CONDITIONAL USE PERMIT N0.99-25 (Bill Apple) Filed by Ms. Margarita N. Valente to allow a Type 41 Alcohol Beverage Control License in order to sell beer and wine for on-premise consumption at the Taqueria Guerro restaurant located at 938 South Harbor Boulevard in the Specific Plan 2 zoning district. RECOMMENDATION: Receive and file the staff report approving Conditional Use Permit No. 99-25. ZONING ORDINANCE AMENDMENT NO. 99-09 (Sergio Klotz) Filed by the City of Santa Ana to amend the Central Business (C3) and the Central Business-Artists Village (C3-A) districts to prohibit drive-through establishments. PUBLISHED IN THE REGISTER: December 16, 1999 RECOMMENDATION: Continue Zoning Ordinance Amendment No. 99-09 to February 14, 2000. Commissioner Mondo inquired as to the removal of several conditions, by the Zoning Administrator, approval for the Conditional Use Permit. Mr. Adams responded that staff would be pursuing code enforcement with the owner of the property, regarding the satellite and public pay phone, rather than the applicant of the conditional use permits. Motion to receive and fde the staff report approving Conditional Use Permit No. 99-25 as conditioned. MOTION: Nalle SECONDED: Doughty AYES: Mondo, Nalle, Doughty, Solorio, and Cribb OPPOSED: None ABSENT: Verino and Richardson ABSTAINED: None G. Discussion of Pedestrian Safety. Corporal Mattke, Police Department and George Alvazez, Public Works Agency, discussed pedestrian traffic and safety in the City. The discussion highlighted the Police Department's efforts to increase and focus on traffic enforcement, the ongoing efforts with the school district, the education of the public regarding pedestrian traffic and safety, and the relationship with other Agencies citywide. In addition, Mr. Alvarez provided information regarding the State grant funds, the possibility of reducing speed limits and providing additional signals when necessary to increase safety, and the ongoing speed surveys conducted to increase pedestrian safety citywide. Commissioner Solorio requested staff investigate as to whether the City could receive all revenue from the traffic citations and utilize the funds in pedestrian safety and street improvements. Commissioner Cribb expressed concern regarding some of the locations of school in the City and requested staff work with the school district to assist in the planning of school sites. Commissioner Mondo stated that there had been negative articles in the local nespaper regarding pedestrian safety and asked if the press had been informed of the City efforts. Corporal Mattke informed the Commission that the identical information and presentation had been given to the press; however, the press had not displayed the positive efforts in the recent articles. H. Discussion of Capital Improvement Program. Ms. Joyce Amerson, Public Works Agency, provided a brief overview of the proposed Capital Improvement Program for 2000. Commissioner Solorio expressed concern regarding the program not addressing or providing maintenance to the azeas in the City where the homes are routinely flooded when rain occurred. Commissioner Verino expressed concern regarding the dilapidated condition of Raitt Street and cottunented that there are tnany old areas in the City that were in need of repair and commented that streets were usually only repaired when major developments occurred. After further discussion, Commissioner Mondo requested a list of all unfunded projects for the meeting in April 2000 when the Capital Improvement Program would be brought to the Commission for action. I. Discussion of the fence ordinance. Ms. Marta Crane, Associate Planner displayed a power point presentation of fences citywide and provided an overview of the upcoming proposed fence ordinance. Several Commissioners expressed concern regarding the fence ordinance and stated that many property owners may have spent an enormous amount of money on their fences, however, according to the proposed ordinance, their fences may not meet the proposed code amendment. 3 ., _-_~.___,...,._,,,r,..,a,..a,.,,o~.a,~ ~rat'f nrnvide information regazdine: 1) whether or not staff would propose to Commissioner Mondo requested staff provide information regazding: 1) whether or not staff would propose to amortize or sunset the existing fences to meet the code; 2) how enforcement and prosecution would be handled; and 3) he recommended a funding mechanism be crafted as an incentive for code compliance. In addition, he expressed that there was a need for the information to be relayed to the public before any action was taken on the proposed ordinance and commented that there may be a need for making a distinction between arterial and residential fencing. Commissioner Doughty expressed concern with property owners who have spent a great deal financially on their fences and the City informing them that their fence was not in compliance with standards. ' Commissioner Cribb expressed that he was opposed to chain link fencing at residential sites. Commissioner Solorio expressed that he would like to ensure fairness citywide; and asked when the Del Hi Park issue would be reviewed by City Council; and commented that he had recently read an article in the local paper regarding shopping cart retrieval and the estimated costs of retrieving the carts and asked if the estimated figure of $100,000 was accurate. Ms. Uptegraff responded that she did not have the exact figure, however, the program was costly. Commissioner Verino stated that she believed a program needed to be in place, and the ordinance would only work if the City demonstrated a good faith effort; and she offered to assist with the work efforts if needed. Comments from the Executive Director. Ms. Uptegraff informed the Commission that: 1) the Police Department along with coordination with Code Enforcement would be taking a modification to Chapter 41, without Planning Commission review, to City Council regazding prohibiting any commercial trucks as large or larger than 3.25 tons not being allowed to park in residential neighborhoods; and 2) staff