PLANNING COMMISSION
NOVEMBER 25, 1996
The Regular Meeting of the Santa Ana Planning Commission was called to order by
Madam Chair Brown at 6:05 p.m. in the City Council chambers, located at 22 Civic
Center Plaza, Room 147, Santa Ana, California. Other Commissioners present
included: Nalle, Doughty, Mondo, Segura, and Oliver arrived at 6:42 p.m. Also in
attendance were: Robyn Uptegraff, Executive Director; Kenneth Adams, Planning
Manager; Gary Sheatz, Deputy City Attorney; Jeffry Rice, Senior Planner; Charles
View, Senior Planner; Tom Childress, Associate Planner; Larry Yenglin, Associate
Planner; Pamela Lucado, Public Works Agency; Mike McCoy and Yolanda Pena, Police
Department; and Sharon McCain-Johnson, Recording Secretary.
A. Approval of the Minutaa from the Regular Meeting of November 11, 1996.
Approve the Minutes of the Regular Meeting of November 11, 1996.
B. Reconaideratioa of actions taken at the previous meeting.

C. CONDITIONAL USE PERMIT NO. 96-37 (Tom Childress)
Filed by SSY Enterprises to allow a Type 47 Alcoholic Beverage Control
License in order to sale beer, wine, and distilled spirits at the CARAMBA
night club located at 226 South Harbor Boulevard.
RECOMlHSliDATION:
Confirm the Zoning Administrator's decision approving Conditional Use Permit
No. 96-37 as conditioned and adopt the findings as submitted by staff.
D. CONDITIONAL USE PERMIT NO. 96-38 (Larry Yenglin)
Filed by Me. Rachel Hashimoto to allow a Type 41 Alcoholic Beverage Control
License in order to allow the sale of beer and wine for on-premise
consumption at Koji's restaurant located at 323 North Sycamore Street.

Confirm the Zoning Administrator's decision approving Conditional Use Permit
No. 96-38 as conditioned and adopt the findings as submitted by staff.

Donuts located at 320 East Seventeenth Street.

Direct staff to begin revocation proceedings for Conditional Use Permit No.
96-10.
Mr. Larry Yenglin presented the staff report.
Mr. Hike McCoy indicated that the restaurant was cited three times and given
a deadline of September 11, 1996 to comply with the conditions of approval.
Representatives of Yum Yum Donuts stated that the conditions of approval had
been complied with but the site had not been recently inspected by staff.
Conditional Use Permit No. 96-10 was continued for 30 days.

Ms. Uptegraff informed the Commission that there would be several upcoming
fast track items: the Wal*mart sign variance, the Discovery Science Center,
and Home Place shopping center.

Mr. Adams informed the Commission that the upcoming Planning Commission would
be lengthy due to the second meeting in December being canceled.

The Planning Commission thanked staff for the recent study session conducted
and expressed that the session was well organized and the Elements were well
presented.

Madam Chair Brown indicated that Variance No. 96-04, Conditional Use Permit No. 96-
40, and Environmental impact Report No. 93-3 would be the first public hearing.
1. VARIANCE NO. 96-04, CONDITIONAL USE PERMIT NO. 96-40 AND ENVIRONMENTAL IMPACT
REPORT N0.93-3 (Jeffry Rice)
Filed by ICI to permit a 12.5 percent parking reduction, two freestanding
signs in excess of code height and area limits at Centre on Seventeenth; and
to permit drive-through service at a restaurant located at 2110 Eaet
Seventeenth Street in the Community Commercial (C1) zoning district.

RECOMMENDATION:
1. Approve Variance No. 96-04 as conditioned and adopt the findings as
submitted by staff.
2. Approve Conditional Use Permit No. 96-40 as conditioned and adopt the

3. Directed the City Attorney to prepare a letter of Public Convenience
and Necessity for Lucky store.
4. Approve addendum to Environmental Impact Report No. 93-3 confirming the
certification of the EIR as adequate for the project, pursuant to
Section 15164 of the California Environmental Quality Act.
Mr. Jeffry Rice, Senior Planner, presented the staff report.
Commissioner Mondo asked why staff was allowing the public phones to be
located exterior to the buildings.
Mr. Rice responded that the phones would be located in the plaza area
adjacent to Burger King and staff believed the phones were within
surveillance view.
Commissioner Oliver asked how much parking would be available to each parcel.
Mr. Rice indicated parking had not been allocated to each individual parcel.
The Bite was being held as an integrated development through CC&R's with
reciprocal parking access, drainage, etc.
Mr. Scott Bell, applicant, indicated that he agreed with the staff report and
staff's recommendation.
Commissioner Mondo asked if any of the adjacent residents expressed any
concerns regarding the trash pick up area or limiting the hours for trash
pick ups.
Mr. Rice indicated that no residents had expressed concerns regarding the
trash pick up area.
' In addition to condition number 3, Commissioner Mondo noted that he would
like to add the came restrictions of trash truck pick ups to the same
activity hours of delivery trucks.

so.
