Approval of the Minutes from the regular meeting of February 28, 2000. RECOMMENDATION: Approve the minutes from the regular meeting of February 28, 2000. ' B. APPEAL OF THE PLANNING MANAGER'S DECISION NO.00-02 Filed by Mr. Carl Marx to appeal the Planning Manager's Decision to deny an addition of a master bedroom and bath to an existing single-family residence located at 1107 South Van Ness Avenue in the Single-Family (Rl) zoning district. (Continued by the Planning Commission February 28, 2000 to March 13, 2000) RECOMMENDATION: 1. Receive and file the Categorical Exemption for Environmental Review No. 00-30. 2. Adopt a resolution denying Appeal of the Planning Manager's Decision No. 00-02. Mr. Bob SL Paul presented the staff report and analysis, which supported a recommendation of denial of the Planning Manager's appeal. Commissioners Verino, Solorio, and Mondo raised a number of questions regarding design proposals. The applicants, Mr. and Mrs. Cazl Mazx re-affirmed their case for support of the original design. After further discussion, Commissioner Verino moved to deny Appeal of the Planning Manager's Decision No. 00-02. MOTION: Verino SECONDED: Mondo No vote took place. Commissioner Solorio made a substitute motion. Motion to approve Appeal of the Planning Manager's Decision No. 00-01 with the condition that a disclosure covenant be developed and recorded against the property. APPEAL OF THE PLANNING MANAGER'S DECISION NO.00-03 Filed by Mr. Jason Escoto to appeal the Planning Manager's residence considered to be conducive to creating a second unit located at 1114 Decision to deny a request for an interior improvement to an existing single- family North Freeman Street in the Single-Family (Rl) zoning district. (Continued by the Planning Commission February 28, 2000 to March 13, 2000) RECOMMENDATION: 1. Receive and File the Categorical Exemption for Environmental Review No. 00-31. 2. Adopt a resolution denying Appeal of the Planning Manager's Decision No. 00-03. Commissioner Verino stated that she would abstain from the action due to the proximity of the project to her residence. Mr. Bob St. Paul presented the staff report and analysis, which supported a recommendation of denial of the Planning Manager's appeal. Commissioners Solorio and Cribb raised a number of questions regarding designed proposals. Ms. Escoto, the applicant spoke in support of the original design. Cost and design considerations were the underlying reasons the applicant requested that the Commission support her appeal. Policy Direction for Current Code Implementation regarding additions to single-family residences. RECOMMENDATION: Affirm current code provisions and implementing policies. Mr. Joseph Edwards, Principal Planner, presented an overview of the zoning code and implementation policies regarding evaluation of room additions to single-family residences. Commissioner Cribb commented on the need to stimulate reinvestment in the City's neighborhoods and Commissioner Cribb commented on the need to stimulate reinvestment in the City's neighborhoods and expressed that the current practices leaned towazd discouraging such activity. Commissioner Solorio expressed that the current policy was acceptable, although, he indicated that there was a need for staff to be more flexible in its administration. Commissioner Mondo indicated that he was a strong advocate of maintaining current practices. He supported reviewing the appeal fee to allow the applicants easier access to the Planning Commission for final policy determinations. Motion to affirm current code provisions and implementing policies with reduced appeal fees. ZONING ORDINANCE AMENDMENT N0.99-09 Filed by the City of Santa Ana to amend the Central Business (C3) and the Central Business-Artists Village (C3-A) districts to prohibit drive-through establishments. VARIANCE NO.00-01 Filed by the Home Depot USA to allow relief from code requirements for signage located at 1750 East Edinger Avenue in the Light Industrial (Ml) zoning district. Adopt a resolution approving Sections 41-862(c) 3, 41-863(a), and 41-862(6) 2, of Vaziance No. 00-O1 ' as conditioned and denying Section 41-863(c) of Variance No. 00-O1. Commissioner Mondo acknowledged that the public heazing had been conducted at the previous meeting and asked if there were additional comments from staff. Mr. Jeffry Rice, Principal Planner, indicated that no circumstances concerning the request had changed. Mr. Scott Sobeck, Home Depot Construction Manager, spoke regarding the issues surrounding the existing Home Depot site located at Harbor and MacArthur Boulevards. He indicated that it was his perception that those issues raised by the Commission, at the previous meetings, including the illegal signage had been