The Regular Meeting of the Santa Ana Planning Commission was called to order by
Madam Chair Brown at 6:30 p.m. in the City Council Chambers, located at 22 Civic
Center Plaza, Room 147, Santa Ana, California. Other Commissioners present
included: Nalle, Mondo, and Segura. Also in attendance were: Robyn Uptegraff,
Executive Director; Kenneth Adams, Planning Manager; Gary She atz, Deputy City
Attorney; Charles View, Senior Planner; Jeffry Rice, Senior Planner; Jamie Watanabe,
Assistant Planner II; Kurth Nelson, Intern; Pamela Lucado and Vinh Nguyen, Public
Works Agency; Mike McCoy and Yolanda Pena, Police Department; Susan Helper,
Community Development; and Sharon McCain-Johnson, Recording Secretary.

Approval of the Minutes from the Regular Meeting of September 23, 1996.
RECOMMENDATION:
Approve the Minutes of the Regular Meeting of September 23, 1996.
Reconsideration of actions taken at the previous meeting.
None.
CONDITIONAL USE PERMIT NO. 96-22
(Jamie Watanabe)
Filed by LA Cellular to allow a new 61 foot high cellular receiving and
transmitting antenna facility located at 2731 North Grand Avenue in the
Arterial Commercial (CS) zoning district.
Continue Conditional Use Permit No. 96-22 indefinitely.
CONDITIONAL USE PERMIT NO. 96-30 {Marta Crane)
Filed by Mr. Brian Leighton to upgrade an alcoholic beverage control license
from Type 41 to Type 47 in order to sell beer, wine, and distilled spirits at
the Boardwalk Cafe located a 416 West Fourth Street in the Downtown
Commercial (C3) zoning district.
Confirm the action of the Zoning Administrator approving Conditional Use
Permit No. 96-30.
HISTORICAL PROJECT REVIEW NO. 96-08 (Kurth Nelson)
Filed by Denita Harmon to remodel the existing single family residential
units and existing detached garage located at 522 - 522 1/2 South Van Ness in
the Specific Development 40 zoning district.
RECOMMENDATION:
Approve Historical Project Review No. 96-08.
CONDITIONAL USE PERMIT NO. 96-14

Filed by M6. Deborah Burton to allow modification to the conditions of
approval allowing the sale of alcoholic beverages and amplified music past
12:00 a.m. located at 1615 East Seventeenth Street in the Arterial Commercial
(CS) zoning district.
RECOMMENDATION:
Confirm the action of the Zoning Administrator approving the request to
modify the conditions of approval for Conditional Uae Permit No. 96-14 as
conditioned and adopt the findings as submitted by staff.

Commissioner Mondo requested Conditional Use Permit No. 96-14 be removed from
the Consent Calendar and moved to approve the remaining Consent Calendar
items. The motion was seconded by Commissioner Nalle.

Commissioner Mondo asked for further clarification regarding Conditional Use
Permit No. 96-14.
Mr. Klegal requested that the conditional of approval requiring a security
guard be removed.

After further discussion, Commissioner Mondo moved to approve Conditional Use
Permit No. 96-14 with the deletion of the condition requiring a security
guard for the restaurant. The motion was seconded by Commissioner Nalle.

6. Discussion of the Midtown proiect. (Jeffry Rice/Susan Helper)
Mr. Jeffry Rice, Senior Planner and Ms. Susan Helper, Community Development
Agency provided a discussion of the Midtown Project.
H. Comments from the Executive Director. (Robyn Uptegraff)
Ms. Uptegraff informed the Commission that City Council would be having
discussions regarding the expansion of the music facility.
2. Comments from the Planning Manager. (Kenneth Adams)
Mr. Adams discussed changing the date of the Planning Commission study
session from November 9, 1996 to November 16, 1996 due to the holiday
weekend.
J. Comments from the Planning Commission.
Commissioner Mondo requested that a study session be held regarding sidewalk
businesses.
Commissioner Nalle congratulated Ms. Uptegraff's efforts on the first Annual
Planning Officials Forum.
Madam Chair Brown also expressed her appreciation to Ms. Uptegraff for her
efforts at the Planning Officials Forum. She also indicated that the doors
had been opened recently at the Roxbury South Nightclub and requested staff
to verify whether any operations were being conducted at the site.

order and conducted by Madam Chair Brown in the City Council Chambers, 22 Civic
Center Plaza, Santa Ana, California. Roll call was answered by Commissioners Nalle,

