C. DEVELOPMENT AGREEMENT NO.00-O1 (89-02)
Filed by Mr. Tom Grabiel, for Bentall Property Management, to request an extension of an existing
Development Agreement with Bentall Development for 10 years.

RECOMMENDATION:

D. ZONING ORDINANCE AMENDMENT NO.00-O1
Filed by the City of Santa Ana to modify various sections of Chapter 41 of the Santa Ana Municipal Code
to establish regulations for fence construction and front yard fence design standards in residential zones
citywide.

RECOMMENDATION:
Continue Zoning Ordinance Amendment No. 00-01 and April 10, 2000.
E. RESOLUTION NO.00-OS
Confirm Resolution No. 00-05 denying Variance No. OOAl to allow relief from code requirements for
signage at a proposed Home Depot located at 1750 East Edinger Avenue.
RECOMMENDATION:
Confirm Resolution No. 00-OS denying Variance No. 00-01.

STUDY SESSION
G. Overview of the proposed fence ordinance (Zoning Ordinance Amendment No. 00-01)
Ms. Marta Crane, Associate Planner, provided an overview of the proposed fence ordinance and led a
question and answer session with the Commission.
Commissioner Mondo commented that he would like staff to re-consider fee for a fence minor exception.
Commissioner Solorio commented that he would like staff to ensure that all property owners be notified of
the fence ordinance.
Commissioner Verino commented that she would like staff to ensure that the language in the ordinance can
be easily read and understood.
Commissioner Cribb commented that he would like for cinder block to be considered, however, if it is not a
permitted material that the requests be reviewed by the Zoning Administrator.
H. Comments from the Executive Director.
Ms. Robyn Uptegraff, Executive Director, indicated that: 1) the City Council remanded an amendment to
Chapter 41 concerning commercial vehicles in residential zones to the Planning Commission; 2) Home
Depot appealed the Planning Commission decision to deny the variance for relief from signage; 3) a new
tenant for the Crazy Horse would be applying for a conditional use permit; and 4) Opera Pacific was
interested in an Industrial building, located at Warner and Gamsey for musical productions, assembly use,
and rehearsals, the request would require discretionary actions in the future.
I. Comments from Planning staff.
M. Joseph Edwards, Principal Planner, informed the Commission that the Housing Element had been
completed, however, an issue existed with the REHNA numbers. He further apprised the Commission that
the City of Santa Ana was one of the cities that appealed the decision due to not agreeing with the
allocation of low-income housing units the City was directed to provide.
J. Comments form the Citv Attorney.
There were no comments.
K. Comments from the Plannine Commission.
Commissioner Cribb indicated that he would like future discussions regarding incorporating contemporary
architecture into additions to existing homes; and encouraging design quality in housing projects.
Commissioner Solorio required an update on the Open Space/Youth Element timing for completion. Mr.
Adams informed the Commission that both Elements will be combined, the Open Space portion of the
Element is completed, however, the Youth Element is being developed by the Recreation and Community
Services Agency, he further commented that the Agency had been actively involved with development of
' the Youth Commission for the past several months.
Commissioner Doughty requested a tour of the Space Saver School, at Bristol Mazket Place, for the
Planning Commission.
Commissioner Mondo commented that the recreational equipment at Lilly King Pazk was in disrepair and
when it became dilapidated, was removed rather than replaced. Ms. Uptegraff responded that the budget
for the pazks and recreational areas is minimal and she explained that Clev Williams, Executive Director of
the Pazks, Recreation & Community Services had recently made a budget presentation and the funds for the
repair and maintenance of the facilities was minimal, however, he was working towards ensuring that
maintenance was a high priority with the swimming pool for the summer months being operational at the
top of the list.

1. APPEAL OF THE ZONING ADMINISTRATOR'S DECISION NO. 00-01 Conditional Use Permit
No. 99-24
Filed by Mr. Michael Cho to allow an upgrade in the Alcohol Beverage Control License (Type 21) in
order to sell beer, wine, and distilled spirits for off-premise consumption at the R Ranch Market located
at 2521 West McFadden Avenue.

RECOMMENDATION:
1. Receive and file the Categorical Exemption for Environmental Review No. 99-10.
2. Adopt a resolution denying Appeal of the Zoning Administrator's Decision No. 00-O1.
Mr. Vince Fregoso, Associate Planner, presented the staff report and recottunendation
' Mr. Adams also informed the Commission that he, as the City's Zoning Administrator, was prepared to
approve the request, contingent upon the application agreeing to comply with current code standards and
all conditions of approval.
Mr. Michael Cho, representing the applicant, indicated that the application was requesting an upgrade to
an existing alcoholic license. He further stated that the owner was reluctant to remove the water vending
machines and that there was a contractual agreement between the owner and the phone company due to a
possible lawsuit. In addition, he commented that there were many other businesses that had vending
machines and public telephones in the City that had not been removed, such as the Northgate Market.
Several Commissioners asked Mr. Cho if the property owner would be willing to relocate the vending
machines and the pay phones to the interior of the building.
Mr. Michael Shalabi, property owner, informed the Commission that he had been in business at the
location since 1982, that since he began his operations he had spent a great deal of funds cleaning and
maintaining the site. He further commented that relocating the machines to the interior of the building
was not feasible.
Commissioner Mondo requested staff to verify code compliance for all Northgate Market locations in the
City. He stated that he did not object to the request for the upgrade in the alcoholic license, however, he
would not consider approval with all of the code violations. In addition, he asked staff and the applicant
if they believe a continuance on the matter would be appropriate.
Mr. Michael Cho further commented that if the alcoholic license was not an issue, the applicant would
ldce to entertain a conditional approval to allow the property owner to comply with the conditions and if
in 12 months the applicant was not in compliance, the appropriate actions be taken.
Mr. Adams explained to the applicant that it was no the practice of the City to conditionally approve
applications. He further apprised the Commission that several Zoning Administrator hearings had been
continued to allow the applicant additional time to consider whether or not he wanted to comply with the
conditions of approval or receive a denial of the request.
After further discussions, the Commission granted a 15 minute recess to allow the applicant and his
representative to discuss the matter further

No. 99-24) for 90 days (June 12, 2000) in order to allow the applicant meet with contractual vendors.
