HomeMy WebLinkAbout08/26/1996MINUTES OF THE REGULAR MEETING CITY OF SANTA ANA, CALIFORNIA PLANNING COMAISSION AUGUST 26, 1996 The Regular Meeting of the Santa Ana Planning Commission was called to order by Madam Chair Brown at 6:30 p.m. in the City Council Chambers, located at 22 Civic Center Plaza, Room 147, Santa Ana, California. Other Commissioners present included: Oliver, Doughty, Nalle, Pedroza and Segura. Also in attendance were: Robyn Uptegraff, Executive Director, Kenneth Adams, Planning Manager; Gary Sheatz, Deputy City Attorney; Charles View, Senior Planner; Tom Childress, Associate ' Planner; Larry Yenglin, Associate Planner; Jamie Watanabe, Assistant Planner Ii; Pamela Lucado, Public Works Agency; Mike McCoy, Police Department; and Linda Hale, Acting Recording Secretary. None. 0. 20NIN0 ORDINANCE AMENDMENT NO. 96-02, GENERAL PLAN AMENDMENT NO. 96-06, AND AMENDMENT APPLICATION NO. 96-06 (Thomas Childress) Filed by the City of Santa Ana to amend the General Plan land use designation and change the zoning on industrial properties in three areas of the City and to modify language in the Light Industrial (M1) district for administrative clarification. APPEAL OF PLANNING MANAGER'S DECISION NO. 96-01 (Kenneth Adams) Filed by Mr. Mark Rosen to appeal the Planning Manager's decision not to issue an occupancy permit for an office component of J & R Towing located at 3307 South Main Street in the Light Industrial (M1) zoning district. (Continued by PZanning Commission July 8, 1996 to August 26, 1996) RECOMMENDATION: Continue Appeal No. 96-01 to September 9, 1996. *** E N D OF C O N S E N T*** Commissioner Doughty moved to approve the Consent Calendar items. The motion was seconded by Commissioner Nalle. AYES: Brown, Na11e, Oliver, Doughty, Pedroza, and Segura NOES: None ABSENT: Mondo E. Comments from the Executive Director. (Robyn Uptegraff) Ms. Uptegraff informed the Commission that the Planning Division in conjunction with OCPDA would sponsor the first annual Planning Director's Forum in October. Topics would include wireless communication; and regulating sex oriented businesses; and what regional agencies do and why cities should care. Ma. Uptegraff provided an update for Seventeenth Street and Tustin. She indicated that Mr. Scott Bell of ICI would be buying Gateway from Smith Foods. Minor adjustments would be needed to the site and a Lucky's market would be the major tenant; A $4 million grant had been received for the Discovery Science Center. Staff will develop a project definition and begin to process the requests for discretionary approval. The target opening date for the Discovery Science Center is January 1998. First American Title Company would like to build a corporate facility at MacArthur Place and continue to utilize it's downtown space for back office operations. F. Commeats from the Planning Manager. (Kenneth Adams) Mr. Adams informed the Commission that in October staff would like to have an all day Saturday work session to review the draft General Plan. During the discussion five Elements would be reviewed: Urban Design, Open Space and Recreation, Land Use, Circulation and the Education Element. Madam Chair Brown requested an update on the Roxbury night club from the Police Department. Mr. Mike McCoy, Police Department, indicated that the project was still in violation of the Planning, Fire, and Police Department conditions of approval. There was illegal dancing in areas not approved for dancing and numerous other violations such as dead bolts on doors; nonilluminated exit signs; blocked exits; nonfunctional emergency lights, exposed electrical panels; and not having the required number of security guards during weekend operations. Madam Chair Brown asked if there was any liability attached to the landlord for blatant noncompliance with safety conditions by their tenant. Mr. Gary Sheatz, Deputy City Attorney, indicated that the landlord is liable. 6. Commeats from the Planning Commission. Commissioner Oliver mentioned that he had recently went to an eatery and he would like to send a "Welcome letter" to the Aztecs Grill on Seventeenth Street near Tustin Avenue. Commissioner Doughty stated that the area of North Flower Street and Seventeenth Street was deteriorating and asked if anything could be done to have a live/work area along Flower Street. Mr. Adams responded that staff could look at a "P" designation for this area. H. Recess. PUHLIC HEARINGS 7:00 o.m. 1. CONDITIONAL USE PERMIT NO. 96-22 (Jamie Watanabe) Filed by L.A. Cellular to allow a new 61 foot high cellular receiving and transmitting antenna facility located at 2731 North Grand Avenue in the Arterial Commercial (CS) zoning district. (Continued by the Planning Commission Avgvst 12, 1996 to August 26, 1996) LEGAL NOTICED: June 15, 1996 PUBLIC NOTICED: June 12, 1996 RECOMMENDATION: Deny Conditional Use Permit No. 96-22 and adopt the findings as submitted by staff. The applicant requested a continuance of Conditional Use Permit to September 9, 1996. Commissioner Nalle moved to approve the request for continuance of Conditional Use Permit No. 96-22. GENERAL PLAN AMENDMENT NO. 96-04 (Sergio Klotz) Filed by the City of Santa Ana to redesignate property in the Land Use Element generally bounded by the Santa Ana