Senior Planner; Larry Yenglin, Associate Planner; Marvin Ellenbecker, Landscape

Department; Sharon McCain-Johnson, and Recording Secretary.
' PLEDGE OF ALLEGIANCE TO THE FLAG: The Pledge of Allegiance was led by Madam Chair
Brown.
PROCEDURAL RULES: The procedural rules for the session were read by Madam Chair
Brown.
PUBLIC HEARINGS 7:00 o.m.
1. ZONING ORDINANCE AMENDMENT NO. 96-09, GENERAL PLAN AMENDMENT NO. 96-07 AND
AMENDMENT APPLICATION NO. 96-09 (Jeffry Rice)
Filed by the City of Santa Ana to modify land use and floor area ratio
designations and to change the zoning district in order to implement the
Midtown Specific Plan citywide.
LEGAL NOTICED: September 27, 1996
PUBLIC NOTICED: October 4, 1996
1. Recommend that the City Council certify Environmental Impact Report 94-
1 and approve the Mitigation Monitoring Program.
2. Recommend that the City Council approve Zoning Ordinance Amendment No.
96-09.
3. Recommend that the City Council adopt a resolution approving General
Plan Amendment No. 96-07 to amend the Land Use Element of the General
Plan.
' 4. Recommend that the City Council adopt an ordinance approving Amendment
Application No. 96-09.
5. Recommend that the City Council adopt an in-lieu fee resolution.
Mr. Jeffry Rice provided an overview of the staff report.
Commissioner Mondo requested clarification regarding how staff arrived at the
dollar amount for the structure.
Mr. Roger Kooi, Downtown Development, responded and provided additional
information regarding the financial figures.
There were no public comments.
Commissioner Mondo moved to approve certification of the Environmental Impact
Report. The motion was seconded by Commissioner Segura.

ABSENT: Oliver, Doughty, and Pedroza
Commissioner Mondo commended staff for their efforts on the project and moved
to approve Zoning Ordinance Amendment No. 96-09. The motion was seconded by
Commissioner Sequra.
Madam Chair Brown also commented and expressed her appreciation for staff's
efforts.

motion was seconded by Commissioner Segura.

Commissioner Mondo moved to approve the in-lieu fee resolution. The motion
was seconded by Commissioner Segura.

Filed by Mr. Bob Schultz to allow a rock crushing and material storage
facility located at 4127 West MacArthur Boulevard in the Light Industrial
(M1) zoning district.

RECOMMENDATION:
Approve Conditional Use Permit No. 96-32 as conditioned and adopt the
findings as submitted by staff.
Mr. Larry Yenglin, Associate Planner, provided an overview of the staff
report.
Mr. Bob Schultz, applicant, indicated that rock crushing would occur
approximately two times a year. He agreed with the conditions of approval;
however, he would like to provide rain birds in place of the tarps.
Commissioner Mondo and Segura asked several questions regarding the company's
operation policies.
Commissioner Mondo moved to approve Conditional Use Permit No. 96-32 with the
modifications to the conditions of approval related to the applicant
providing rain birds instead of tarps and the Conditional Use Permit to have
an additional review 90 days after approval. The motion was seconded by
Commissioner Nalle.

CONDITIONAL USE PERMIT NO. 94-22

Filed by P.K. Enterprises to amend Conditional Use Permit No. 94-22 in order
to allow auto detailing at an existing car wash located at 601 East
Seventeenth Street in the Arterial Commercial (C6) zoning district.

Mr. Marvin Ellenbecker, Landscape Associate, presented the staff report and
overview of the applicant's request.
Commissioner Mondo asked Mr. Phil Martin if the applicant was aware of the
sign ordinance and if the applicant would comply with the sign ordinance.
Mr. Martin responded yes he was aware of the sign ordinance and the applicant
would comply with the ordinance.
Commissioner Mondo moved to approve Conditional Use Permit No. 94-22 with the
added condition for the applicant to remove all illegal signs and maintain
signage on site in compliance with the Santa Ana Municipal Code. The motion
was seconded by Commissioner Nalle.

CONDITIONAL USE PERMIT NO. 92-23

To revoke Conditional Use Permit No. 92-23 for the Roxbury South nightclub

district.

RECONMENDATION:
Revoke Conditional Use Permit No. 92-23.
Mr. Vince Fregoso, Associate Planner, presented the staff report and
indicated staff's request would bring closure to the proceedings and formerly
revoke the conditional use permit.
Commies Toner Mondo moved to revoke Conditional Use Permit No. 95-23. The
motion was seconded by Commissioner Nalle.
