Johnson, Commission Secretary CONSENT CALENDAR A. Approval of the Minutes from the regular meeting of April 24, 2000 and May 8, 2000. RECOMMENDATION: Approve the minutes from the meeting of April 24, 2000 and May 8, 2000. B. CONDITIONAL USE PERMIT NO. 00-07 AND VARIANCE NO. 00-05 SECONDED: Nalle RECOMMENDATION: 1 Adopt a resolution approving Conditional Use Permit No. 00-07 and Variance No. 00-05 as conditioned. Presentation of the formal resolution by Mr. Kenneth Adams, Planning Manager Motion to adopt a resolution approving Conditional Use Permit No. 00-07 and Variance No. 00-05 as conditioned. Ms. Uptegraff apprised the Commission of an upcoming case to modify the conditions of approval for the Art Institute and discussed the issues related to the modifications. Marc Myers, Art Institute, commented regarding the proposed modification. Mr. Gary Sheatz, Assistant City Attorney, advised the Commission and the applicant that once the case was agendized and noticed it would more appropriate to discuss. E. Recessed. VARIANCE NO. 98-05 7:00 p.m. Filed by Mr. Phillip Martin to allow an amendment to the variance for the Huong Tich Temple in order to allow a reduction in the landscaping in the front and side yard setbacks located at 4821 West Fifth Street in the Single-Family (R1) zoning district. PUBLISHED IN THE REGISTER: April 28, 2000 PUBLICLY NOTICED: April 27, 2000 (Continued by the Planning Commission May 8, 2000 to May 22, 20001 RECOMMENDATION: Adopt a resolution denying the request to amend Variance No. 98-05. Ms. Lynnette Perry, Associate Planner, presented the staff report and provided an overview of the issues related to the amendment request. Chairman Mondo opened the public hearing. The following speakers provided comments in support of the amendment: Mr. Bhikkhu Sunnyata Sakya Mr. Philip Martin Kirk MacArthur Chairman Mondo closed the public hearing. The Commission requested clarification regarding the amendment request and discussed issues related to the approved landscaping, the present landscaping, and the acceptance of a good-faith bond. C Motion to deny the amendment to Variance No. post a good-faith bond far 58,000 during landscaping per the approved p/an. MOTION: Doughty 98-05 and direct the applicant to the process of constructing the SECONDED: Richardson Substitute motion to deny the amendment to Variance No. 98-05; direct staff to prepare a resolution approving the requested landscape setback on Rosita Street and the requested landscape setback on the west property line; direct the applicant to post agood-faith bond in the amount of 58,000 and staff issue a 120 day temporary certificate of occupancy a//owing the applicant to modify the landscaping to match the approved plans. 3 MOTION: Doughty SECONDED: Richardson AYES: Mondo, Nalle, Solorio, Doughty, Verino, Cribb, and Richardson NOES: None ABSENT: None ABSTENTION: None 2. Public Comments (for items not on the agenda). There were no public comments. 3. Comments from the Executive Director. There were no comments. 4. Comments from the Planning Manager and staff. There were no comments. 5. Comments from the Assistant City Attorney. There were no comments. 6. Comments from the Planning Commission. Commissioner Richardson commented that asingle-family residence located at the northwest corner of Sycamore and Wilshire had approximately four to five ice cream trucks parked with electrical extension cords and the extension cords were attached ' from the trucks to the home and requested staff investigate; and he reported illegal signage located at 2140 South Main Street, #A. Commissioner Cribb reported that he had been contacted from two public members that reported to him racial two tiered pricing at La Rioja market and requested staff investigate; reported that weed maintenance was necessary at 2400 North Bush, Bristol, and LaVeta, near the 5-Freeway; commented that the Edgewood off-ramp signal was still a serious safety concern to him and suggested a full signal; and reported traffic gridlock on Main Street at Seventeenth Street. Ms. Joyce Amerson, Public Works stated that staff would investigate. Commissioner Solorio expressed that he was sorry to hear that Ms. Robyn Uptegraff was terminating her employment with the City and commended and praised her work efforts and service for the past several years. Commissioner Verino reported that she had been contacted by a resident reporting a serious insect problem in nearby trees located at 1300 North Olive and requested staff investigate area. 7.
