Award a contract to Powell Constructors, Inc., the lowest responsible bidder, in accordance
with unit bid prices in the estimated amount of $6,010,329 for construction of the First
Street bridge replacement over the Santa Ana River effective Monday, March 28, 201 1 ,
subject to compliance with all City rules and regulations.
2. Approve a funding analysis with a total estimated construction cost of $8,113,900.
DISCUSSION
Currently, the First Street Bridge over the Santa Ana River consists of two travel lanes in each
direction (Exhibit 1). This project will widen the bridge and the approaches to three lanes in each
direction, along with bike lanes and with pedestrian sidewalks on both sides to make this segment
of First Street consistent with the Orange County Master Plan of Arterial Highways and the City's
Circulation Element.
The proposed work includes demolishing the existing bridge and construction of a new, wider
bridge. Other improvements include medians, trail connections to the Santa Ana River and
landscaping along the approaches to the bridge.
The work will be conducted in two phases. In the first phase, traffic will be directed to the south
half of the bridge while the north half will be demolished and rebuilt. The second phase of the
project will start immediately following completion of the first phase. Traffic in this phase will be
directed to the newly completed north half of the bridge during construction of the south half.
Once completed, these improvements will enhance flow of traffic, pedestrian safety and ride
quality of the bridge.

The Notice Inviting Bids was advertised on February 18 and 19, 201 1 , and bids were opened on
March 17, 2011. A summary of the bid invitations mailed, the bids received, and the bid results

While the City made outreach efforts to Santa Ana contractors regarding the Notice Inviting Bids,
only one Santa Ana contractor submitted a bid as a prime contractor. Also, Hardy and Harper, a
Santa Ana -based contractor is a sub to the low bidder. The other 45 Santa Ana contractors did
not submit a bid either because they are not capable of performing this type of work, unable to
obtain insurance because the project is too large, or they work as a subcontractor to certain prime
contractors.
A total of 1 O bids were received and all were responsive. The lowest bid was submitted by Powell
Constructors, Inc. for $6,010,329, which is below the Engineer's estimate of $10,400,000. The
downturn of the economy and the competitive market contributes to the low bids received.
The project is partially funded with Highway Bridge Replacement and Rehabilitation funds and
Measure M funds. The project must be awarded by March 31 , 201 1 as required by Orange County
Transportation Authority. According to the bidding documents, bidders may protest the bidding
results within five business day following bid opening and are entitled to an administrative hearing
to be conducted by the Executive Director of Public Works. Therefore, this award is valid only if
the City does not receive any legitimate bid protests.

ENVIRONMENTAL IMPACT
In accordance with the California Environmental Quality Act, the recommended action is exempt
from further review. Notice of Determination ER No. 201 0 -108 was filed for this project.
FISCAL IMPACT
The funding analysis shows a total estimated construction cost of $8,113,900 for the project
(Exhibit 2). Funds are available in the Measure M Street Construction Fund (accounting unit
03217660 - 66220, project no.061723) and the Select Street Construction Fund (accounting unit
05917660 - 66220, project no. 061723).

PROPOSAL 8c CONTRACT AGREEMENT
BIDDER'S STATEMENT
BIDDER understands and agrees that this written proposal (or any part thereof specifically designated
and accepted by the City of Santa Ana, hereinafter AGENCY) shall constitute the entire agreement
between BIDDER and the AGENCY only after it has been accepted by the City Council, endorsed by
the Clerk of the Council with her signature and official seal noting hereon the action of approval of the
Council, signed by the Public Works Agency Executive Director or his duly authorized agent, and
signed by the City Attorney, denoting his approval of the form of this document, and its execution, and
when it or an exact copy of it has been either delivered to BIDDER or deposited with the United States
Postal Service properly addressed to the BIDDER with the correct postage affixed thereto.
BIDDER further agrees that upon delivet-y (as defined above) of the accepted agreement he /she will
furnish AGENCY all required bonds and certificate of liability insurance within ten (10) days (excluding
Saturdays, Sundays and AGENCY'S legal holidays), or the funds, check, draft, or BIDDERS bond
substituted in lieu thereof accompanying this proposal shall become the property of the AGENCY and
shall be considered as payment of damages due to the delay and other causes suffered by AGENCY
because of the failure to furnish the necessary bonds and because it is distinctly agreed that the proof of
damages actually suffered is difficult to ascertain; otherwise said funds, check, drafis, ot• BIDDER'S
bond substituted in lieu thereof shall be returned to the undersigned.
BIDDER understands that a bid is required for the entire work, that the estimated quantities set forth in
the bid schedule are solely for the purpose of comparing bids, and that final compensation under the
contract will be based upon the actual quantities of work satisfactorily completed.
All teens contained in the Specifications, the Certification of Non - Discrimination by Contractors, and
the Workers' Compensation Insurance Certificate are to be incorporated by reference into this
Agreement and are made specifically as part of this bid.

