Approval of Minutes RECOMMENDATION: u Approve the minutes from the regular meeting of February 5, 2004. B. Commission Secretary Report RECOMMENDATION: 4:34 P.M. Instruct the Commission Secretary to enter into the minutes that pursuant to the Brown Act and the Maddy Act, the February 5, 2004 Agenda for the Regular Meeting was posted on the door of the City Hall Council Chambers at 22 Civic Center Plaza on January 28, 2004 at 11:28 a.m. C. RECONSIDERATION OF HISTORIC RESOURCES COMMISSION APPLICATION NO. (Continued by the Historic Resources Commission December 4, 2003 to January 8, 2004; January 8, 2004 fo February 5, 2004; Februarys, 2004 to March 4, 2004.) (Melanie McCann) By direction of the City Council the Historic Resources Commission shall reconsider the placement and categorization of the structure located at 1310 North Louise Street (Miller House). RECOMMENDATION: ~I 1) Adopt a resolution denying Historic Resources Commission Application No. 2003-42 2) Adopt a resolution denying Historic Register Categorization No. 2003-45 Motion to: Approve the Consent Calendar items as presented. COMMISSIONER COMMUNICATION DISCLOSURE (REGARDING AGENDIZED PROJECTS) Commissioner O'Callaghan abstained on Item 2 because of conflict of interest. ' Commissioner Schaefer abstained on Item 3, property at 2421 North Oakmont because of conflict of interest. E. HISTORIC PROPERTY PRESERVATION AGREEMENT NO. 2003-09 (Lynnette Perry) Filed by the City of Santa Ana to execute an agreement with Hryniewicki Family Trust for the structure located at 2010 North Victoria Drive. RECOMMENDATION: Recommend that the City Council direct the City Attorney to prepare and authorize the City Manager and Clerk of the Council to execute an agreement with Hryniewicki Family Trust for the structure located at 2010 North Victoria Drive. Lynnette Perry, Associate Planner presented staff report and recommendation. Commissioner's comments: Commissioner Chinn inquired about costs incurred for title report. Staff indicated there are preliminary costs involved. Commissioner Lutz inquired about the garage door that does not appear historical to the property. Staff indicated requirement is to maintain the character of the home. Motion to: Recommend that the City Council approve the Historic Property Preservation Agreement No. 2003-09. HISTORIC RESOURCES COMMISSION PRIORITIES (Paul Giles) 1. Evaluation of current register listing process 2. Options for discussion: a. Voluntary listing and revisions to Chapter 30 b. Continuance of action c. Overlay district creation versus listing individually Maya De Rosa, Senior Planner highlighted the current process for listing on the local register. Options for consideration were shared with the Commissioners. Commissioner Kings would like to pursue option to have city move forward on landmark and key designations and allowing voluntary consideration for contributive properties. Chairman Giles indicated Commission would pursue "consent based" path. Mr. Giles recommended the item be continued to next month for further discussion. Commissioner O'Callaghan stated that before Commission could change policy, review the overlay district, then set up guidelines for the Commission to review. Commissioner Chinn appreciated staff efforts in researghing the cities, and providing concise information about property rights issue. Commissioner Kings sees neighborhood standards as primary focus. She noted the State recognized Santa Ana's preservation efforts and used Santa Ana Template as the model to follow. ' Commission agreed to continue item to April 1, 2004. PROCEDURAL RULES PUBLIC HEARINGS HISTORIC RESOURCES COMMISSION APPLICATION NO. 2003-67 AND HISTORIC REGISTER CATEGORIZATION NO.2003-69 (Lynnette Perry) (Continued by fhe Historic Resources Commission on January 8, 2004 to March 4, 2004) Filed by the City of Santa Ana to place and categorize the structure at 1210 South Main Street (Elliott & Martin Furniture Store) as Contributive on the Santa Ana Register of Historical Properties. RECOMMENDATION: 1. Adopt a resolution approving Historic Resources Commission Application No. 2003-67. 