Freeway (I-5) and MainPlace Drive along Main Street from General Business District (GBD) to Professional and Administrative Office (PAO) and from General Commercial to Professional (P); and redesignate 119 East Edgewood Road from General Business District (GBD) to Low Density Residential (LR-7). B. AMENDMENT APPLICATION NO. 96-04 Filed by the City of Santa Ana to rezone property generally bound by the Santa Ana Freeway (I-5) and MainPlace Drive along Main Street from General Commercial (C2) to Professional (P) and rezone 119 East Edgewood Road from General Commercial (C2) to Single-Family Residential (R1). Recommend that the City Council adopt a resolution approving General Plan Amendment No. 96-04 to amend the Land Use Element of the General Plan; and ' 2. Recommend that Application No. the City Council adopt 96-04. an ordinance approving Amendment Mr. Sergio Klotz, Associate Planner, provided a brief presentation for the basis of the project being remanded back to Planning Commission. The following public members spoke in favor of the project: Bob Engen Michelle Morrisey Mel Vernon PLANNING COMMISSION MINUTPS 3 AUGUST 26, 1996 The following public members spoke in opposition of the project: Jim McClure Leah DuPont Commissioner Oliver noted that the item had been remanded back to the Commission due to a more thorough review of the environmental issues and moved to approve General Plan Amendment No. 96-04 and Amendment Application No. 96-04. The motion was seconded by Commissioner Segura. Commissioner Nalle moved to continue the projects for two weeks to determine if there are other options for development at the Main Street/Edgewood ' property. The motion was seconded by Commissioner Doughty. Commissioner Doughty asked staff what could be developed at the southeast corner. Mr. Klotz responded that staff's recommendation is single family residential. Commissioner Oliver reminded the Commission that the item before them was to review the environmental compliance not the entire project. Ms. Uptegraff stated that the Commission's review could also address other issues involved, but the item was specifically remand to have the Commission review the revised environmental action. ZONING ORDINANCE AMENDMENT NO. 96-03 (Larry Yenglin) Filed by the City of Santa Ana to change the permitted and conditionally permitted uses in the Professional (P) zoning district in the City. LEGAL NOTICED: August 11, 1996 RECOMMENDATION: Recommend that the City Council approve Zoning Ordinance Amendment No. 96-03. Mr. Larry Yenglin, Associate Planner, provided a brief overview and indicated ' that the zoning ordinance amendment was also remanded back to the Commission for a more thorough environmental review. Commissioner Doughty asked if the change would expand the uses in the Professional (P) district. Mr. Yenglin indicated that it would allow additional support uses. There were no public comments on the item. Commissioner Nalle moved to approve Zoning Ordinance Amendment No. 96-03. The motion was seconded by Commissioner Segura. AMENDMENT APPLICATION NO. 96-08 (Sergio Klotz/Susan Helper) Filed by the City of Santa Ana to rezone properties generally bounded by First, Third, Bush, and Spurgeon Streets from Central Business (C3) to Central Business-Artist Village (C3-A) zoning district. (Continued by the Planning Commission Augvst 12, 1996 to August 26, 1996) LEGAL NOTICED: August 2, 1996 PUBLIC NOTICED: August 2, 1996 RECOMMENDATION: Recommend that the City Council adopt an ordinance approving Amendment Application No. 96-08. Mr. Sergio Klotz, Associate Planner, provided a discussion indicating the background on the current and proposes uses and the boundaries of the proposed zoning. Ma. Susan Helper, Community Development, provided an overview of the City's vision for the proposed expanded artist village and the existing artist village. PIANNING COMMISSION MINUfFS 4 AUGUST 26, 1996 The following public members spoke in favor of the project: John McDowell James Kendrick Mel Vernon Michelle Morriaey The following public members requested a continuance of the project: Liz Gallagher Bruce Miller Lisa Weinberg i~ 5 6 Commissioner Oliver noted that the Adcor proposal was not the issue; nor was their capability to develop the property. However the issue was what uses would be allowed the area of the proposed rezoning. Commissioner Oliver further moved to approve Amendment Application No. 96-08. The motion was seconded by Commissioner Doughty. AYES: Brown, Nalle, Oliver, Doughty, Pedroza, and Segura NOES: None ABSENT: Mondo CONDITIONAL USE PERMIT NO. 96-27 (Melanie McCann) Filed by Mr. Akhtar Khan to allow after hour operations at an existing food establishment located at 711 North Bristol Street in the Bristol Street Specific Plan Area (SP-1) and Planned Shopping Center (C4) zoning district. LEGAL NOTICED: Augu et 11, 1996 PUBLIC NOTICED: August 15, 1996 RECOMMENDATION: Approve Conditional Uae Permit No. 96-27 as conditioned and adopt the findings as submitted by staff. Ms. Melanie McCann, Assistant Planner II, a brief description of the project and the basis for staff's recommendation. Commissioner Oliver asked why staff supports the project in an above average crime area. Mr. McCoy responded that the site was well