CERTIFICATION OF NONDISCRIMINATION BY CONTRACTOR
The undersigned contractor or corporate officer, during the performance of this contract, certifies as
follows:
l . The Contractor shall not discriminate against any employee or applicant for employment because
of race, color, religion, sex, or national origin. The Contractor shall take affirmative action to ensure
that applicants are employed, and that employees are treated during employment without, regard to their
race, color, religion, sex, or national origin. Such action shall include, but not be limited to, the
following: employment, upgrading, demotion, or transfer; recruitment or recruitment advertising; layoff
or termination; rates of pay or other forms of compensation; and selection for training, including
apprenticeship. The Contractor agrees to post in conspicuous places, available to employees and
applicants for employment, notices to be provided setting forth the provisions ofthis nondiscrimination
clause.
2. The Contractor shall, in all solicitations or advertisements fior employees placed by or on behalf
of the Contractor, state that all qualified applicants will receive consideration for employment without
regard to race, color, religion, sex, or national origin.
3. The Contractor shall send to each labor union or representative of workers with which he /she has
a collective bargaining agreement or other contract or understanding, a notice to be provided advising
the said labor union or workers' representatives of the Contractor's commitments under this section, and
shall post copies of the notice in conspicuous places available to employees and applicants for
employment.
4. The Contractor shall comply with all provisions of Executive Order 1 1246 of September 24,
1965, and of the rules, regulations, and relevant orders ofthe Secretary of Labor.
5. The Contractor shall furnish all information and reports required by Executive Order 1 1246 of
September 24, 1965, and by rules, regulations, and orders of the Secretary of Labor, or pursuant thereto,
and will permit access to his /her books, records, and accounts by the administering agency and the
Secretary of Labor for purposes of investigation, to ascertain compliance with such rules, regulations,
and orders.
6. In the event of the ConL-actor's non- compliance with the nondiscrimination clauses of this
contract or with any of the said rules, regulations, or orders, the contract may be canceled, terminated, or
suspended in whole or in part and the Contractor may be declared ineligible for further Government
contracts or federally assisted construction contracts in accordance with procedures authorized in
Execution Order 1 1246 of September 24, 1965, and such other sanctions may be imposed and remedies
invoked as provided in Executive Order 1 1246 of September 24, 1965, or by rule, regulations, or order
of the Secretary of Labor, or as otherwise provided by law.

7. The Contractor shall include the portion of the sentence immediately preceding paragraph (1)
and the provisions of paragraphs (1) through (7) in every subcontract or purchase order unless exempted
by rules, regulations, or orders of the Secretary of Labor issued pursuant to Section 204 of Executive
Order 1 1246 of September 24, 1965, so that such provisions will be binding upon each subcontract or
purchase order as the administering agency tnay direct as means of enforcing such provisions, including
sanctions for noncompliance; provided, however, that in the event the Contractor becomes involved in,
or is threatened with, litigation with a subcontractor or vendor as a result of such direction by the
administering agency, the Contractor may request that the United States enter into such litigation to
protect the interests of the United States.
8. Pursuant to California Labor Code Section 1735, as added by Chapter 643 Stats. 1939, and as
amended,
No discrimination shall be made in the employment of persons upon public works because of race,
religious creed, color, national origin, ancestry, physical handicaps, mental condition, marital status, or

As required by California Labor Code Section 1860 and 1861, the Contractor certifies as follows:
I am aware of the provisions of Section 3700 of the Labor Code, which requires every employer to be
insured against liability for worker's compensation or to undertake self - insurance in accordance with the
provisions of the Code, and I will comply with such provisions before co�ninencing the performance of
the work ofthis contract.
If I, as the Contractor, now or at any time during the course of this agreement, qualify as an employer

