PLANNING COMMISSION

The Regular Meeting of the Santa Ana Planning Commission was called to order by
Chairman Mondo at 6:30 p.m. in the City Council Chambers, located at 22 Civic Center
Plaza, Room 147 Santa Ana, California. Other Commissioners present included:
Brown, Oliver, Doughty, Pedroza, and Segura. Also in attendance were Kenneth Adams,
Planning Manager; Richard Lay, Assistant City Attorney; Gary Sheatz, Deputy City
Attorney; Jeffry Rice, Senior Planner; Tom Childress, Associate Planner; Marta
Crane, Assistant Planner II; Chad Beckstrom , Planning Intern; Pam Lucado, Public
Works Agency; Mike McCoy, Police Department; Diana Lopez, student Representative
from Valley High School and Sharon McCain-Johnson, Recording Secretary.
A. Approval of the Minutes from the Regular Meeting of January S, 1996.
RECOMMENDATION:
Approve the Minutes of the Regular Meeting of January 8, 1996.
B. Reconsideration of actions taken at the previous meeting.
None.
0. VARIANCE NO. 95-9, CONDITIONAL USE PERMIT NO. 95-031, AND TENTATIVE PARCEL
MAP NO. 95-173 (Larry Yenglin)
Filed by DSL Service Company to allow a drive-through restaurant; a reduction
in landscaping and parking; an increase in signage; and exemption from
loading and trash requirements located at 3600 Weat McFadden Avenue in the
Specific Plan No. 2 zoning district.
RECOMMENDATIONS
Continue Variance No. 95-9, Conditional Use Permit No. 95-031, and Tentative
Parcel Map No. 95-173 to February 12, 1996.
Commissioner Brown moved to approve the Consent Calendar items. The motion
was seconded by Commissioner Segura.

ROLL CALL: The Regular Meeting of the Santa Ana Planning Commission was called to
order and conducted by Chairman Mondo in the City Council Chambers, 22 civic Center
Plaza, Santa Ana, California. Roll call was answered by Chairman Mondo and
Commissioners Brown, Oliver, Doughty, Pedroza, Segura and Diana Lopez, student
representative from Valley Bigh School. Also in attendance were: Kenneth Adams,
Planning Manager; Richard Lay, Assistant City Attorney; Gary Sheet z, Deputy City
Attorney; Jeffry Rice, Senior Planner; Tom Childress, Associate Planner; Pam Lucado,
Public Works Agency, Mike McCoy, Police Department; and Sharon McCain-Johnson,
Recording Secretary.
' PLEDGE OF ALLEGIANCE TO TAE FLAG: The Pledge of Allegiance was led by Troop 22 of
the Boy Scouts
PROCEDURAL RVLES: The procedural rules for the session were read by Chairman Mondo.
PUBLIC HEARINOS•
1. GENERAL PLAN AMENDMENT NO. 96-001 (Jeffry Rice)
Filed by Miller Construction Company to change the land use designation from
Medium Density Residential-15 dwelling unite per acre to General Business
District-0.5 on Fourth Street from French Street to Garfield Street.

RECOMMENDATIONi
1. Recommend that the City Council adopt a resolution approving General
Plan Amendment No. 96-001 to amend the Land Use Element of the General
Plan; and
2. Recommend that the City council approve Mitigated Negative Declaration
ER No. 95-118.
Mr. Jeffry Rice, Senior Planner, provided a brief overview of the applicant's
request to change the land use designation in order to construct a full
service grocery store. Mr. Rice indicated that a mitigated negative
' declaration had been prepared and mitigation measures would be implemented
during the construction of the project. The proposed grocery store meets all
other code requirements and staff recommends approval of the project.
Mr. Tim Miller, representing Northgate Market, thanked the Commission for
their support for the previous Northgate Market proposal.
Chairman Mondo informed Mr. Miller if he planned to sell alcoholic beverages
in the future that he should file a conditional use permit in addition to his
application at this time.
Mr. Miller indicated that the applicant did not intend to sell alcoholic
beverages.
Commissioner BYOwn moved to approve General Plan Amendment No. 96-001. The
motion was seconded by Commissioner Doughty.

2. CONDITIONAL USE PERMIT NO. 95-38 (Tom Childress)
Filed by Ma. Sor Kann Tang to allow after hour operations every day at an
established donut shop located at 2102 South Main Street, Suite A.

RECOMMENDATION:
' Approve Conditional Use Permit No. 95-38 as conditioned by staff and adopt
the findings as submitted by staff.
Mr. Tom Childress, Associate Planner, provided an overview of the staff
report and indicated that the applicant was requesting to operate a donut
shop 24 hours every day, seven days a week. Staff reviewed the application
and determined that the extended hours of operation would not create any
negative impacts and recommends approval of the request.
Commissioner Doughty asked if there had been any crime in the area.
Mr. Mike McCoy, indicated that there had been one disturbing the peace
reported in 1985; one petty theft report; and one other crime report made.

Commissioner Doughty asked if the applicant could sell more donuts during the
after hour operations.
Mr. Childress indicated that Ms. Tang would like to have the flexibility to
come in after hours to complete her work.
Commissioner Oliver asked if the project was conditioned for any building
upgrades.
Mr. Childress responded that only security upgrades were requested.
In addition, Mr. Childress informed the Commission that the applicant was
unable to attend the meeting.
Chairman Mondo asked if Ms. Tang had reviewed the conditions of approval.
Mr. Childress indicated that Ms. Tang had reviewed the staff report and
agreed with the conditions of approval.
Commissioner Doughty moved to approve Conditional Use Permit No. 95-38. The
motion was seconded by Commissioner Oliver.

Commissioner Oliver moved to approve the absence of Commissioner Na11e. The
motion was seconded by Commissioner Doughty.
