising the rights conferred by this variance.
2. The applicant must remain in compliance with all conditions
listed below throughout the life of the variance. Failure to
comply with each and every conditions may result in the
revocation of the variance.
3. Compliance with the DP 97-48 Site Plan Review comments with the
exception of the items covered by the variance.
4. As such time when the Planet Hollywood Restaurant ceases to
operate, the light beacons on top of the facade as well as the
Planet Hollywood pole sign must be removed prior to any building
or occupancy permits being issued to another tenant.
5. All exterior signage, including wall and freestanding signs,
must include the words "Santa Ana" underneath or adjacent to all
copy displaying "Planet Hollywood" and must be agreed upon by
staff and the applicant.
