RECOMMENDATION:
Approve the Minutes of the Regular Meeting of August 25, 1997.

Filed by Mr. Manuel Gomez to allow a Type 41 Alcohol Beverage Control License for on-premise
consumption Dos Amigos restaurant located at 3701 West McFadden Avenue.
RECOMMENDATION:
Receive and file the staff report approving Conditional Use Permit No. 97-15 as conditioned.

C. CONDITIONAL USE PERMIT NO. 97-15

RECOMMENDATION:
Receive and file the staff report approving Conditional Use Permit No. 97-15 as conditioned.
Commissioner Mondo requested clarification regazding the conditions of approval related to amplified
music and audible music (C-9 and C-23).

Ms. Marta Crane, Assistant Planner II, informed the Commission that amplified music was not
allowed on the premises. However, if the applicant chose to provide taped music, the music could
not be audible beyond the area of control of the licensee.

' D. ORDINANCE AMENDMENT NO. 97-04
Filed by the City of Santa Ana to revise Chapter 30 of the Santa Ana Municipal Code regarding
historic structures and amend the Santa Ana Register of Historic Properties.
LEGALLY NOTICED: August 15, 1997
RECOMMENDATION:
1. Recommend that the City Council adopt an ordinance approving Ordinance Amendment No.
97-04.
2. Recommend that the City Council adopt a resolution amending the Santa Ana Register of
Historical Property.
Commissioner Hanna indicated that due to a conflict of interest, he would abstain from taking action
on the proposed ordinance.
Mr. Larry Yenglin, Associate Plammer, presented the staff report, recommendation, and proposed
ordinance.
Commissioner Mondo requested staff to review and modify specific sections (Sections 30-2 (f) (h)
and 30-7) of the proposed ordinance.
The Commission requested additional claziflcation regazding the demolition of historical structures
and unanimously stressed the need for modification to the language in the ordinance.

E. ZONING ORDINANCE AMENDMENT NO. 97-06
Alternative building standazds for artists live/work studios in existing commercial and industrial
structures.

RECOMMENDATION:
Recommend that the City Council adopt an ordinance approving Zoning Ordinance Amendment No.
97-06.
Mr. Thomas Childress, Associate Planner, presented the staff report and recommendation.
Commissioner Hanna indicated that due to a conflict of interest, he would abstain from taking action
on the proposed ordinance.
Ms. Susan Helper, Community Development Agency, provided an overview of the ordinance.

G. Comments from the Executive Director.
' Ms. Uptegraff reminded the Commissioners of the City Council study session regazding the General
Plan on September 15, 1997.
H. Comments from the Planning Manager.
There were no comments.
I. Comments from the Planning Commission.
Commissioner Verino informed staff that the Taqueria Zamerano restaurant had placed a trash bin
on the street and had made an outdoor eating azea. She requested the appropriate staff to conduct
a site inspection.
Commissioner Mondo informed the Commission that he would be resigning from his position as
Commissioner. He expressed his thanks to staff for their efforts and especially Kenneth Adams for
his assistance for the past seven years. In addition, Commissioner Mondo expressed his appreciation
to Councilman Richazdson for having given him the opportunity to serve as a Planning Commissioner
and to his family for their patience and support.
Commissioner Oliver expressed his regret for Commissioner Mondo's resignation and his
appreciation for serving on the Commission with Commissioner Mondo. He further stated that
Commissioner Mondo would be deeply missed.
' Commissioner Hanna expressed his regret to see Commissioner Mondo resign and stated that he
believed Commissioner Mondo would be irreplaceable.
Commissioner Doughty stated that she was proud to have served with Commissioner Mondo and that
he would be missed. She stated that Commissioner Mondo was always prepazed for all of the
meetings and was a leader amongst the Commissioners. In addition, Commissioner Doughty
informed staff that there were newly installed public telephones that were hanging over the sidewalks
on Westwood and Seventeenth Street and at 610-612 West Seventeenth Street.

Filed by the City of Santa Ana to revoke Conditional Use Permit No. 96-32 allowing a rock crushing
and material storage facility located at 4127 West MacArthur Boulevazd in the Light Industrial (Ml)
zoning district.

RECOMMENDATION:
Adopt a resolution revoking Conditional Use Permit No. 96-32.
Mr. Lazry Yenglin, Associate Planner, provided an update on the conditions of approval completed
by the applicant; the outstanding conditions of approval not yet completed; and staff s
recommendation.
Ms. Tamaz Stein, attorney representing the applicant, submitted pictures of the site and indicated
conditions completed by the applicant. In addition, she indicated that all of the landscaping had been
purchased and as soon as a pile of rocks were removed the remaining landscaping would be
completed. She also displayed pictures of the purchased trailer and stated as soon as all permits were
pulled, the ramp would be completed and the trailer would be fully installed.
Mr. Steven Maesk, referenced his letter and indicated that he was available for questions regazding
the asbestos issue.
The Commission requested staff to identify the outstanding conditions of approval.
Mr. Yenglin stated that the landscaping had not been completed, the Garry Avenue landscaping and
wrought iron fence installations had not begun, the surface drainage had not been completed per the
approved plan, permits for the trailer had not been issued, and there was no evidence that the wheel
washer had been installed.

The Commission once again asked the applicant when all conditions of approval would be completed.
Ms. Stein indicated that she believed all conditions would be completed in two weeks.
After further discussions between the Commission, applicant, and staff, Commissioner Doughty
moved to revoke the conditional use permit.
