PLANNING CONNISSION
AUGUST 12, 1996
The Regular Meeting of the Santa Ana Planning Commission was called to order by Vice
Chairman Nalle at 6:03 p.m. in the City Council Chambers, located at 22 Civic Center
Plaza, Room 147, Santa Ana, California. Other Commissioners present included:
Oliver, Mondo, Doughty, and Segura. Also in attendance were: Robyn Uptegraff,
Executive Director, Kenneth Adams, Planning Manager; Gary Sheatz, Deputy City
Attorney; Charles View, Senior Planner; Tom Childress, Associate Planner; Larry
Yenglin, Associate Planner; Jamie Watanabe, Assistant Planner II; Pamela Lucado,
Public Works Agency; Mike McCoy, Police Department; and Sharon McCain-Johnson,
Recording Secretary.
A. Approval of the Minutes from the Regular Meeting of July 22, 1996.
Approve the Minutes of the Regular Meeting of July 22, 1996.
B. Reconsideration of actions taken at the previous meeting.

Commissioner Mondo stated that he would abstain from voting on the Consent
Calendar items due to his absence.
Commissioner Doughty moved to approve the Consent Calendar. The motion was
seconded by Commissioner Segura.

C. Discussion of the French Park (SD) permitted uses and development
standards. (Larry Yenglin)
Mr. Larry Yenglin, Associate Planner lead a discussion regarding the French
Park (SD) area. He indicated that SD-19 was originally adopted by the City
Council in 1985, the primary reason was to protect the historic homes located
in this area. In addition, Mr. Yenglin stated that the SD was created to:
1) stop the demolition of historic homes in the area; 2) encourage the
rehabilitation of historic homes; and 3) maintain and continue the historic
character of this area by requiring exterior modifications to existing
structures to be similar to the original appearance of the house.
The Planning Division had worked closely with the Historic French Park
Neighborhood Association in updating these regulations and anticipate these
standards would assist in the revitalization of the neighborhood.
Mr. Yenglin summarized that the major changes to the French Park area were:
conditionally permitted uses, residential development standards, professional
office, mixed use conversions, temporary outdoor activities, design review
demolition permits, and review process.
Commissioner Mondo asked if all property owners had been notified of the
proposed changes.
Mr. Yenglin responded that the property owners had been notified.
D. Comments from the Executive Director. (Robyn Uptegraff)
There were no comments.
E. Comments from the Planning Manager. (Kenneth Adams)
Mr. Adams indicated that he would defer his time for Mr. Tom Childress to
discuss the rezoning of the industrial properties
Mr. Tom Childress, Associate Planner, indicated that the Zoning Ordinance
Amendment, General Plan Amendment, and Amendment Application was a request by
staff to change the zoning of industrial properties and to modify the
language for the Light Industrial zoning district for additional
administrative clarification. Mr. Childress displayed area maps and
explained to the Commission the areas involved in the zone changes
After further discussion, it was determined by the Commission that it would
be best not to take action at this time on the request due to the logistics
of the rezoning request and continue the case to August 26, 1996.
F. Convents from the Planning Comissioa.
Commissioner Doughty asked how Councilman Richardson had been doing.
Ms. Uptegraff indicated that she had recently visited him and he was in good
spirits. However, she had not heard an update since her visit.

PROCEDURAL RULES: The procedural rules for the session were read by Vice Chairman
Nalle.
PUBLIC HEARINGS 7:00 p.m.
Vice Chairman Nalle informed the public that he would be recommending that the
Commission continue Zoning Ordinance Amendment No. 96-02, General Plan Amendment No.
96-06, Amendment Application No. 96-06, and Amendment Application No. 96-08.

BONING ORDINANCE AMENDMENT NO. 96-02, GENERAL PLAN AMENDMENT NO. 96-06, AND
AMENDMENT APPLICATION NO. 96-06 (Thomas Childress)
Filed by the City of Santa Ana to amend the General Plan land use designation
and change the zoning on industrial properties in three areas of the City and
to modify language in the Light Industrial (M1) district for administrative
clarification.

