B. HISTORIC REHABILITATION LOAN PROGRAM UPDATE
Continued item until March 7, 2002 meeting.
D. REVIEW OF ANNUAL OBJECTIVES
' Charles View, Planning Manager, presented an update of the objectives; the
Commission will discuss them next month.
Commissioner Giles requested that property owners be notified via both certified and
regular mail. After discussion, Charles View said Planning would do both.
Commissioners Chinn and Giles requested an update on plaques/awards. They were
advised that the budget for cultural information phases 1 (Downtown) and 2 (French
Park) had been funded. The Ad Hoc Committee will discuss the proposed text and
report back to the Commission. Another area for next year will be identified.
Madam Chair Kings noted some of the wording from Objective 12 regarding the Plaque
Program was missing, and Mr. View stated it would be inserted.
Commissioner Richardson, in reference to Objective 15, asked to explore how historical
buildings would be addressed in the aftermath of an earthquake and noted that
guidelines are available.
Madam Chair Kings agreed with Commissioner Richardson and added a future goal is
training building inspectors on policy with regard to historic buildings and demolitions.
The Commission should add these to their discussion of future goals.
' E. IDENTIFICATION OF HISTORICALLY SENSITIVE {AREAS
Madame Chair Kings noted that the Commission is currently limited in their preservation
efforts to those structures/properties on the historical list. Many areas are not on the list,
as they were not considered threatened. Future areas to focus on and potential
historical districts need to be addressed. Boundaries and guidelines need to be
established for those areas.
Discussion followed. It was noted that unless a property is located within an SD,
Planning Counter staff could only encourage applicants to maintain the historical
features of the structure. h9ills Act benefits and requirements for historical designation
were discussed.

Discussion held regarding the Ur6~n Design Element. Madam Chair Kings noted CLG
status requires development of a preservation element or standards for the General Plan
and requested an overlay map of n~i~hbo~hood districts for next month.
Mr. View advised that as one of the Commission's objectives, Lcgan and Delhi are being
surveyed this year. The Commission will need to identify two areas to survey next year.

HISTORIC RESOURCE DEMOLITION N0.2001-01, 2001- 02 AND 2001-03
Filed by fhe City of Santa Ana to discuss the notice of intent to demolish
three structures located at 1007-1009, 1015, and 1109 North Broadway and
listed on the Santa Ana Register of Historic Properties as part of the One
Broadway Plaza high-rise office project.

RECOMMENDATION:

Receive public commenf and discuss the demolition of the historical
structures located of 1007-1009, 1015, and 1109 North Broadway.
Charles View, Planning Manager, provided a brief update and advised the Commission
that the Environmental Impact Review's (EIR) anticipated release date is February 22.
Today the Commission is receiving comments on the request to demolish the historical
structures. The Planning Commission will hold a hearing and be receiving comments on
the draft EIR; a full document will be provided for those who want a copy.
No written communications have been received.
Madam Chair Kings had received correspondence from the following:
• Santa Ana Historical Preservation Society stating they consider demolition of the
buildings only as a last resort but do not have the resources to acquire or
relocate the structures.
• Heninger Park opposing the demolition and that relocation should only be
considered as a last resort. They have two lots that could be possible relocation
sites and would work with the City. Both the Heninger Park and Santa Ana
Historical Preservation Society letters asked for Caribou to provide funds to
relocate and move the structures.
• Discovery Museum stating they would consider accepting the Koenig House as a
last resort.
• French Park opposing the demolition and expressed the hope that Caribou would
help pay for mitigation costs. They offered their assistance with relocation
efforts.
Madam Chair Kings opened the public hearing.
Elizabeth Palmer, Santa Ana resident, spoke of the importance of historical preservation,
maintaining downtown Santa Ana, and asked that we do everything possible to preserve
the buildings.

