Approval of the Minutes from the Regular Meeting of September 8, 1997. RECOMMENDATION: Approve the Minutes of the Regular Meeting of September 8, 1997. B. Reconsideration of actions taken at the previous meeting. ' C. ZONING ORDINANCE AMENDMENT NO. 97-07 (Bill Apple) Filed by the City of Santa Ana to require a Land Use Certificate and adopt minimum design standards for exterior pay phones. LEGALLY NOTICED: September 7, 1997 RECOMMENDATION: Continue Zoning Ordinance Amendment No. 97-07 indefinitely. D. APPEAL OF THE PLANNING MANAGER'S DECISION NO. 97-04 Filed by RSCR California, Inc. to appeal the Planning Manager's decision not to permit an exist door from the front bedroom of a single family residence located at 2034 North Olive Street in the Single- Family Residential (Rl) zoning district. RECOMMENDATION: ' Deny Appeal of the Planning Manager's Decision No. 97-04. Ms. Melanie McCann, Assistant Planner II, provided an overview of the staff report and recommendation. In addition, Ms. McCann informed the Commission and the public that the use of the caze facility was not an issue, but the location of the exit door at the residential home was the only matter being considered. Mr. Michael Cutchshaw, applicant, provided the history of the care facility and provided an overview of why it was important to the applicant to have the exit door. The following persons spoke in favor of the applicant's request: Mark Antenucci Marsha Siegel Larry Crander The following persons spoke in favor of staffs recommendation: James Broeske Betty Moss Dick Freeman Jim Balay ' Terry Balay Hedy Hansen James Gartner The Commission stressed to the public members that the Planning Commission did not have the authority to deny the care facility use; the City could only impose conditions relating to the aesthetic character of the neighborhood. After further discussion, Mr. Adams informed the Commission that the League of California Cities would be looking at possible alternative legislation addressing care facilities. MOTION: Deny Appeal of the Planning Manager's Decision No. 97-04. Comments from the Executive Director. Ms. Uptegraff expressed her appreciation to the Commission members who participated in the City Council study session and informed them of the October 20, 1997 study session. I. Comments from the Planning Manager. There were no comments. J. Comments from the Planning Commission. Commissioner Verino asked if staff had conducted a site inspection for the Taqueria Zamerano restaurant per her request. Mr. Adams responded that he would have a staff member respond to her request. K. Recess. Due to the lack of agenda items, there was no recess taken. PLANMNG COMMISSION MINUTES 3 SEPTEMBER 22, 1997 COUNCIL CHAMBERS COUNCIL CHAMBERS ROLL CALL PLIDGE OF ALLEGIANCE TO THE FLAG PROCEDURAL RULES 1. GENERAL PLAN AMENDMENT N0.97-04 AND AMENDMENT APPLICATION N0.97-04 ' Filed by the City of Santa Ana to change the zoning designation from Single-Family Residential (Rl) to Open Space (O) and the General Plan designation from Low Density Residential at seven dwelling units per acre (LR-7) to Open Space (O) located at 2913, 2917, 2923, 2929, 2933, and 2937 North Fallbrook Drive. LEGALLY NOTICED: September 7, 1997 PUBLICLY NOTICID: September 10, 1997 RECOMMENDATION: 1. Recommend that the City Council adopt a resolution approving General Plan Amendment No. 97-04. 2. Recommend that the City Council adopt an ordinance approving Amendment Application No. 97-04. Mr. Marvin Ellenbecker, Associate Planner, presented the staff report and recommendation. Ms. Suzi Furjanic, Recreation and Community Services, provided a description of the plans for the site. She indicated that it would be a passive park to serve as a buffer between the neighborhood and the freeway.
