HomeMy WebLinkAbout06/24/1996MINUTES OF THE REGULAR MEETING CITY OF SANTA ANA, CALIFORNIA PLANNING COMMISSION JUNE 24, 1996 The Regular Meeting of the Santa Ana Planning Commission was called to order by Madam Chair Brown at 6:03 p.m. in the City Council Chambers, located at 22 Civic Center Plaza, Room 147 Santa Ana, California. Other Commissioners present included: Nalle, Pedroza, Segura, and Doughty and Mondo arrived at 6:10 p.m. Also in attendance were: Kenneth Adams, Planning Manager; Gary Sheatz, Deputy City Attorney; Linda Hale, Senior Planner; Charles View, Senior Planner; Marvin Ellenbecker, Associate Planner; Larry Yenglin, Associate Planner; Jamie Watanabe, Asaiatant Planner II; Mike McCoy, Police Department; and Jeffry .Rice, Acting Recording Secretary. A. Approval of the Minutes from the Regular Meeting of May 13, 1996. RECOMMENDATION: Approve the Minutes of the Regular Meeting of May 13, 1996. B. Reconsideration of actions taken at the previous meeting. None. C. APPEAL NO. 96-03 (Larry Yenglin) Filed by Mr. Jose Meza to appeal the decision of the Zoninq Administrator not to allow the sale of beer and wine at the E1 Comal Restaurant located at 1515 East First Street in the General Commercial zoning district. LEGAL NOTICED: June 1, 1996 PUBLIC NOTICED: May 31, 1996 Continue Appeal No. 96-03 to July 8, 1996 at the request of the applicant. D. HISTORIC REVIEW NO. 96-03 (Marvin Ellenbecker) Filed by Mr. Mike Zadeh to rebuild a single car garage that was previously remodeled located at 1019 North Spurgeon Street in the French Park Historical Neighborhood. nsnnuwonrnan+r nu. Approve Historic Review No. 96-03. *** E N D O F C O N S E N T C A L E N D A R*** Commissioner Pedroza moved to approve the Consent Calendar items. The motion was seconded by Commissioner Nalle. AYES: Brown, Nalle, Doughty, Mondo, Pedroza and Segura NOES: None ABSENT: Oliver E. North Main Street and the Museum District study session. (Linda Hale) Ms. Linda Hale, Senior Planner, provided a brief overview of the Main Street study session held with the City Council. She focused on the directed actions that came out of the study session. Particularly, the rezoning of property to the Professional (P) zoning district south of MainPlace Drive and north of the I-5 freeway. There would also be a General Plan Amendment to redesignate these properties to the Professional and Administrative Office (PAO) land use category. In the Museum district, an interim zoning is proposed for properties with Main Street frontage called Community Commercial-Museum District (C1-MD). This zoning would revise the permitted uses on an interim basis. Mr. Larry Yenglin, Associate Planner, provided an overview of modifications to the Professional (P) zone uses and standards. These changes will revise the Professional (P) zone and impact all Professional (P) zoned property, not just property in and about North Main Street. Mr. Howard Burns, representing McDOnald's, spoke in protest of the proposed P zone change on the Red Roof Inn site. He passed out a rendering of the proposed McDonald's site. The proposed franchise operator introduced herself and was looking forward to coming into the City of Santa Ana. Ms. Ruth Ornsby of Red Roof Inn, spoke in favor of McDOnald's given they are unable to get a sit-down restaurant adjacent to their hotel. Mr. Bon Enger, representing Mr. McClure at Edgewood and Main Street, spoke in opposition to the Professional (P) zone change on his client's property. F. CONDITIONAL USE PERMIT NO. 95-36 (Jamie Watanabe) Review of Conditional Use Permit No. 95-36 to allow after hour operations at Pizza Hut located at 2541 South Fairview Avenue. Direct staff to begin revocation proceedings for Conditional Use Permit No. 95-32. Mr. Jamie Watanabe, Assistant Planner II, gave an overview of the Conditional Use Permit and conditions not met. Mr. Mike McCoy, Police Department, stated the light upgrades had not been completed. Ms. Ruth Logsdon of Pizza Hut indicated that they had been complying with the conditions and were receiving mixed messages from staff. Trees had been trimmed since the inspection. Commissioner Mondo moved to continue Conditional Use Permit No. 95-36 and and verified with the applicant that he fully understood what was expected of him according to the conditions of approval. The motion was seconded by Commissioner Nalle (no vote took place). After further discussion, Commissioner Segura moved to direct staff to begin revocation proceedings. There was no second for the motion. The Commission reiterated the previous motion of Commissioner Mondo to Continue Conditional Use