Approval of the Minutes from the meeting of April 26, 1999. RECOMMENDATION: Approve the minutes from the meeting of Apri126, 1999. B. Reconsideration of actions taken at previous meeting. C. TENTATIVE PARCEL MAP NO. 98-232 AND ZONING ORDINANCE AMENDMENT NO. 99-03 Filed by Mr. Mark Seferian to allow the subdivision of a 31.69 acres into nine pazcels and create new signage requirements within MacArthur Place located at I First American Way in the Specific Development 43 zoning district. Discussion of menu boards and olaylands at fast food restaurants. Mr. Vince Fregoso, Senior Planner, lead a discussion with the Planning Commission regazding the menu boards and playlands at fast food restaurants and requested direction from the Commission regazding whether or not there was a consensus for code modifications. The Commission unanimously agfeed not to modify currenk code requirements, E. Comments from the Executive Director. There were no comments. Pleming Cortunission Minutes 1 May 10, 1999 F. Commissioner Cribb expressed concern regarding street entrances to certain neighborhoods having additional landscaping, specifically Right Street and Fairhaven Avenue. Ms. Joyce Amerson, Public Works stated that the City had a masterplan for certain areas in the operations budget and she would check the azea specified. ' Commissioner Cribb informed staff that there was an abundance of exterior signage located at Seventeenth and Main Streets. Commissioner Richazdson requested staff to investigate the backside of a loading ramp located at Fourth and French Streets were per code. Commissioner Richardson commended staff for the re-painting of the lights on Main Street to Warner and to Seventeenth Street. Commissioner Mondo stated that the shopping carts were blocking the sidewalk azea at Von's center at South Bristol Street and requested that staff verify code violations. I. Recess. VARIANCE NO. 99-01 Filed by Mr. Rusty Heaps to allow a reduction in parking and landscaping for the Church of Jesus Christ located at 2012 South Flower Street in the Community Commercial (C1) zoning district. Receive and file the Categorical Exemption for Environmental Review No. 99-14. Mr. Vince Fregoso, Associate Planner, presented the staff report and recommendation. Mr. Rusty Heaps, Pastor of Church of Jesus Christ, described church uses, stated that the church had a small congregation; he had not received any complaints; and the church had been displaced due to the McFadden Avenue realignment. In addition, Mr. Heaps stated that he had sought a location for approximately two years and the south Flower location was the most feasible due to the cost. Mr. John and Ms. Donnelle O'Neill, local restaurant, spoke in opposition to the project and stated that they lived in close proximity to the existing churches and expressed noise and pazking problems due to the number of churches at the location. Motion to: 1) adopt a resolution denying Vaziance No. 99-O1; and 2) receive and file the Categorical Exemption for Environmental Review No. 99-14. AND SPECIFIC DEVELOPMENT 68. AND TENTATIVE TRACT MAP NO. 15805 Filed by Pazagon Homes to change the zoning from Arterial Commercial (CS) to Limited Multiple-Family Residential-Specific Development 68, and to subdivide five acres into 20 pazcels in order to develop 40 paired single-family units located at 2700 West Alton Avenue in the Arterial Commercial (CS) Zoning district. Recommend that the City Council approve and certify the Negative Declaration for Environmental Review No. 99-01. Mr. Jeffry Rice, Principal Planner presented the staff report and recommendation. Mr. Richazd Cisakowski, representating Pazagon Homes, described the proposed paired homes. Commissioner Cribb and Solorio noted that the rendering illustrated additional landscaping that that was required in the specific development and Commissioner Solorio requested the rationale behind the homes being a gated community. Mr. Richard Cisakowski, stated the market demand was for gated communities and he was not prepazed to negotiate regazding the additional landscaping on the applicant's behalf. However, he emphasized to the Commission that most homeowners were willing to personalize and provide additional front yazd landscaping than what was proposed by the applicant. Commissioner Richazdson inquired regazding the railroad spur line on the adjacent school district property. In addition, he expressed concern over what measures had been taken to ensure that it would not have heavy usage in the future and requested staff to pursue the abandonment of the line with the railroad and merger with the district property. Motion to: 1) recommend that the City Council adopt an ordinance approving Amendment Application No. 99-03; 2) recommend that the City Council adopt an ordinance approving Specific Development 68 with the modification for the applicant to provide two 24 inch box canopy trees on each lot; 3) recommend that the City Council adopt a resdution approving Tentative Tract Map No. 15805 as conditioned; and 4) recommend that the City Council approve and certify the Negative Declaration for Environmental Review No. 99-OZ. APPEAL OF THE ZONING ADMINISTRATOR'S ACTION NO. 99-01 AND CONDITI NAL USE PERMIT NO. 99-02 Filed by Mc Wannis Loy Abajian to appeal the Zoning Administrator's action not to allow a Type 20 Alcohol Beverage Control License in order to sell beer and wine for off-premise consumption located at 2801 South Bristol Street in the General Commercial (C2) zoning district. (Set for public hearing by the Zoning Administrator) LEGALLY NOTICID: April 30, 1999 PUBLICLY NOTICED: May 4, 1999 RECOMMENDATION: Adopt a resolution denying Conditional Use Permit No. 99-02. 2.. Receive and file the Categorical Exemption for Environmental Review No. 98-146. Ms. Lynnette Perry, Associate Planner, presented the staff report and recommendation. Mr. Fred Pardes, Attorney representing the application, emphasized to the Commission that the mazket was primazily a food mazket with ancillary liquor sales and that less than two percent of the floor space would be for alcohol sales. In addition, he informed the Commission that the applicant was in escrow for purchasing a Type 21 alcohol license from Lucky's and the applicant was willing to downgrade the license; and he referenced a petition that was submitted to the Zoning Administrator in support of the alcohol license. Commissioner Mondo referred to the Mazch 31, 1999 Zoning Administrator heazing and asked if the applicant planned to upgrade to a Type 21 license after two yeazs and that it was stated at the heazing that the market would not be able tq remain open iP the license was not kranted which indicated a si~nificanc® to the liquor sales at the location. Matthew Ainley, Department of Alcohol Beverage Control, clarified the alcohol beverage control process regarding conditioning a Type 21 license to prohibit liquor sales. In addition, he apprised the Commission that if the applicant bought and obtained the Lucky's liquor license, Lucky's could re-apply for the alcoholic license and obtain another license within 90 days of surrendering the license. Commissioner Doughty moved to excuse the absences of Commissioners Verino and Nalle. Commissioner Cribb seconded the motion and the motion unanimously passed. 6. Adjournment.