2. Adopt a resolution approving Historic Register Categorization No. 2003-69. Lynnette Perry, Associate Planner presented staff report and recommendation. ' Commissioners' comments: Chair opened the public hearing. The owner, Karen Milner requested that property be removed from designation. Discussion ensued with owners concerns for future plans for building and lot. Karen Milner noted concern about the interior regulations noted in the Secretary of Interior Standards. She would consider along-term continuance as a compromise. Ms. Milner contends that she will not change the property Commissioner Gartner reiterated the benefits of designation and commented that the fagade is classic architecture. The Planning Manager noted that the historic designation affects the exterior of the building only. Commissioner Schaefer commented that the Historic designation adds value to the property. Commissioner Giles reviewed exterior modifications restrictions and noted changes should be compatible with architecture of the building. Commissioner Kings commented on the attractiveness of the building and the South Main area. Would like to have owner review signage requirements and allow for continuance for the owner. Deputy City Attorney Otto noted that the interior guidelines in the Secretary of Interior Standards are intended for federal tax credits. Commissioner O'Callaghan would like applicant to reconsider listing on the register. Commissioner's comments: ' Commissioner Kings inquired if repairs on the roof were reviewed by staff and permits pulled. Staff indicated permits were in compliance. Chairman Giles opened the public hearing. The owner, Vincent Sarmiento is going forward with roof repairs, restoring property to its original state and is supportive of the categorization listing. Commissioner Lutz inquired if zoning changed; owner indicated the property is zoned as Professional. Commissioner Chinn congratulated the owner for his decision. Commissioners' comments: None noted Chairman Giles opened the public hearing. Mary West Brown (321 E. Santa Clara) declined designation. Teresa Gorman Martinez (501 E. 20~' St. and 507 W. 20th St.) declined the designation on both properties. Ruben Martinez, co-owner also declined the designation on both properties. Ronald Richardson (2335 N. Oakmont) thanked the Commission for inclusion on the register. John E. Stevens Jr. (521 E. Santa Clara) requested clarification on asbestos shingle restriction. Expressed his appreciation for the Commissions' efforts on historic preservation of the properties. Also requested information on the state historic code requirements; staff will follow up. Chairman Giles closed public hearing Commissioner Gartner wants to approve all properties and allow applicants to appeal with city council. Commissioner Schaefer commented that owners are being handed a protection for their home, there appears to be a misunderstanding with restrictions among the homeowners. Commissioner Giles commented that there are desires for property owners and the public to protect homes for future generations. Staff Comments Maya De Rosa announced the meeting of the Historic Ad Hoc Awards Committee scheduled for March 25 to review the awards program. 0 6. Historic Resources Commission Comments Commissioner Kings • Thanked staff for the Certified Local Government Report. • Would like to extend notice time to two months instead of one month to allow applicants more time to review policy in more detail. • Would like to reinforce need for further discussion to review categorization policy. Commissioner Corpin • Asked for the date of the City Council meeting regarding One Broadway project; response was March 15 at City Council Chambers. Commissioner Chinn • Requested update on loan program. Staff stated a memo of the draft program was given to the Commission. Staff indicated program is available for public participation. Staff indicated one application (1225 N. French Park) is moving forward and will follow up. • Reaf estate issue, property on Broadway, next to Seventh Day Adventist Church is up for sale. Church would like to buy property and convert it to a parking lot. Commissioner Bustamante • Thanked the staff for all their work. ' Vice Chairman Schaefer • Thanked the staff for their work. • Inquired if possible to extend notices to applicants who do not understand the categorization program. Planning Manager noted staff efforts to provide ample notice and information to property owners. Commissioner O'Callaghan • Commented that if applicant has done research and wants to decline listing, Commission should respect owner's right to decline listing on the historical register. Proceeds benefit Centennial Heritage Museum. Commissioner Gartner • Wants to provide enough education to the people and honor their request, wants to avoid inconsistency with Commission decisions. Chairman Giles • Thanked the staff for the Contact Log to the Templates. • Announced salvage effort at 6th & Lacy. • Noted that 709 North Garfield is moving into French Park at the corner of Vance/Lacy. • Stated interest in reviewing design standards. 7.
