MAY 12, 1997

The Regular Meeting of the Santa Ana Planning Commission was called to order by
Chairman Nalle at 5:10 p.m. in the City Council Chambers, Room 147, located at 22
Civic Center Plaza, Santa Ana, California. Other Commissioners present included:
Mondo, Oliver, Verino, and MacDowell. Commissioners Doughty and Hanna arrived at
5:20. Also in attendance were: Robyn Uptegraff, Executive Director; Kenneth Adams,
Planning Manager; Gary Sheatz, Deputy City Attorney; Charles View, Senior Planner;
Sergio Klotz, Associate Planner; Bill Apple, Assistant Planner II; Bob St. Paul,
Assistant Planner I; Joyce Amerson, Pam Lucado, Manuel Gomez, and Scott McCann,
Public Works Agency; Mike McCoy and Yolanda Pena, Police Department; and Sharon
McCain-Johnson, Recording Secretary.

RECOMMENDATION:
Approve the Minutes of the Regular Meeting of April 28, 1997.
Reconsideration of actions taken at the previous meeting.

VARIANCE NO. 97-06
(Charles View)
Filed by Alevey and Associates to grant relief from parking requirements in
order facilitate re-use of the existing Valley Center development located at
SO15 - 5127 West Edinger Avenue in the Community Commercial (C1) zoning
district.

Discussion of the I-5 Landscaoina.

Mr. Manuel Gomez, Transportation Analyst, presented slides and lead a
discussion regarding the 1-5 landscaping.
Capital Improvement Program for 1997-98.
RECOMMENDATION:
Approve Capital Improvement Program for 1997-98.

Mr. Manuel Gomez, Transportation Analyst, provided an overview of the
proposed Capital Improvement Program for 1997-98.
Several Commissioners felt too much funding had been allocated for traffic
studies and not street improvements. Concern was also expressed regarding
the lack of funding provided for park improvements. In addition,
Commissioner Na11e requested additional information regarding funding
sources.
Motion to Continue Capital Improvement Program for 1997-98.

F. Discussion of Alcoholic Beverage Control ordinance. (Charles View)
Mr. Charles View, Senior Planner, Bill Apple, Assistant Planner II, Yolanda
Pena and Mike McCoy, Police Department briefly discussed with the Commission
the City standards for alcoholic beverage control licenses.
The discussion was continued to May 27, 1997.

There were no comments.
I. Comments from the Planning Manager. (Kenneth Adams)
Mr. Adams informed the Commission that due to the length of the upcoming
Planning Commission agendas he would like to begin the next two meetings at
5:00 p.m.
The request was unanimously granted by the Commission.
J. Comments from the Planning Commission.
Commissioner Doughty requested the status regarding: 1) the PUB location on
Seventeenth Street; 2) 2828 North Bristol Street; and 3) the E1 Comal site on
Seventeenth Street.
Ms. Uptegraff indicated that there were ongoing disputes regarding the
property line at the PUS site; there had been no change in the status for
2828 North Bristol Street; and staff was continuing to work with the owner of
the E1 Coma1 restaurant.

Filed by the City of Santa Ana to rezone property generally bounded by Dorman
Street, Fairmont Street, and Lincoln Avenue from Two-Family Residences (R2)
' to Single-Family Residence (R1). Properties affected: 806, 810, 902, 906,
910, 914, 1002, 1006, 1010, 1014, and 1018 East Dorman Street; 1503, 1507,
1511, 1517, 1523, 1538, 1542, and 1546 North Fairmont Street; and 1520 and
1530 North Lincoln Avenue.

R1-B) zoning district.

Ma. Lynnette Perry, Assistant Planner II, provided an overview of the staff
report and recommendation.
The Commission discussed with staff the lack of parking at the site; off-site
parking; and landscaping.

Mr. Jim Biram, representing the applicant, displayed slides of other RESCO
medical facilities and exnressed his thanks to staff for their assistance-

Mr. Tim Rush, spoke in favor of the project and submitted an Agreement
between the neighborhood and RESCO properties for the medical facility,
The Commission expressed concerns regarding adequate parking, traffic
circulation, and enforcement problems with the proposed Agreement.
The following persons spoke in favor of the project:

The following persons spoke in opposition to the project:
Susan Morales, submitted a petition
The applicant further requested to submit a cash donation in lieu of
landscaping.
Motion to approve Variance No. 97-04 with the modified condition for the
applicant to provide a cash donation to the City.
MOTION: Doughty SECOND:
Motion failed.
After further discussion, the Commission unanimously agreed to continue
Variance No. 97-04 to June 9, 1997.

In addition, the Commission reiterated their concern regarding the Agreement
and lack of review of the Agreement, landscaping, lack of parking for the
facility, off-site parking, and traffic circulation.
The Commission recessed at 9:40 p.m. to 9:45 p.m.
4. CONDITIONAL USE PERMIT NO. 95-37 (Thomas Childress)
Filed by the City of Santa Ana to revoke Conditional Use Permit No. 95-37 for
Donut Depot located at 3119 South Main Street in the Light Industrial (M1)
zoning District.

RECOMMENDATION:
Adopt a resolution revoking Conditional Use Permit No. 95-37 and adopt the
findings as submitted by staff.
Mr. Tom Childress, Associate Planner, presented a brief overview of the
issues related to the revocation of the conditional use permit.
Mr. Mike McCoy, Police Department, indicated that the site is 10-15 percent
under the lighting code and that was an acceptable level to staff.
Ms. Young Chou, applicant, indicated that she would like additional
assistance from the City and she requested the Commission to not revoke the
conditional use permit.
Mr. Scott DeLong, Public Access Communications, Inc., indicated that due to
economics, the phone company was unable to relocate the public phone and he
informed the Commission that there was an existing lease for the public phone
until 2004.
Motion to continue Conditional Use Permit No. 95-37 to June 9, 1997.

Filed by Mr. John Killen and Mr. Raymund Villanueya to change from the
Commercial Residential (CR) zone to Community Commercial (C1) zoning district
located at 3305-3365 South Bristol and to allow construction of an In-N-Out
Burger restaurant located at 3361 South Bristol Street.

1. Recommend that the City Council adopt an ordinance approving Amendment
Application No. 97-02.
2. Approve Conditional Use Permit No. 97-11 as conditioned and adopt the
findings as submitted by staff.
Mr. Thomas Childress, Associate Planner, provided an overview of the staff
report and recommendation.
Commissioner MacDOwell expressed concern regarding the noise from the drive-
through speaker box intruding into the adjacent neighborhood.
Mr. Childress responded that the only residential property to the proposed
restaurant was located across Bristol Street and staff did not believe noise
from the establishment would become a problem or intrude into the
neighborhood.
Mr. John Killen, applicant, expressed his appreciation to staff and stated
that he had reviewed the staff report and agreed with the conditions of
approval.
