CALIFORNIA MINUTES OF THE REGULAR MEETING CITY OF SANTA ANA, CALIFORNIA PLANNING COMMISSION APRIL 28, 1997 The Regular Meeting of the Santa Ana Planning Commission was called to order by Commissioner Mondo at 5:10 p.m. in the City Council Chambers, Room 147, located at 22 Civic Center Plaza, Santa Ana, California. Other Commissioners present included: Doughty, Verino, and MacDowell. Commissioners Oliver and Hanna arrived at 5:20. Also in attendance were: Robyn Uptegraff, Executive Director; Kenneth Adams, Planning Manager; Gary Sheatz, Deputy City Attorney; Charles View, Senior Planner; Linda Hale, Senior Planner; Jeffry Rice, Senior Planner; Maya DeROSa, Environmental Coordinator; Thomas Childress, Associate Planner; Sergio Klotz, Associate Planner; Larry Yenglin, Associate Planner; Bill Apple, Assistant Planner II; Melanie McCann, Pam Lucado and Scott McCann, Public Works Agency; Mike McCoy and Yolanda Pena, Police Department; and Sharon McCain-Johnson, Recording Secretary. A. B. C Approval of the Minutes from the Regular Meeting of April 14, 1997. RECOMMENDATION: Approve the Minutes of the Regular Meeting of April 14, 1997. Reconsideration of actions taken at the previous meeting. None. CONDITIONAL USE PERMIT NO. 97-06 (Lynnette Perry) Filed by Mr. James A. Carter to allow a Type 41 Alcohol Beverage Control License for the Kanesho restaurant located at 1500 West MacArthur Boulevard in the Commercial Residential (CR) zoning district. RECOMMENDATION: Confirm the Zoning Administrator's decision approving Conditional Uae Permit No. 97-07 as conditioned and adopt the findings as submitted by staff. *** E N D OF C O N S E N T *** C D Commissioner Mondo removed item C from the Consent Calendar. Motion to approve remainder of Consent Calendar. MOTION: Verino SECOND: MacDowell AYES: Doughty, Mondo, Verino, and MacDOwe11 NOES: None ABSENT: Nalle, Oliver, and Hanna Commissioner Mondo asked staff if the applicant had reviewed and agreed with all of the conditions of approval. Staff indicated that the applicant had reviewed and agreed to the conditions. Mr. Adams requested the Commission to move item F, the discussion regarding alcoholic licenses, last on the agenda due to possible time constraints. Motion to approve Conditional Use Permit No. 97-07.. MOTION: Verino SECOND: MacDowell AYES: Doughty, Mondo, Verino, and MacDowell NOES: None ABSENT: Nalle, Oliver, and Hanna ZONING ORDINANCE AMENDMENT NO. 96-07 (Thomas Childress) Filed by the City of Santa Ana to revise the City's recycling regulations and revise recycling uses in the Light Industrial (M1) and Heavy Industrial (M2) zoning districts. (Continued by Planning Commission to April 14, 1997 to April 28, 1997) LEGAL NOTICED: January 29, 1997 PUBLIC NOTICED: January 27, 1997 RECOMMENDATION: Recommend that the City Council adopt an ordinance approving Zoning Ordinance Amendment No. 96-07. Mr. Tom Childress, Associate Planner, presented slides of recycling centers throughout the City and provided an overview of the staff report and recommendation. Commissioner MacDowell asked if any changes had occurred in the State law regarding convenience zones. Mr. Childress indicated that the State law had not changed. However, the state was allowina local aovernment to administer and mandate recvclina f] E. F G Mr. Childress indicated that the State law had not changed. However, the State was allowing local government to administer and mandate recycling centers. Commissioner Oliver asked how many centers would be affected by the proposed ordinance. Mr. Childress responded 23 centers. In addition, Ms. Uptegraff informed the Commission that there would be a one year time frame to allow operators to relocate. Commissioner Mondo asked if staff had considered operators to apply for a conditional use permit if the goal was to take the use out of the Commercial zone. Mr. Childress responded that staff believed requiring the operators to operate in the Industrial would be the moat appropriate district. Mr. Ron Switzer, Mobil Recycling Corporation, indicated that he had three locations in Santa Ana; the ordinance was of concern to him; and he had been a operator in Santa Ana for approximately 10 years and had not received any complaints on his sites. In addition Mr. Switzer indicated that moat Cities require conditional use permits to set us standards for recycling centers. Mr. Jesse Garcia, indicated that he had four sites in Santa Ana and indicated the ordinance was of concern. Motion to continue Zoning Ordinance Amendment No. 96-07 to May 27, 1997. MOTION: Hanna SECOND: Doughty AYES: Oliver, Doughty, Mondo, Verino, Hanna, and MacDOwell NOES: None ABSENT: Nalle Discussion of reaoniac corners of Grand Avenue and Fourteenth Street. (Sergio Klotz) Mr. Sergio Klotz, Associate Planner, lead a discussion and answer session with the Commission regarding staff's proposal to rezone properties located at 1234 East Fourteenth Street and 1302 East Fourteenth Street. After further discussion, it was unanimously agreed by the Commission to bring back the item as a public hearing in three to four months in order to determine if the rezoning would be an appropriate action depending upon development direction in the area. Discussion of the nrouoeed Home Place Shouoina Center. (Linda Hale) Ms. Linda Hale, Senior Planner, lead a brief discussion regarding the Home Place shopping center proposal; access to the site; and proposed signage for the site. CONDITIONAL USE PERNIT NO. 96-32 (Larry Yenglin) Filed by the City of Santa Ana to begin revocation proceedings for a recycling facility located at 4127 west MacArthur Boulevard. REC019~NDATION: Direct staff to begin revocation proceedings for Conditional Use Permit No. 96-32. Mr. Larry Yenglin, Associate Planner, provided a brief overview of the staff report and the chronology of events for the site. Mr. Bob Schultz indicated that the applicant had invested a great deal financially into the site and requested additional time to bring the site into compliance. In addition, Mr. Schultz indicated that the applicant had planned to relocate from the site in December 1997. Commissioner Mondo asked if any plane had been submitted for approval. Mr. Yenglin responded no plans had been submitted. In addition, Mr. Yenglin indicated that there had been 11 Planning Division conditions of approval and two Public Works Agency conditions for Conditional Use Permit No. 96-32, none of the conditions of approval for either agency had been completed. Motion to direct staff to begin revocation proceedings for Conational Use Permit No. 96-32. Maya DeROSa, Environmental Coordinator, provided an overview of the potential environmental impacts for the center.