Permit No. 95-36 to July 8, 1996. CONDITIONAL USE PERMIT NO. 95-32 (Larry Yenglin) Review of Conditional Use Permit No. 95-32 to allow after hour operations at Tacos Serrano located at 415 North Grand Avenue. RECOMMENDATION: Mr. Yenglin provided an overview of the outstanding condition for the pay phones to be removed. Mr. Matt Rogers representing Tacos Serrano spoke in favor of the applicant. He indicated that the phones are on a lease basis and cannot be readily removed and the conditions of approval went against the lease. Mr. Gary Sheatz, Deputy City Attorney, indicated to Mr. Rogers the legality of exercising the Conditional Use Permit versus breaking the lease. Commissioner Doughty mentioned that she would like to look for alternatives. Mr. McCoy mentioned that although its an enforcement issue, he suggested a shut off timer at late night hours. Commissioner Mondo moved to direct staff to begin revocation proceedings for Conditional Use Permit No. 95-36. The motion was seconded by Commissioner Brown (no vote took place). After further discussion, Commissioner Nalle presented an alternative motion to continue for Conditional Use Permit No. 95-36 to July 8, 1996. The motion was seconded by Commissioner Pedroza. ZONING ORDINANCE AMENDMENT NO. 96-OS (Charles View) Filed by the City of Santa Ana to allow the development of care homes subject to a Conditional Use Permit in Specific Development 19 (Historic French Park). ' RECOMMENDATION: Recommend that the City Council approve Zoning Ordinance Amendment No. 96-OS for Specific Development 19. Mr. Charles View, Senior Planner, provided a brief overview of the staff report to allow care homes by conditional use permit in the French Park area. Commissioner Doughty moved to approve Zoning Ordinance Amendment No. 96-05. The motion was seconded by Commissioner Mondo. REVISION OF RISTORIC REVIEW NO. 95-01 (Charles View) Filed by Mr. Alejandro Moreno to allow the replacement of proposed wood aiding with stucco on a single family home located at 914 South Van Ness Street in the Specific Development 40 (Henninger Park Historical District). Deny the request to revise the plans for Historic Review No. 95-01. Mr. Charles View, Senior Planner, provided an overview of the applicant's request to utilize stucco as the exterior finish material for the project rather than the previously approved wood Biding. Mr. Moreno indicated stucco costa would be approximately $3,000 and wood siding would costs approximately $15,000. After further discussion of various alternatives, Commissioner Doughty moved to deny the Revision of Historic Review No. 95-01. The motion was seconded by Commissioner Mondo. APPEAL NO. 96-01 (Kenneth Adams) Filed by Mr. Mark Rosen to appeal the Planning Manager's decision not to issue an occupancy permit for an office component of J & R Towing located at 3307 South Main Street in the Light Industrial (M1) zoning district. RECOMMENDATION: Deny Appeal No. 96-01. Commissioner Mondo moved to continue Appeal No. 96-01 to July 8, 1996. The request was granted and unanimously passed. Comments from the Planning Manager. (Kenneth Adams) Mr. Adams indicated that Mr. Mike McCoy and Yolanda Pena had comments but he deferred them until after the public hearings. N. Roll call was answered by Commissioners Nalle, Mondo, Doughty, Pedroza, and Segura. Also in attendance were: Kenneth Adams, Planning Manager; Gary She at z, Deputy City Attorney; Larry Yenglin, Associate Planner; Jamie Watanabe, Assistant Planner II; Lynnette Pedroza, Assistant Planner II; Jamie Watanabe, Assistant Planner II; Pam Lucado, Mike McCoy and Yolanda Pena, Police Department; and Charles View, Acting Recording Secretary. PLEDGE OF ALLEGIANCE TO THE FLAG: The Pledge of Allegiance was led by Madam Chair Brown. PROCEDURAL RULES: The procedural rules for the session were read by Madam Chair Brown. PUBLIC HEARINGS, 7:00 p.m., COUNCIL CHAMBERS Madam Chair Brown moved to continue Conditional Use Permit No. 96-22 and Appeal No. 96-04 to July 22, 1996. The motion was seconded and unanimously passed by the Commission. 