1. Recommend that the City Council approve Zoning Ordinance Amendment No.
96-02.
2. Recommend that the City Council adopt a resolution approving General
Plan Amendment No. 96-06 to amend the Land Use Element of the General

3. Recommend that the City Council adopt an ordinance approving Amendment
Application No. 96-06.
Commissioner Oliver Moved to continue the items for 30 days. The motion was
seconded by Commissioner Mondo.

AMENDMENT APPLICATION NO. 96-08 (Sergio Klotz)
Filed by the City of Santa Ana to rezone properties generally bounded by
First, Third, Bush, and Spurgeon Streets from Central Busineea (C3) to
Central Busineea-Artist Village (C3-A) zoning district.

CONDITIONAL USE PERMIT NO. 96-22

Filed by L.A. Cellular to allow a new 61 foot high cellular receiving and
transmitting antenna facility located at 2731 North Grand Avenue in the
Arterial Commercial (C5) zoning district.

RECOMMENDATION:
Deny Conditional Use Permit No. 96-22 and adopt the findings as submitted by
staff.
Mr. Jamie Watanabe, Aeeist ant Planner II, provided an overview of the
applicant's request to allow a monopole with transmitting antenna. Zn
addition, Mr. Watanabe indicated that staff did not support the initial
request but staff had three recommendations for the request: 1) that the
applicant co-locate with the existing monopole; 2) locate the monopole in
either nearby Santiago Park; and or 3) Hart Park.
Staff requested that the applicant investigate these three options, however
the applicant had not submitted adequate information regarding the viability
of these options.
Commissioner Oliver asked if the applicant was aware of these alternatives.
Mr. Watanabe indicated that the applicant had been informed.
Ms. Leslie Daigle, representing LA Cellular, indicated that they had
considered staff's alternatives. She stated that in order for LA Cellular to
co-locate on another monopole, they would need to get approval by AirTouch
Cellular. She displayed a certified letter that LA Cellular sent to
AirTOUCh, however she stated that no response had been received back by
AirTOUCh Cellular.
In addition, Ms. Daigle provided a brief presentation indicating that the
community in Santa Ana had a need for additional monopoles for the area in
order for adequate network service to be provided in the area. One of the
options, staff mentioned was locating a monopole at Hart Park in the City of
orange. The City of Orange had been working on an ordinance for monopoles.
Ms. Daigle further indicated that she would like to work with staff and in
order for LA Cellular to complete their studies she would like to request a
continuance of the request.
Mr. Peter Pleakacz, Engineer for LA Cellular, mentioned that discussions had
been made regarding co-location of monopoles but there were difficulties with
co-location such as interference, antenna isolation, and monopole height
problems.
Commissioner Oliver asked if any consideration had been given to locating the
monopole at the suggested parks or on roof tops.
In response Mr. Pleskacz indicated that the monopole would need to go above
the trees to cover the broad area; Santiago Park was too far to the west; and
commercial and retail roof tope had not been considered.
Commissioner Mondo asked if any consideration had been given to a stealth
design or other similar designs.
Me. Daigle indicated that they would consider other designs.
Commissioner Oliver asked if the applicant would have any problems if their
request was approved, adding a condition to the conditional use permit that
the monopole be acceptant for co-location.
Ms. Daigle responded that LA Cellular would consider it but would need the
engineer to make sure the monopole would be capable of handling the co-
location.
Mr. Joe Morales, LA Cellular, indicated that the FCC has basic requirements.
That there were interference problems and they had to fix them.
After further discussion, Mr. Adams indicated to the Commission that it would
be best to continue the case in order for staff and the applicant to discuss
the options further.
Commissioner Mondo moved to continue Conditional Use Permit No. 96-17 to
August 26, 1996.
Mr. Adams requested that the Commission continue for 30 days to allow staff
and adequate amount of time to meet with the applicant.
Commissioner Mondo responded that he would like staff to work with the
applicant during the next two weeks and if no progress had been made an
additional request could be made for another continuance.
Commissioner Mondo indicated that he would like his motion to go forth for
Conditional Use Permit No. 96-17 to August 26, 1996. The motion was seconded
by Commissioner Oliver.

