APPROVAL OF THE MINUTES for the regular meeting of May 3, 2001. RECOMMENDATION: Approve the minutes of the regular meeting of May 3, 2001. B. COMMISSION SECRETARY REPORT RECOMMENDATION: Instruct the Commission Secretary to enter into the minutes. The June 7, 2001 Agenda was posted at the City Hall Council Chambers on June 1, 2001 at 10:30 a.m. * * * END OF CONSENT CALENDAR * * BUSINESS CALENDAR C. HISTORIC MARKER PROGRAM RECOMMENDATION: Approve the Historic Marker language for various properties on the Santa Ana Register of Historical Properties. Staff requested that the item be continued to the next meeting so that Commissioner Richardson may be in attendance. Motion to continue fo July 5, 2001 meeting. STATUS OF "THE BARRIOS" OF SANTA ANA AND "THE WEST FIFTEENTH STREET" STUDIES Madame Chair Kings noted both items are previous Commission requests which she directed be placed on the agenda to decide if further action is needed. Commissioner Bustamante noted the research staff provided for the history of West Fifteenth Street was sufficient and did not require additional investigation. ' Madame Chair Kings noted the Logan Barrio may be a potential historic district. Joseph Edwards requested that the item be placed on hold until the task of determining the criteria for historic districts is complete. Madame Chair Kings noted when findings are complete on how to create a historic district that staff make an effort to send a letter and packet of information to neighborhoods. Information should be provided in English and Spanish. E. DISCUSSION OF RAMIFICATIONS OF COURT DECISION REGARDING RELIGIOUS INSTITUTIONS Chris Norman, Assistant City Attorney, noted Government Code 37361, upheld by the California Supreme Court, allows religious institutions for non-commercial property to self-exempt themselves from historic resources codes; noted any religious institution can self-exempt themselves by declaring two items: first, they object, and second, they note it will be a hardship on practice of religion and an economic hardship; added the Commission cannot overturn and is without power to consider the application; and recommended staff route a waiver form drafted by the City Attorney's Office, along with application that requests waiver to exempt themselves from the statute. Once information given to Commission regarding waiver, staff will then request direction from Commission on how to handle exempting and getting waivers from institutions. Madame Chair Kings noted that the Commission could provide a cover letter and explain why it is important to leave on the list. ' F. CONFLICT OF INTEREST DISCUSSION Chris Norman provided an overview of the Conflict of Interest laws, noting that the California law has two requirements, disclosure and disqualification, that apply to the Commissioners. Mr. Norman reviewed and gave examples of possible conflicts; discussed that public officials must disclose their personal financial interests which is accomplished by completing the statement of economic interest forms 700; discussed disqualification when a conflict of interest arises and when in receipt of campaign contributions. Mr. Norman proceeded to discuss the eight-step test in deciding whether there is a financial conflict of interest under the Act; noted that the City Attorney's Office is available to offer advice but does not protect from the Fair Political Practices HISTORIC RESOURCES COMMISSION MINUTES 2 JUNE 7.2001 Commission; and noted the new regulation of 500 feet of the boundaries to denote area of presumed conflict. G. CITY OF PASADENA SIGNS AND AWNINGS DISCUSSION Commissioner Chinn provided a presentation of the various historical designated plaques personalized by the donor and retractable awnings in Pasadena's historical downtown. Commissioner Chinn added that the Commissioners will be receiving a letter from Heritage Orange County regarding awnings. H. Madame Chair Kings opened the public hearing at 6:05 p.m. n Steve Solata spoke on the poor condition of the Patricia Apartments indicating it is continually in disrepair and inquired on procedure of historic registration of property. Madame Chair Kings explained the property is on the historic register and is deemed to be historic and the action is to categorize the property. Madame Chair Kings directed staff to explain wwhat the designation means and direct Mr. Solata to Code Enforcement. Mr. Edwards noted staff will provide Mr. Solata with a copy of the template so he can be aware of what has taken place. Madame Chair Kings closed the public hearing at 6:12 p.m. Commissioner Giles noted the Dr. C.D. Ball House language under "description," the last sentence, should read "alterations. " Madame Chair Kings noted two items in the template: The Template Review Committee indicated they would like to maintain the old terminology used in the historic building records, an