had met with Ryland Homes regarding a potential site at Memory Lane and Flower for some high quality single-family units. K. Comments from the Plaanina Manager and staff. Mr. Kenneth Adams, Planning Manager, informed the Commission that due to the recent inquiries regazding the school sites in the City, that he would be having a discussion with the Commission to address concerns that ' the Commission would like to discuss with Mr. Mike Vail and that staff would invite Mr. Vail to a future meeting to discuss the school issues directly with the Commission. Mr. Vince Fregoso, Associate Planner, presented an overview of the phase one clinic. He further informed the Commission that no consideration was given to phase two and if the applicant chose to do construction for phase two it would be brought before the Commission for discretionary approval. In addition, Mr. ' Fregoso highlighted staffs recommendation for modifications to Planning Division conditions of approvals numbers two and three. There were no public comments. Motion to: I) Approve and certify the Negative Declaration for Environmental Review No. 99-148; and 2) Adopt a resolution approving Conditional Use Permit No. 99-27 as condetioned. ZONING ORDINANCE AMENDMENT NO. 99-10 AND AMENDMENT APPLICATION NO. 99-08 Filed by the City of Santa Ana to amend the zoning ordinance and various zoning designations to establish a new zoning district known as the Commercial-South Main (C-SM) along South Main Street. PUBLISHED IN TIIE REGISTER: December 17, 1999 PUBLICLY NOTICED: January 14, 2000 RECOMMENDATION: 1. Recottunend that the Ciry Council approve and certify the Negative Declaration for Environmental Review No. 168. 2. Recommend that the City Council adopt an ordinance approving Amendment Application No. 99-08. 3. Recommend that the City Council adopt an ordinance approving Zoning Ordinance Amendment No. 99-10. Mr. Joseph Edwards, Principal Planner, presented the staff report, displayed areas on South Main Street that were being considered for the rezoning, and staff recommendation. ' Ms. Vicki Uehli, Community Development Agency, discussed and described with the Commission the recently approved rebate program for business owners who chose to perform property improvements to the sites. Corrunissioner Doughty asked if the rebate program encouraged interior improvements and handicap access. Ms. Uehli responded that the rebate program was created for facade improvements only. Commissioner Mondo asked how off-site parking would be addressed; and indicated that he believed it would be appropriate for small scale signs such a newmetic signs when businesses change and he noted a discrepancy in the staff report and ordittance related to medical clinics. Mr. Edwards stated that the applicant would need to prove that there was adequate parking at their sites; it was staff s intention to allow clinics; and he would explore the language concerning the signs. Commissioner Solorio commented that he did not support plastic internally illuminated awning signs on Main Street and he requested staff further consider whether or not health clinics should be a permitted use in the area. The following public members spoke m favor of the proposed rezoning but requested information regazding increased parking demands due to the potential of new businesses, allowed uses in the new zone, and potential impacts to taxes. In addition, it was requested that additional enforcement be given for pedestrian traffic and possibly reducing the speed limit in the area: Otto Bade Barry Kahn Louis Cazdenas Motion recommending that the Ciry Council: 1) approve and certify the Negative Declazation for Environmental review No. 99-168; 2) adopt an ordinance approving Zoning Ordinance Amendment No. 99- 10; and 3) adopt an ordinance approving Amendment Application No. 99-08. Commissioner Solorio commented that he was willing to support the motion, however, he would like to get clarification regazding the uses and that he would like to consider clinics as an allowed use in the rezoning. In addition, he expressed concern regazding the property owners receiving additional information regarding the permitted uses in the proposed rezoned area and allowing awning signs in the proposed rezoning. After further discussion, the Commission unanimously agreed to continued action on the request and directed staff to ensure that additional notification is presented to the property owners regarding permitted uses. The motion by Commissioner Doughty and the seconded by Commissioner Cribb were rescinded. Commissioner Cribb requested staff to schedule a discussion regarding the implementation of a cafe district and complimented Commissioner Verino's efforts as Chair for the past year. Commissioner Solorio expressed concern regarding the illuminated signs at RiteAid and if staff could verify whether or not the illumination was approved or a canvas type awning and requested staff provide information to the Commission regazding upcoming topics in order the Commission tie to preview the items. Commissioner Doughty expressed her appreciation to Ms. Joyce Amerson for providing information regarding the removal of shopping cazts. ' Commissioner Mondo: 1) expressed concern regarding the amount of funds spend on the removal of the shopping cazds and asked if the Ciry could consider another mechanism to abandon them; 2) commented that a number of requests had been made previously to staff regarding, such as, the South Main azea ,South Bristol, Logan azea, Artist Village, Grand Avenue District, Main Place, Polygon, Hutton Center, MacArthur Place, and Museum District areas as well as the design and development standards, he further requested that staff provide a report as to the status of the projects so the Commission can prioritize the work efforts on the projects at an upcoming meeting; and 3) asked for a list of all school sites in order to consider planning future school sites. 5. Oral Communications -Comments from the Public. (For matters not listed on the Agenda). There were no oral comments. 6. Excuse of absences.
