C. Discussion of Specific Development for Pacific Center.
Mr. Bill Apple, Associate Planner, provided an update on the status of the PacifiCenter and informed the
Commission that the item would be before them at the next scheduled meeting.
D. Discussion of the status of the upcoming projects.
Mr. Jeffry Rice, provided an update of projects in the City.
E. Comments from the Executive Director.
' Ms. Uptegraff informed the Commission the City Council: 1) approved the Paragon home project; 2)
denied the Church use on south Flower; 3) approved the Mater Dei project, however, the applicant informed
staff that they would like to modify the development agreement, and if so, it would require an additional
review by the City Council once again; and 4) continued the appeal for the historical application for the
Blind Children's Learning Center.

G. Comments from the Planning Commission.
Cotmissioner Solorio informed staff that he had received several complaints and safety concerns regazding
the new medians on Main Street by Edinger Avenue and requested staff investigate.
Commissioner Mondo requested to be kept apprised of the 18,000 squaze foot retail center at Vons on
Bristol Street.
Commissioner Richazdson expressed his thanks regazding the Gonzales Mazket on Fifth Street; commented
that Ross Street had been closed for a lengthy time and requested staff review re-opening the street for
public access as soon as possible.

Mr. Vince Fregoso, Senior Planner, presented the staff report for the three locations and staff
recommendation.
Commissioner Mondo asked if there was going to be any secondary signage and if the vaziance request was
identical to the previously approved Variance No. 95-08.
Mr. Fregoso responded that there would be limited signage at the site, however, he was not sure whether it
was the identical request.

and stated the request was identical to the previous request. In addition, he stated that the sign was not

Mr. Robert Fiscus, requested approval of the request and stated that there was an error on the staff report
and stated the request was identical to the previous request. In addition, he stated that the sign was not
lazger, only the base was one foot lazger than the previous request; and the applicant would be willing to
reduce any other signage on the site.
The following members of the public spoke in favor of staff's recommendation and expressed concern with
the lack of landscaping specifically on the north Grand Avenue Chevron station:

' Commissioner Mondo expressed to the applicant that he would not support the request, however, he would
consider supporting a smaller sign request, identical to the previously approved variance, only if the
applicant agreed to limit signage on the site.
Commissioners Nalle and Solorio expressed concerns regarding the illegal signage at the site and requested
that the Code Enforcement Division continue to follow up on enforcement activities at the location.
Motion to continue Variance No. 99-05, Variance No. 99-06, and Variance No. 99-07 to June 28, 1999.

at Jasco Chemical Corporation located at 1008 North Fuller Street in the Heavy Industrial (M2) zoning
district.

Mr. Fregoso indicated that he had received one inquiry from an adjacent neighbor inquiring as to zoning issues
only and all of the property owners within 300 feet of the project were notified.
Mr. Angel Cordoza, applicant, indicated that he was supportive of staffs recommendation and explained to the
Commission that the company was reducing the amount of chemical storage and making a safer environment
at the location.
The following members of the public spoke in favor of the project and emphasized that the Jasco Oi] Company
was a very reputable company:

The following public members spoke in opposition to the request and expressed concern regarding: the
chemical company operating in the residential neighborhood, that there had been leaks in the past at the site,
possible future chemical leaks, and health concerns with the chemical operations:

Commissioner Nalle explained to the concerned citizens that the company was reducing the amount of
chemical storage at the facility and that the reduction of chemical storage would increase safety in the area. In
addition, he recommended that staff and the chemical company meet with the local residents to provide
additional information regarding the uses and practices at the site.
Motion to continue Conditional Use Permit No. 99-09 to June 18, 1999 to allow staff, the applicant, and the
local neighborhood to address issues of concern and provide additional information regarding the
operations of Jasco Chemical company.

Commissioner Solorio requested staff to investigate previous chemical leakage from the company, at the site,
with the Fire Department prior to the next meeting.
6. ZONING ORDINANCE AMENDMENT N0.99-OS
Filed by Morgan Corporation to amend the Heninger Park regulations to allow group homes in project areas I
and II and to require conditional use permits with a 750 foot separation between group homes in Specific
Development 40 zoning district.

Mr. Vince Fregoso, Senior Planner, presented the staff reports for Zoning Ordinance Amendment No. 99-
05, Conditional Use Permit No. 99-11, and Conditional Use Permit No. 99-14 and staff recommendations.
He informed the Commission that the zoning ordinance amendment was necessary to allow group homes in
the azea and the request for conditional use permits were necessary for the specific group home requests.
Mr. David Silva, representing R. Morgan, provided an overview of the operations of the group homes,
descriptions of the group homes, and described the individuals that would be utilizing the homes.
Mr. Efrain Olivares, Architect, provided an overview of the structure.

Commissioner Mondo stated that he would like the conditions of approval to define developmentally
disabled, per the State definition, to ensure that there is no confusion in the future and in case the facility
had to be re-used by another applicant.
Ms. Carol Berg, Community Development Agency, indicated that staff was developing a Disposition and
Development Agreement indicating that the property would be used only for same use, by another applicant;
that the document would be fully prepared once funding sources were confirmed.
Ms. Ginelle Hazdy, local resident, requested that she be allowed to review the landscaping plan for the
project, especially Birch Street.
Motion to recommend that the City Cauncil approve Zoning Ordinance Amendment No. 99-OS and that
the City Council approve and certify the Mitigated Negative Declaration for Environmental Review No.
99-66.

Mr. Jeffry Rice, Principal Planner, presented the staff report, provided an overview of the proposed project,
and staff recommendation.
Mr. James Ray, representing the applicant, spoke in favor of the project.
Commissioner Mondo asked Mr. Ray if he had reviewed the conditions of approval, specifically numbers 15
and 16, and if the applicant concurred with the conditions.
' The Real Estate Manager, representing the applicant, indicated that he understood the conditions of approval
and he had no objections. In addition, he stated that he would like a temporazy banner when the facility
opened. Mr. Adams stated that the applicant needed to apply for the temporazy banner and receive proper
approval.
Commissioner Mondo asked Mr. Ray if the applicant was planning to applying for an alcohol beverage
control license, in the future, for the mini market.
Mr. Ray stated that the applicant had no intention of applying for an alcohol license.
Motion to adopt resolutions approving: 1) Tentative Parcel Map No. 97-156 with the deletion of condition
numbers 6 and 10 related to recording apop-out dedication and evidence of the covenant and agreement;
and 2) Conditional Use Permit No. 99-12 with the modification to the conditions of approval, deleting
number five related to recording parcel map prior to permits, modifying condition number 14, to require 36
inch box trees and the additional condition indicating that no alcoholic sales at the mini mazket; and 3)
Approve and certify the Mitigated Negative Declaration for Environmental Review No. 98-110.