Henk Huetink, Santa Ana resident, spoke in opposition of demolition and the concept of
building ahigh-rise in downtown Santa Ana.
Jo Ann Ramirez, Santa Ana Historical Preservation Society, stated the January 3, 2002
minutes did not reflect her comments and read a prepared statement from the Santa
Ana Historical Preservation Society. She asked that the Commission "hold over the
public comments forum" until the EIR is out.
Roberta Reed, Santa Ana resident, had expected her entire comments from the
January 3, 2002 meeting to be reflected in the minutes. She read a letter she wrote to
the Commission and requested that it be a part of the public record. She expressed
concern regarding the demolition permit and that the project may not appropriately follow
the CEQA process.
Discussion followed about the City's policy of only taking action minutes at all Board
meetings. Madam Chair Kings asked the City Attorney if there is another format to
include detailed comments. Kylee Odette, Deputy City Attorney, stated she would
discuss the policy regarding minutes with the City Clerk. Mr. View stated that written
comments would be placed in the demolition request file and would not be reflected in
the minutes.
Ben Grabiel, Santa Ana resident, asked the Commission to reject the request to
demolish these buildings and for another site to be found that would fit Mr. Harrah's
requirements.
Madam Chair Kings closed the public comments.
In response to Commission comments, Mr. View stated staff is not taking individual
comments but capturing the spirit of the comments and the concerns are clear to staff.
Encouraged the Commission to pass. on to the Planning Commission and City Council
all mitigation measures they favor.
' Commissioner Giles asked for a review of the demolition process.
Mr. View explained Santa Ana Municipal Code (SAMC) Section 30-7 and stated that at
the end of the process, the property owner is entitled to demolish the property. In this
case as there is a project in place, the City Council has. more leverage of mitigation as
these structures are tied to a project but that the applicant is legally entitled to demolish
the buildings and will be allowed to do so. If the EIR states there are unavoidable
adverse impacts with the project, City Council could still approve the project (with their
findings and statement of overriding consideration) stating the positive impacts outweigh
the negative impacts.
Madam Chair Kings asked for staff to research the feasibility of Cabrillo Park Tennis
Center as a relocation site, and noted that at the last meeting she asked staff to look at
the feasibility of doing a third structural report on the Yale Apartments.
Charles View spoke with the Building Official regarding the demolition permit that has
been issued. There is nothing at this point to reconsider. Mr. View will ask the Building
Official to prepare a response in writing at Madam Chair Kings's request.
Motion to continue the public hearing to March 7, 2002.

It was the consensus of the Commission that they would like to generate a document
listing their recommendations and forward it to City Council before the public hearing.
They wish to formulate a response that would summarize possible mitigation measures,
and include comments and feelings of their constituents. They would need at least two
meetings, and possibly have to call a special meeting.

Mr. View stated staff would work them, making sure they. had time to read the document
and if necessary call a special meeting.
2. HISTORIC REGISTER N0.2001-02
Filed on behalf of Albert Scott to request that fhe Historic Resources
Commission affirm or rescind the decision to place fhe structure located at
1320 North Broadway on the Santa Ana Register of Historic Property.

Jim Scott, one of the owners, stated a letter he had written was in the Commissioners'
packets. He had a fundamental belief that for this Commission and for properties like
this to be protected a partnership was needed with the owner. They were never involved
or notified and are asking for due process so they can go forward. They do not want this
designation or restrictions, controls, and red tape. In November 2000 family members
spoke with Councilman Lutz about the process to undesignate the property. They have
followed what staff asked and now ask to remove the house from the Register.
Madam Chair Kings asked regarding red tape, if there were specific items.
Mr. Scott said they discovered the designation when they tried to get a roofing permit;
every time they want to upgrade controls appear.
Madam Chair Kings closed the public hearing.
Discussion held regarding the advantages of a home being on the Register, the potential
of a historic district on Broadway, and the protection placement on the Register provides
the home. The Commission noted that the property is well maintained, thanked him for
his efforts, and advised Mr. Scott of the appeal process.