1. Recommend that the City Council approve Zoning Ordinance Amendment No.
96-06.
2. Recommend that the City Council adopt a Resolution to authorize design
review guidelines.

Ms. Diann Marsh indicated that she was in favor of the ordinance and stated
that she would like to see Santa Ana restored to the way it used to be. 1n
addition, she indicated that she had worked very hard with staff and had many
neighborhood meetings; that the area needed a special instrument in order to
maintain the historic neighborhood.
Ms. Debbie McEwen indicated that she supported the request and the
neighborhood association had not received any opposition.
Commissioner Oliver asked during the review process, if a project would be
reviewed by the Planning Division.
Mr. Yenglin responded that the project would go before the design committee
and then it would be forwarded to Planning Commission for approval.
Commissioner Oliver asked what would happen if the neighborhood association
approved the project and the project meets all of the City standards but then
design committee did not support the project.
Mr. Yenglin stated that the item would come before the Commission for final
approval.
Commissioner Doughty commented that she was in favor of the project and
expressed her appreciation for the work performed by staff and the
neighborhood association.
Commissioner Mondo stated that he felt staff and the neighborhood association
did a tremendous job and moved to approve Zoning Ordinance Amendment No. 96-
06 with the added condition that the 90 day time period related to demolition
could be shortened upon concurrence of the property owner, Historic French
Park Neighborhood Association and the Santa Ana Historical Preservation
Society. The motion was seconded by Commissioner Oliver.

Filed by Mr. Rafael Ayila to allow after hour operations for La Vaquita
Restaurant located at 1525 Weat First Street in the Community Commercial (Cl)
zoning district.

Ma. Lynnette Perry, Assistant Planner II provided an overview of the
applicant's request to continue after hour operations at the La Vaquita
Restaurant. Ms. Perry stated that the restaurant had been in operation since
1986; no alcoholic beverages were sold at the location; and the crime rate
was considered average by the Police Department. Landscaping upgrades would
be completed by the applicant and staff recommends approval of the request.
Commissioner Mondo clarified with Ma. Perry that the applicant was requesting
to extend the hours of operation for Friday and Saturday only.
Ma. Perry confirmed that the applicant was only asking to extend the hours of
operation on Friday and Saturday nights.
Mr. Avila, applicant, stated that he agreed with the conditions of approval
and that it was important to him to be able to continue restaurant operations
until 3:00 a.m.
Commissioner Mondo moved to approve Conditional Use Permit No. 96-26. The
motion was seconded by Commissioner Doughty.

6. CONDITIONAL USE PERMIT NO. 95-32 (Larry Yenqlin)
To discontinue revocation proceedings and to modify the conditions of
approval for Tacos Serrano after hour operations located at 415 North Grand
Avenue.

2. Approve the modified conditions of approval for Conditional Uae Permit
No. 95-32.
Mr. Larry Yenglin, Associate Planner, provided a brief background of the
project and indicated that staff had been working with the telephone company
(StarNet) and an agreement had been made between staff and StarNet to
discontinue phone operations between the hours of 9:00 p.m. and 5:00 a.m. In
addition, staff recommends the Commission to direct staff to discontinue the
revocation proceedings and to approve the modified conditions of approval.
Commissioner Mondo asked if the applicant had removed the public phone from
the public right-of-way.
Mr. Mike McCoy, Police Department, stated that the relocation of the phones
had been completed at this site, but not yet at other StarNet sites.
Commissioner Mondo moved to approve the modified conditions of approval and
directed staff to discontinue revocation proceedings. The motion was
seconded by Commissioner Doughty.

5. EBCUSE OF ABSENCES.
Commissioner Mondo moved to approve the absences of Commissioners' Brown and
Pedroza. The motion was seconded by Commissioner Segura and unanimously
passed.