addressed. Mr. Milton Solomon, representing the Sign Company, reiterated his statements that the rationale for the variance was due to the fact that the Center mandated a different sign treatment program than that which would be permitted under the City's current zoning standards. Commissioners Mondo, Solorio, and Verino provided several comments relative to the maintenance and sign conditions at the existing Home Depot Center and expressed concern that the lack of attention to the Commission's concern at that site may manifest themselves at the Home Depot Edinger site. Discussion focused upon a strong concern that the same maintenance issues may be repeated at the proposed project site. Motion to adopt a resolution denying Variance No. 00-O1. ' Commissioner Solorio expressed discomfort in supporting all of the components of the variance. Commissioner Verino requested comparison to the sign variance granted to the Riverview West shopping center. Commissioner Mondo expressed a lack of confidence in Home Depot's ability to maintain a maintenance program commensurate with the City's expectations. CONDITIONAL USE PERMIT NO. 99-29 AND APPEAL OF THE PLANNING MANAGER'S Filed by Ms. Barbara Saito, Nextel Communication, Inc. to allow an increase in height of an existing monopole and to appeal the Planning Manager's decision regarding site improvements located at 1234 South Main Street in the General Commercial (C1) zoning district. (Action only necessary if Planning Commission approves the conditional use permit) Ms. Lynnette Perry, Associate Planner, provided a summary of the activities and discussions that occurred during the two week continuance period. She indicated that the applicant had modified her request regarding the tree planting requirement, however, did not wish to address any of the additional on-site requirements. Mr. Tim Kendricks, Wilshire Square Neighborhood Association, spoke in against the application request based on the fact that no serious negotiations occurred between the applicant and the neighborhood group. Mr. John White, Merchant's Association, stated that the Association had a neutral position but expressed concern regarding the potential environmental impacts of a proliferation of 60 foot telecommunication poles along the South Main corridor. ' Ms. Bazbara Saito, representing the applicant, reaffirmed her request for support to the project as part of the evolution of the telecommunication industry. She offered to provide two new palm trees comparable with the sizes accepted by the City at other monopalm sites. Several of the Commissioners raised questions regarding the maintenance of the site, specifically, weeds and debris that appeared on several of the photographs. Motion to adopt a resolution denying Conditional Use Permit No. 99-29. Approve and certify the Negative Declazation for Environmental Review No. 98-49. 2. Adopt a resolution approving Conditional Use Permit No. 00-O1. Mr. Vince Fregoso, Associate Planner, provided an overview regarding the resolution that had been requested at the previous Planning Commission meeting. He indicated the pazking had been adjusted to provide additional landscaping on the arterials; the landscape pallet had been enhanced; and the pazking plan had been revised to provide sufficient parking even during peak hour activity for the proposed uses at the site. Mc Art Bannick, Bally Total Fitness, spoke in support of staff s recommendation and re-affirmed that there was a possibility that Balley's would request a sign vaziance for the Bristol Street side of its building. Mr. James Carter, applicant, re-affirmed his support of staff s position and committed to upgrading the Center to be competitive in the South Coast Metro market. Motion to recommend that the City Council: I) approve and certify the Negative Declaration for Environmental Review No. 98-49; 2) adopt an ordinance approving Amendment Application No. 00-O1; and 3) adopt a resolution approving Variance No. 00-02. ' Chairman Mondo requested that the landscape plan on South Bristol be included in this year's Cagital Improvement Program Budget for the fiscal yeaz 2000-2001. He also requested that the Commercial Code Enforcement pro-actively investigate the signs associated with the Metro Town Square. Commissioner Verino requested an update on the introduction of vending machines in the City's public parks. She further commented that in many cases, the vending machines were obvious eyesores and in several cases did not contain any products. 6. Oral Communications -Comments from the Public. (For matters not listed on the Agenda). There were no oral comments. Excuse of absences. Commissioner Cribb moved to excuse the absence of Commissioner Nalle, Doughty, and Richardson.