example of "wrecked old building" noted in the template under the construction history; and commented that the Committee decided to take out business licenses that were showing up in the property records as it was becoming too cumbersome. Oral Comments -Comments from the Public There were no public comments. STAFF AND COMMISSION COMMENTS 7. Comments from Staff Mr. Edwards • Announced that the there will not be a Template Review Committee on June 15 as the consultant is not available. Next regular meeting will resume on Friday, July 13. • Reminded Commissioners of the meeting to discuss the Broadway Historic Corridor on Thursday, June 14 at 3:00 p.m. • Noted the City Council approved the budget and earmarked $90,000 for plaques; and approved the Historic Properties Restoration Loah Program; • Announced Charles View as the new Planning Manager and Laura Johnson as the ' new Commission Secretary; and • Announced the last meeting for Christopher Norman and thanked him for all his assistance with the Commission. Mr. Norman thanked the Commissioners adding it was a pleasure serving. 8. Comments from Historic Resources Commission Commissioner Corpin • Inquired what staff does when someone from a neighborhood comes forward to make a complaint about a property. Madame Chair Kings noted to have staff redirect complaint. Commissioner Gartner • Noted pleasure on being reappointed on the Commission. Commissioner Giles • Expressed thanks to Mr. Norman for his legal advice; • Discussed possibly writing letters to people that would accompany notifications when properties are being discussed and inquired if anything has been drafted. Mr. Edwards noted there is a letter that is sent out describing the process. Commissioner Giles requested a copy of the letter. ' Commissioner Chinn • Commented on the sale of surplus items at the Howe Waffle House noting this is a good show and appreciates hard work of the Santa Ana Historical Preservation Society. • Inquired on the web site for historical data. Hally Cappiello noted that currently there are various agencies that have gone on-line with website; Planning site is complete but is currently waiting for the Building department's site to be complete in order to go on-line together; • Announced the Los Angeles Conservatory website which includes walking tours, political commentaries and events; • Noted concern on the approval at the last Commission meeting of Historic Exterior Modification for the Santora Building; noted Commission will receive letters from HISTORIC RESOURCES COMMISSION MINUTES 8 JUNE 7. 2001 E__J Heritage Orange County indicating Dan Bradley; noted drawings were Commission received six months ten items they discussed with Mike Harrah and dated March 20p1 and November 2000 noting late and should not have gotten to crisis management and should not occur again with any Historical building; requested in the future items be brought to Commission sooner; Requested a meeting with Downtown Manager to discuss bringing National Trust into the area and discuss similar programs they offer such as partnership network or services/loan programs; and Noted he would like to see more applications for the Mills Act. Commissioner Bustamante • Invited Commissioners to the new exhibit at the Old Orange County Courthouse titled "California Style Architecture" that will be on display for a couple of months. Commissioner Rankin • Announced she will be relocating outside of the city and will soon be departing Commission, adding she is not yet ready to resign but will inform when the time comes, and will discuss with Commissioner Solorio suggestions for filling the seat. Madame Chair Kings • Congratulated Charles View on his appointment; • Thanked Mr. Norman for all his help and appreciation of all his comments; • Reinforced Commissioner Corpin's concern and asked staff to inquire if there are any potential funds for the Patricia Apartments through a rehabilitation loan; • Noted the Commission in October is scheduled to discuss cultural icons; had some concerns that the new plaques seem understated; would like to discuss possibly having bigger, fancier plaques and see examples of plaques in Palm Springs; and possibly pick-up the living history and place photos with corporate sponsor to fund; requested issues be added for discussion; and • Inquired on the status of hosting a future State Historic Preservation Conference and the Certified Local Government (CLG) application. Mr. Edwards noted that both projects are in progress and require City Council endorsement. Both items, as part of the HRC objectives, will be brought back to the Commission for consideration in the near future. 9. Excuse of Absences Motion by Commissioner Bustamante and seconded by Commissioner Gartner to excuse the absences of Commissioners O'Callaghan and Richardson and approved unanimously by a vote of 7:0. 10.