1 ^ 2 CONDITIONAL USE PERMIT NO. 96-17 (Lynnette Perry) Filed by AirTouch Cellular to increase the height of an existing monopole and antenna array from 35 feet to 65 feet at Saddleback High School located at 2802 South Flower Street in the Open Space (O) zoning district. LEGAL NOTICED: June 1, 1996 PUBLIC NOTICED: May 30, 1996 RECOMMENDATION: Approve Conditional Use Permit No. 96-17 as conditioned by staff and adopt the findings as submitted by staff. Ms. Lynnette Perry, Assistant Planner II, provided an overview of staff report and the applicant's request to increase the height of an existing monopole. In addition, Ms. Perry indicated that staff's primary concern was the location and visibility of the facility; there would be no impacts to the neighborhood, and screening would be provided through landscaping. Commissioner Mondo asked for information regarding service area and pole heights. Mr. Robert Salem, expressed his appreciation to staff and indicated that the height would be 65 feet. Commissioner Mondo asked how high the Southcoast, Redhill Street, and Alton Street sites were. Mr. Salem responded that the Southcoast site was 60 foot roof mounted; the Redhill Street site was 60 feet; and Alton Street was 45 feet. There was a discussion between the applicant and the Planning Commission regarding cellular service and the height of the monopoles. After further discussion the Commission voted to approve Conditional Use Permit No. 96-17. AYES: Brown, Nalle, Doughty, Pedroza and Segura NOES: Mondo ABSENT: Oliver CONDITIONAL USE PERMIT NO. 96-23 (Jamie Watanabe) Filed by Mr. Sareth Srey to allow after hour operations at Jacks Donuts located at 2413 West Seventeenth Street in the Community Commercial (Cl) zoning district. LEGAL NOTICED: June 1, 1996 PUBLIC NOTICED: May 31, 1996 Approve Conditional Use Permit NO. 96-23 as conditioned by staff and adopt the findings as submitted by staff. Mr. Jamie Watanabe, Assistant Planner, provided an overview of the staff report and the applicant's request to allow after hour operations at an existing donut shop. In addition, Mr. Watanabe indicated that staff did not anticipate any adverse effects and recommends approval of the request. Commissioner Doughty asked if the local neighborhood was noticed of the request. PIANNING COMMISSION MMUTES 4 1UNE 21, 1996 Mr. Watanabe responded yes. Commissioner Mondo asked if condition number 2 applied to 24 hour operations. Mr. Kenneth Adams, Planning Manager, responded that for this particular case condition number 2 would not apply. Commissioner Nalle asked if Police Department condition number 1 was the same as other after hour operations. Mr. McCoy responded that the it was a standard condition of approval. Commissioner Nalle moved to approve Conditional Use Permit No. 96-17. The motion was seconded by Commissioner Doughty. Commissioner Mondo expressed opposition to approving the 24 hour request when the applicant did not attend to operate the restaurant for 24 hours. AYES: Brown, Nalle, Doughty, Pedroza and Segura NOES: Mondo ABSENT: Oliver 3. CONDITIONAL USE PERMIT NO. 96-22 (Jamie Watanabe) Filed by L.A. Cellular to allow a new 61 foot high cellular receiving and transmitted antenna facility located at 2731 North Grand Avenue in the Arterial Commercial (CS) zoning district. LEGAL NOTICED: June 15, 1996 PUBLIC NOTICED: June 12, 1996 RECOMMENDATION: Deny Conditional Use Permit No. 96-22 and adopt the findings as submitted by staff. Continued by the Planning Commission to July 22, 1996. 4. APPEAL NO. 96-04 (Larry Yenglin) Filed by Mr. Victor Koshkerian to appeal the Zoning Administrator's decision not to allow the sale of beer and wine for off-premise consumption at an ' existing Chevron gas station located at 2650 North Grand Avenue. LEGAL NOTICED: June 15, 1996 PUBLIC NOTICED: June 13, 1996 RECOMMENDATION: Confirm the action of the zoning Administrator's denying Conditional Use Permit No. 96-19 and adopt the findings as submitted by staff. Continued by the Planning Commission to July 22, 1996. L. Comments from the Planning Manager. (Kenneth Adams) Ms. Yolanda Pena, Police Department, discussed the Department's concerns regarding an investigation held for the Galaxy Theater. She recommended that Planning Commission review the conditions of approval at an upcoming Commission meeting. In addition, she added that the Monday night cover charge was not consistent with the approved conditional use. Mr. Gary Sheatz, Deputy City Attorney, mentioned another recent court case involving the City. Commissioner Mondo asked the status of the Roxbury's conditional use permit. Mr. Adams responded that a 21 day notice for revocation had begun. Commissioner Mondo asked if there were any food services at Roxbury's night club. Ms. Pena indicated that the entire first floor of food services had been completely dismantled and the floor was being used for entertainment purposes. Commissioner Mondo requested staff to verify the conditions of approval for the Galaxy Theater as to whether the theater had been issued a dancing permit. Commissioner Nalle requested staff to verify if there were any other problems associated with the site.
