HomeMy WebLinkAbout03/25/1996MINUTES OF THE REOVLAR NEETINO CITY OF SANTA ANA, CALIFORNIA PLANNING COMMISSION March 25, 1996 The Regular Meeting of the Santa Ana Planning Commission was called to order by Madam Chair Brown at 6:00 p.m. in the City Council Chambers, located at 22 Civic Center Plaza, Room 147 Santa Ana, California. Other Commissioners present included: Nalle, Oliver, Doughty, Pedroza, Segura, and Mondo arrived at 6:10 p.m. Also in attendance were Robyn Uptegraff, Executive Director; Kenneth Adams, Planning Manager; Gary Sheatz, Deputy City Attorney; Larry Yenglin, Associate Planner; Tom Childress, Associate Planner; Chad Beckstrom, Intern; Pam Lucado, Public Works Agency; Mike McCoy and Yolanda Pena, Police Department; and Sharon McCain-Johnson, Recording Secretary. CONDITIONAL USE PERMIT NO. 90-01 (Tom Childress) Annual review of Conditional Use Permit No. 90-01 to allow indoor entertainment located at 2323-2345 Weat First Street Receive and file the staff report for the annual review of Conditional Uae Permit No. 90-1. D. CONDITIONAL USE PERMIT NO. 92-10 (Tom Childress) Annual review of Conditional Use Permit No. 92-10 to allow a transmission service and repair shop located at 2005 North Tustin, dFD. RECOMMBNDATION: Receive and file the staff report for the annual review of Conditional Use Permit No. 92-10. E. CONDITIONAL USE PERMIT NO. 92-17 (Tom Childress) Annual review of Conditional Use Permit No. 95-17 to allow the sale of beer and wine for on-premise consumption at the Manuela Calderon Taqueria Guadalajara Restaurant located at 1320 East Edinger Avenue. RECOIOtENDATION: Receive and file the staff report for the annual review of Conditional Use Permit No. 92-17. F. CONDITIONAL USE PERMIT NO. 92-19 (Tom Childress) Annual review of Conditional Uae Permit No. 92-19 to allow the sale of beer and wine for on-premise consumption for the Topaz Restaurant located at 2002 North Main Street. RECOMMENDATION: Receive and file the staff report for the annual review of Conditional Use Permit No. 92-19. O. CONDITIONAL USE PERMIT NO. 94-01 (Tom Childress) Annual review of Conditional Use Permit No. 94-01 to allow the sale of beer and wine for on-premise consumption at the Pupuaidromo Restaurant located at ' 819 South Main Street. RECOMMENDATION: Receive and file the staff report for the annual review of Conditional Use Permit Nc. 94-8. I. RECOMl~NDATIONs Receive and file the staff report for the annual review of Variance No. 89-8. *** E N D O F C O N S E N T C A L E N D A R*** PLANNING COMLOSSION MINUTHS 2 MARCH 26, 1996 Mr. Tom Childress, Associate Planner informed the Commission that Conditional Uee Permit No. 92-19 needed some further review by the Police Department and requested the item be continued until April 8, 1996. Commissioner Doughty asked if the number of alcoholic licenses in the City had increased. Me. Yolanda Pena indicated that the number of licensed had decreased since 1988. However, the amount of off-site and on-site alcoholic licenses were almost equal. Commissioner Nalle ae why Conditional Use Permit No. 92-19 was requested to be continued. Me. Pena stated that an indoor entertainment banner had been recently noticed. Indoor entertainment had not been approved with the original conditional use permit and the Police Department would like to investigate the operation. Commissioner Oliver asked if a piano, violinist, etc. would be considered indoor entertainment. Me. Pena stated yea. Commissioner Nalle moved to approve the consent calendar with the continuation of Conditional Use Permit No. 92-19. The motion was seconded by Commissioner Oliver. AYES: Brown, Nalle, Oliver, Doughty, Pedroza, Nalle, and Segura NOES: None ABSENT: Mondo UNIFORM CODE BOARD OF APPEALS 1. UCBA APPEAL NO. 96-O1 (Bob Tyler) Filed by Mr. Steven C. Shepherd to allow relief from strict adherence to current accessibility codes related to a existing parking structure located at 600 Weet Santa Ana Boulevard. LEGAL NOTICED: March 17, 1996 APPLICANT NOTICED: March 15, 1996 RECOMNENDATION: Approve Appeal No. 96-01 ae conditioned by staff. Me. Uptegraff requested thatUCBA Appeal No. 96-01 be continued to April 8, 1996 due to more project clarification. Commissioner Nalle moved to continue UCBA Appeal No. 96-01. SIGN PERNIT NO. 96-45 (Larry Yenglin) Filed by Mr. Brad Becker to allow a facade change for a proposed Hollywood Video located at 810 South Harbor Boulevard in the Specific Plan 2 zoning district. Approve Sign Permit No. 96-45. Mr. Larry Yenglin, Associate Planner, provided an overview of the applicant's request to allow a facade change on a building in the Lucky's shopping center for a Hollywood Video. The sign would be an attempt to mimic the Hollywood sign in the Hollywood H111s. Mr. Yenglin stated that staff believed the proposed design meets the intent of the creativity desired for new development along Harbor Boulevard and recommends approval of the request. Mr. Brad Becker, representing Hollywood