RECOMMENDATION:
Approve minutes of the regular meeting of October 7, 2004.
Commission Secretary Report
RECOMMENDATION:
' Instruct the Commission Secretary to enter into the minutes that pursuant to the
Brown Act and the Maddy Act, the October 7, 2004 Agenda for the Regular
Meeting was posted on the door of the City Hall Council Chambers at 22 Civic
Center Plaza on October 1, 2004 at 8:32 a.m.
C. HISTORIC PROPERTY PRESERVATION AGREE,VIENT NO. 2004-07
Filed by the City of Santa Ana to execute an agreement with Sheryl L. Harvey for
the structure located at 1820 North Bush Street.

Recommend that the City Council direct the City Attorney to prepare and
authorize the City Manager and Clerk of the Council to execute an agreement

Birch Street as Key on the Santa Ana Register of Historical Properties.

G. FUTURE POLICY FOR LISTING PROPERTIES ON THE HISTORICAL
REGISTER (Paul Giles)
Commission discussion ensued regarding potential reasons that property owners
have for opposing placement on the Santa Ana Register of Historical Properties,
valid reasons for not designating a property and forms of protection that are
currently available for properties that are eligible, but not placed on the register.
It was noted that some owners do not substantiate the reasons for opposing
designation. Deputy City Attorney Otto noted that Chapter 30 of the Santa Ana
Municipal Code (SAMC) does offer reasons whereby a property may be de-
listed. Should a property meet any of these criteria at the onset, it would be
proper to reconsider placement regardless if the property is a potential
Landmark, Key, or Contributive designation. A property is either eligible for local
designation or it is not. Currently, properties that are eligible, but not designated,
are provided a level of review for architectural consistency through the
implementation of Citywide Design Guidelines; while listed properties are
protected through the use of the Secretary of the Interior Standards.
Commission noted that overlay districts could offer protection to eligible
properties.
Discussion ensued regarding the selection of properties for placement on the
register. Deputy City Attorney Otto stated that Chapter 30 does not offer
guidance regarding the survey process, but does have eligibility standards and
criteria. The Commission has the responsibility to make the findings required to
show eligibility of an individual property. Further, Chapter 30 does not currently
offer guidance for properties that may be eligible for listing, but are not listed. An
amendment to Chapter 30 would be required should the Commission wish to
make findings as to why a property is eligible but not listed in order to bring it
' back for consideration at a later date. Commission noted that efforts to list
eligible properties with unwilling owners could be agendized pending further
review of the neighborhoods.
Staff conducted a survey of other city's processes for placement and how listed
versus eligible properties not listed are treated. Approximately ten cities were
surveyed. Only one surveyed city utilized the Secretary of the Interior's
Standards for properties not designated (either individually or listed as
contributive to a district). However, this city did not interpret the Standards as
strictly as Santa Ana does. Additionally, staff noted that only west coast cities
were surveyed since east coast cities' historic resources are often of national
significance and are often much older.
Chairman Giles summarized the discussion:
• Commission is interested in listing all eligible properties.
• Commission will consider not listing properties when presented with a
valid reason from the applicant.
• Promote historic preservation through outreach and expand first contact
information packet to include a marketing piece similar to one being used
in the current Historical Resources brochure.

Commissioner Schaefer
Inquired as to when West Floral Park will be surveyed. Staff indicated
West Floral Park is scheduled for first week in December followed by Jack
Fisher Park.
Commissioner Kings
In the context of the policy discussion regarding listing of historical
properties, Commissioner Kings encouraged Commissioners to be
ambassadors in their neighborhoods to welcome new residents.
Commissioner Corpin
Commented on the policy of the new design guidelines and training for
new Commissioners.
Commissioner Chinn
Reported that the Heritage Coalition of Southern California met at the old
Courthouse on October 28, 2004. Thanked Santa Ana Preservation
Society for opening the Howe-Waffle House.
Noted he did a presentation regarding the One Broadway referendum
process during the Orange County walking tour of the City.
• Requested an update on the Loan Program. Staff indicated that Wayne
Curl at 1225 N. French Street processed his application and hired a
contractor. Staff also noted other applications are underway.
Noted that home tour programs denote those homes that participate in the
Mills Act and that this promotes placement on the register.
Requested copy of One Broadway Plaza Cultural Resource Mitigation
Measures.
• Requested information regarding North Broadway Corridor Design
Standards from last year.
Requested review of potential grant funding under Proposition 40 Grants
for Historic Preservation.
Commissioner Bustamante
Commented on the importance of this Commission and thanked them
as he prepares for his newly elected assignment on the City Council.
Commissioner Gartner
Congratulated Carlos Bustamante on his recent election to the City
Council.
• Appreciated being on the Ad Hoc Design Guidelines Committee.
Chairman Giles
• Suggested insertion of the home tour program with the application and
to note the neighborhood contact.
Requested the report from Ad Hoc Committee. Planning Manager
recommended an additional Ad Hoc Committee meeting to finalize the
Commission's comments.
Noted attendance for meeting in December 2, 2004, Commissioners
Giles, Gartner, Chinn and Lutz will not be attending.
' Requested investigation for code violations of the house on Pine Street
east of Main Street on south side of street, on register as Rectory of
Episcopal Church.