managed and had minimal criminal incidents. Commissioner Pedroza asked if the business is currently operating. Staff responded that it is currently operating 24 hours daily, Madam Chair Brown asked the applicant if he was aware of the conditions of approval and if he was in agreement with all of the conditions. The applicant, Mr. Akhtar Khan, responded that he was aware of and in agreement with all conditions. Commissioner Oliver moved to approve Conditional use Permit No. 96-27. the motion was seconded by Commissioner Segura. AYES: Brown, Nalle, Oliver, Doughty, Pedroza, and Segura NOES: None ABSENT: Mondo CONDITIONAL USE PERMIT NO. 96-28 (Bill Apple) Filed by Mr. Felimon Mikhael to allow a room addition to an existing rectory located at 4330 West Regent Drive in the Single-Family Residential (R1) zoning district. LEOAL NOTICED: August 12, 1996 PUBLIC NOTICED: August 15, 1996 RECOMMENDATION: Approve Conditional Use Permit No. 96-28 as conditioned and adopt the findings as submitted by staff. Mr. Bill Apple, Assistant Planner II, provided a brief project description and a basis for staff's recommendation and conditions of approval. Commissioner Oliver asked if there were any problems since the initial approval. PLANNING COMMISSION MINUTES 5 AUGUST 26, 1996 Mr. Apple responded that the surrounding owners had been notified of the project and no calla or complaints were received. Mr. Ayyad Ghobrial, representing the applicant, requested a waiver for the condition of approval related to constructing a pitched roof and requested to allow the applicant to work with staff to screen the mechanical equipment. Commissioner Doughty asked if the equipment was viewable from the street. Mr. Apple indicated that the equipment is viewable from the church parking lot and one adjacent property. ' Commissioner Pedroza asked if the entire addition proposed was a flat roof. Mr. Ghobrial responded yes and asked if all other previous conditions apply to the project. In response staff indicated that all previous conditions still apply to the project. Commissioner Oliver moved to continue Conditional Use Permit No. 96-27 for 30 days. Mr. Ghobrial stated that the applicant agrees with pitching the addition, but does not want to have to pitch the existing flat portion of the roof. Commissioner Oliver withdrew his motion for a continuance. Commissioner Doughty asked how the flat roof could be approved. Mr. Adams stated that staff had not done any research on the flat roof. After further discussion, Commissioner Oliver indicated that he supported staffs recommended conditions and moved to approve Conditional Use Permit No. 96-27. The motion was seconded by Commissioner Doughty. Commissioner Segura noted that she would like to see photos of the addition and she was in support of the request. DRAFT ENVIRONMENTAL IMPACT REPORT NO. 94-1 FOR THE MIDTOWN SPECIFIC PLAN (Maya DeRosa/Susan Helper) To review the Draft Environmental Impact Report and to receive public input on the potential impacts effects of the proposed Midtown Specific Plan. LEGAL NOTICED: August 16, 1996 PUBLIC NOTICED: August 15, 1996 RECOMMENDATION: Receive and file public comments on the Draft Environmental Impact Report No. 94-1. Me. Susan Helper, Community Development, provided an overview of the Midtown District, the history of the Plan, the vision for ultimate development, and the use of the district. She further described the five subdistricts and their character and context within the framework of adjacent neighborhoods and commercial district. Ms. Maya DeRosa, Environmental Coordinator, noted that the purpose of this meeting was to take public comments on the proposed environmental impact report (EIR). The comments would be noted and included in the draft environmental impact report (DEIR) as well as responses to comments. Ms. DeRosa also noted that adverse impacts were unavoidable and alternatives were considered in the analysis. The following public members commented on the DEIR: ' Ms. Debbie McEwen commented that she had traffic circulation concerns on Washington Street and that on page 56 it refers to "community serving district", what community is it referencing. Mr. Mel Vernon commented that he was concerned with the additional traffic on Lincoln, Fairhaven, and Santa Clara. In addition, he noted that he was speaking for himself and not the Park Santiago Neighborhood. Mr. James Kendrick commented that he supported the environmental report but he believed there were traffic impacts that had been overlooked. Ms. Ginger Flour commented that she was concerned about the blight and crime in the area and asked if the project would help the area. PLANNING COMMISSION MINUTES 6 AUGUST 26, 1996 Commissioner Oliver noted that he favored any actions or studies to achieve a Netter traffic flow and further commented that he believed traffic impacts were a legitimate concern. Commissioner Oliver moved to receive and file the public comments on the DEIR. The motion was seconded by Madam Chair Brown. AYES: Brown, Nalle, Oliver, Doughty, Pedroza, and Segura NOES: None ABSENT: Mondo 8. EBCUSE OF ABSENCES. Madam Chair Brown moved to excuse the absence of Commissioner Mondo. the motion was seconded by Commissioner Nalle and unanimously passed. 9. ADJOURNMENT.