Video, indicated that the proposed Hollywood Video would be the first store in Orange County. It would be approximately 6,000 square feet with 75 T.V. monitors, and it would be a family oriented atmosphere. In addition, Mr. Becker stated that there would be no pornographic videos and he felt the store would be successful in the location. Commissioner Nalle asked how the applicant decided on the location for the video store. PIANNINO COMI~B9S[ON MINUTHS 3 MARCH 25, 1996 Mr. Becker indicated that the site was vacant; the area had been restored and had a cleaner environment; and he felt it would do well at the location. Commissioner Oliver asked if the aignage was only being considered with the request and was it similar to previous requests including awning. Mr. Yenglin indicated the facade change was being considered and it was similar to previous Commission determinations regarding awning. Commissioner Doughty moved to approve Sign Permit No. 96-01. (Kenneth Adams) Mr. Adams informed the Commission that City Council approved the Riverview West project. Eacess. it PLANNING COMMLSS[ON MINUTES 4 MARCH 25, 1996 COUNCIL CHAMBERS ROLL CALLS The Regular Meeting of the Santa Ana Planning Commission was called to order and conducted by Madam Chair Brown in the City Council Chambers, 22 Civic Center Plaza, Santa Ana, California. Roll call was answered by Commissioners Nalle, Oliver, Mondo, Doughty, Pedroza, Segura. CONDITIONAL USB PBRMIT NO. 96-11 (Vince Fregoso) Filed by Demetrios Georgantopouloa to allow after hour operations at Cozy Corner restaurant located at 426 North Harbor Boulevard in the Specific Plan 2 zoning district. LEGAL NOTICED: March 15, 1996 PUBLIC NOTICED: March 15, 1996 RECONNBNDATIONi Approve Conditional Uee Permit No. 96-11 as conditioned by staff and adopt the findings as submitted by staff. Mr. Vince Fregoso, Associate Planner, provided a brief overview of the applicant's request to allow after hour operations at the Cozy Corner restaurant. Mr. Fregoso indicated staff believed no negative impacts would result from the after hours operations and recommends approval of the request. Commissioner Oliver asked how long Cozy Corner restaurant had been in operation. Mr. Fregoso stated approximately 20 years. Commissioner Doughty asked how crime was rated in the area and what types of incidents occurred. Mr. Fregoso stated that the crime was rated low in the area and there had been two minor incidents. There had been no major incidents reported in the last year. Mr. Demetrios Georgantopouloa indicated that he was pleased with staff's recommendation. Commissioner Doughty moved to approve Conditional Uae Permit No. 96-11. The motion was eeconded by Commissioner Oliver. CONDITIONAL USB PERNIT NO. 96-10 (Larry Yenglin) Filed by Yum Yum Donut Shops, Inc. to allow after hour operations at an existing donut shop located at 320 East Seventeenth Street in the Community Commercial (C1) zoning district. LEGAL NOTICED: March 15, 1996 PUBLIC NOTICED: March 15, 1996 RBCONl~RDATION: Approve Conditional Uee Permit No. 96-10 as conditioned by staff and adopt the findings ae submitted by staff. Mr. Larry Yenglin, Associate Planner, provided a brief overview of the applicant's request to continue the after hour operations every day and indicated the donut shop is in an area considered above average in police- related incidents and staff did not anticipate any negative impacts due to the late night operations and recommends approval of the request. Commissioner Hondo asked what type of criminal incidents occurred. YIANPiINa COMMISSR)N MINOTPS 5 MARCH 25, 1996 t Mr. Mike McCoy, Police Department, indicated that there had been approximately 10 calla. Three were for disturbing the peace; one was related to a male having a gun; and the remaining calls were other incidents. CommiseionerOliver indicated that there was an alley south of the building that was very dark and asked what provisions would be made to improve the area. Mr. McCoy indicated that the conditional use permit was conditioned for the applicant to provide additional lighting in the area. Mr. Lincoln Wataee, Yum Yum Donuts, indicated that evening sales were very important to the business. In addition, he indicated that he recently learned of the police related activity. Commissioner Doughty asked if a security guard would be employed for the shop. Mr. Wataee indicated that he did not plan to hire a security guard. Commissioner Oliver asked what the company's policy was when dealing with loitering and other criminal activities and how many employees would be in the donut shop during the hours of 2:00 a.m. through 6:00 a.m. Mr. Wataee indicated that he would try to work with the people surrounding the store. However, if it was necessary he would get the police involved and there would be two employees during the early morning hours. Commissioner Doughty moved to approve Conditional Uae Permit No. 96-10. the motion was seconded by Commissioner Nalle.
