RENEWAL OF DEVELOPMENT AGREEMENT N0.89-02 ' Filed by Mr. Tom Grabiel for Bentall Property Management to request an extension of an existing Development Agreement with Bentall Development for 10 years. Motion to approve the January I0, 2000 and January 24, 2000 minutes with modifications as noted and the remainder of the Consent Calendar items.. Establishment of Plannin¢ Commission Obiectives for 2000. RECOMMENDATION: Commission Policy. Mr. Kenneth Adams discussed with the Commission the Planning Commission and staffs objectives and ongoing Division projects for the current yeaz and the upcoming. ZONING ORDINANCE AMENDMENT N0.99-10 AND AMENDMENT APPLICATION N0.99-08 Filed by the City of Santa Ana to amend the zoning ordinance and various zoning designations to establish a new zoning district known as the Commercial-South Main (C-SM) zoning district. Recommend that the City Council approve and certify the Negative Declaration for Environmental Review No. 168. 2. Mr. Barry Kahn, indicated that he was a property owner in the proposed rezoning area, referenced a copy of a map, and questioned whether or not his property would be a split zone pazcel and expressed concern with the rezoning. Mr. Edwards responded that the entire parcel would be rezoned South Main Commercial District. Motion to recommend: 1) that the City Council approve and certify the Negative Declaration for Environmental review No. 99-168; 2) adopt an ordinance approving Zoning Ordinance Amendment No. ' 99-10; and 3) adopt an ordinance approving Amendment Application No. 99-08 with amendments to Section 411-521 (b) -deleting medical uses and Section 41-530 amending the article number. VARIANCE NO. 00-01 Filed by the Home Depot USA to allow relief from code requirements for signage located at 1750 East Edinger Avenue in the Light Industrial (M1) zoning district. PUBLISHED IN THE REGISTER: February 4, 2000 PUBLICLY NOTICED: Febntary 3, 2000 RECOMMENDATION: 1. Receive and file the Categorical Exemption for Environmental Review No. 99-172. 2 . Adopt a resolution approving Sections 41-862(c) 3, 41-863(a), and 41-862(b) 2, of Variance No. 00- 01 as conditioned and denying Section 41-863(c) of Vaziance No. 00-O1. Mr. Bill Apple, Associate Planner, presented the staff report and recommendation. Cormissioner Nalle stated that he would abstain from the hearing due to a conflict of interest. Mr. Milton Solomon expressed his appreciation to staff and displayed a rendering representing the applicant's proposal and requested that the Cotmission reconsider the applicants proposed sign. Cottunissioner Mondo referenced the existing Home Depot located on MacArthur and Harbor and expressed his displeasure with the continuing current code violations at the site and asked if a Home Depot representative was present. In response, Mr. Solomon stated that there was no representative from Home Depot, however he was the representative related to the sign request. After further discussion, Commissioner Mondo stated that he would like to continue the item in order to allow a representative from Home Depot attend the meeting to address Commission concerns. ABANDONMENT N0.99-08 Filed by Burke Development to abandon a portion Vance Street, west of Poinsettia and east of the alley between Civic Center Drive and Wellington to incorporate into the industrial development. Mr. Taig Higgins, Public Works Agency, provided an overview of the staff report and recommendation. There were no public comments. Motion to recommend that the City Council adopt a resolution approving Abandotunent No. 99-08. Commissioner Richardson requested staff verify the code compliance regarding signage located at Eighteenth and Bush Street. Commissioner Cribb requested staff verify code compliance with signage at the Ralph Allen building. SECONDED: Nalle Commissioner Solorio indicated that he had not received a report regarding the Main Ranch and inquired as to the status; asked staff to verify if the signage at Rite Aid on Main and First Street was approved as constructed; and requested staff verify that all the lights were operating correctly at Delhi Park. Mr. Adams stated that the project was in a 30 day Alcohol Beverage Control review and once it was completed and approved the present owner would cease operations at the market and he would have staff verify Rite Aid and the lighting at Del Hi Pazk. Commissioner Mondo commented that he would like to encourage the Police Department and the new Cade Enforcement officers to coordinate and work together with enforcement issues. He indicated that there had been a series of outdoor sales on Bristol Street, and as an example, stated that while the Police Depaztment did not cite the illegal operations, the Department could inform Code Enforcement for follow up. 6.