Edward Bertrand, Santa Ana resident, asked that the categorization for 1035 West Third
Street be tabled until the next meeting for further review. He stated that the house is
large, increases the density of the neighborhood, is associated with criminal activity, and
is unkempt. He noted that the area needs new development, not restriction and that the
loan program and Mills Act would not benefit this neighborhood. Mr. Bertrand's mother,
Vicky G. Flores, also stated this house is a problem for the neighborhood and has had
considerable police activity.
Commissioner Giles requested clarification and Mr. Bertrand responded that compared
to other houses, such as the Juhlin Victorian Cottage or the Smiley House, this is not a
model house and is similar to other homes in the area.
Madam Chair Kings noted the house is already on the Register. The initial list was
passed by the Council and the Commission is categorizing the house.
Mr. Bertrand made reference to hearing about proper notification not given; this was the
first opportunity to comment, he does not want to challenge the designation.
Kylee Odette, Deputy City Attorney, stated that in the previous case the owner of the
property at the time of placement was noticed. It is the subsequent property owners who
have raised the issue.
Commissioner Richardson asked that staff note the police situation and advise the police
department.
Madam Chair Kings asked staff to review code enforcement and police records. This is
an 1890 house and one of our few homes from this era remaining in place.
Commissioner Schaefer noted that Floral Park is not on the Register. Also, the
Commission looks at the historic architecture of the home, not the neighborhood it's in.
This house is one of a few surviving properties dating from before 1900, and we have a
responsibility to preserve them.

Commissioner Giles requested if continued until next manth that Police and Community
Preservation inspectors look at this property for code violations.

code is not fairly applied across the city. Joseph Edwards will have staff investigate

• Welcomed Commissioners Richardson and Bustamante back for another year.
• Update on'Philips Block redevelopment project will be scheduled for next month.
• Provided update on the Southern Counties Gas Building. Will bring forward during
the environmental review process either in March or April.

• Welcomed Phillip Schaefer to the Commission.
• Congratulated Commissioners Richardson and Bustamante on their reappointments.
• Reminded the Template Review Committee that the next meeting is tomorrow. The
months of March and November will also have back-to-back meetings.
Madam Chair Kings has a conflict and has a request to change the time; will meet at
4:30 p.m. tomorrow. Mr. Edwards advised that comments have been forwarded to
Mr. Harris and staff will contact the Ad Hoc Committee members to review his revisions
when they are returned.

• Asked how long the conveyor belt would be at the Southern Counties Gas Building.
Mr. View stated it would take two months to get ready and then take several weeks
to move out the soil; the present schedule is March or April.
• Welcomed Commissioner Schaefer..
Commissioner Chinn
• Southern Counties Gas Building has a facade easement. He met with the
contractor, four-feet of material will be taken out, and then hopes the building can be
occupied. Noted the brickwork had been repaired and is outstanding.
• Met with City on Philips Block. Everything goes thraugh the State Architect's office,
as it is part of the process.
• Welcomed Commissioner Schaefer.
• Orange County Historic Society will have a meeting this time next week; Joan Irvine
will be signing her book at the Kidseum and Bowers Museum.

• Thanked staff for their ongoing work and outstanding job.
• Welcomed Commissioner Schaefer.
• Asked that the Commission be kept updated on One Broadway Plaza.

• Sympathized with Mr. Scott's position but could not bring himself to vote against the

opinion should be drafted after the draft EIR has been reviewed.

• Stated he looked forward to serving on the Commission. He has a background in
architecture.
• Has some concerns about One Broadway Plaza; we (should get together as soon as
possible and strategize to influence City Council and public opinion.
Madam Chair Kings
• Asked staff for help to formulate an opinion, take comments from constituents, and
organize in a meaningful way for Planning Commission and City Council, and to
assist the Commission in the legal process and procedure for One Broadway Plaza.
' Asked to reschedule the tour of the library and Santa Ana History Room.
• Asked staff to help get a good tenant in the YMCA Building.
• Noted that one portion of Proposition 40 in the primary election preserves cultural
and historic significant structures in the state and that the preservation community
supports the proposition.
• Thanked staff for their continued support, appreciates their effort and good work.