BIDDER'S STATEMENT REGARDING APPRENTICESHIP RE UIREMENTS
The undersigned BIDDER is familiar with the requirements of Section 1777.5 of the State Labor Code
regarding employment of apprentices, and understands that contractors on contracts exceeding $30,000
or 20 working days shall:
1. Apply to the joint apprenticeship committee administering the apprenticeship standards of the
craft or trade in the area ofthe site ofthe public work for a certificate approving the contractor under the
apprenticeship standards for the employment and training of apprentices in the area or industry affected.
2. Employ the number of apprentices or the ratio of apprentices to journeymen stipulated in the
apprenticeship standards.
3. Contribute to the fund or fiords in each craft or trade in which he /she employs journeymen or

A. In order to accommodate the project schedule, Southern California Edison (SCE)
requested the contractor to install inserts attached to the deck in order to support the new
conduits underneath the bridge deck. To expedite payment to contractor for installing
these inserts, the city will make payment to the contractor as a change order and SCE will
reimburse the City for the cost. Prior approval for this change order was granted on
October 31, 2011.

B. To improve the esthetics of the bridge, the barrier rails were re- designed to include arches,
reveals and pilaster instead of the plain panels. The new design requires the use of
special forms and additional reinforcement, which require substantially more time for the
installation. This change order provides for the bridge barrier rails re- design. Prior approval
for this change order was granted on November 15, 2011.

C. To construct the bridge deck, forms are placed adjacent to the girders; girder elevations
need to be uniform. After the girders were post- tensioned, each girder's curvature was
different. Therefore, it was recommended to weld two steel angle iron on top of the
girders, to adjust for the elevation difference. The situation is expected to be the same for
the next half of the bride and the cost of this order includes that future work. Prior
approval for this change order was granted on October 24, 2011.

D. A girder for the bridge deck is a continuous structural element, it was pre- fabricated into
three segments with the connection at the top of the piers. The connection was made by
overlapping the rebars at each pier. The contract piers are not wide enough to allow for
sufficient overlapping of the rebar. As a result, the structural engineer recommended
joining the rebars by slide -in couplings. This change order provides for cutting the rebars
to fit the space and install slide -in. Prior approval for this change order was granted on
November 15, 2011.
TOTAL COST = $4,595
E. Field condition reveals that area between the new retaining wall at the easterly
embankment and the adjacent property would need to be graded to allow the property
owner to use this area. However, the grading in this area was not included in the contract.
This change order provides additional grading, landscaping and modifications of the

The coordination effort between the City and Southern California Edison's (SCE) to de- energize
nigh voltage transmission and distribution lines above the north side of the bridge was critical for
the contractor to install the new concrete girders. Due to the size of the cranes and the location of
the lines it was not possible to install the fifteen girders, for the north half of the bridge, without de-
energizing SCE's lines.
Following several coordination meetings with SCE, they agreed to a three -day window from Sam to
3pm to de- energize the lines contingent on the energy demand on the grid. The transmission lines
over the bridge are a critical component to the southwest grid. Consequently, when the energy
demand is high it is not possible for SCE to de- energize these lines without interrupting service on
the grid. Therefore, SCE advised that the de- energizing window may fluctuate with the energy
demand on the grid.
The first day, due to weather forecast, SCE was not able to de- energize the lines until lam, which
caused a two hour delay to the contractor. The second day went well and SCE was able to de-
energize the lines as planned. However, the third was eventually cancelled due to the extreme hot
weather. The contractor was on standby for approximately four hours before it was confirmed that
SCE was not able to de- energize the lines; which caused the rescheduling of the work.

Coordinating the rescheduling with SCE and the contractor proved difficult due to the weather
forecast and the availability of the special transport trucks for the remaining girders.
Due to the size and weight of the girders leaving them on site was not a viable option. After
weighing the options and reviewing the weather forecast it was decided to demobilize the cranes
and return the girders to the manufacturer since it looked like it would be at least a week before the
work could be rescheduled.
This change order is to compensate the contractor for all labor and equipment standby time; two
hours on September 6, 2011 and four hours on September 8, 2011 and the demobilizing and
remobilizing of all labor, equipment, and material, which included a 500 and a 250 ton cranes and
transport

REASON FOR CHANGE
While constructing the northern half of the bridge, the coordination to relocate and work
around the overhead utilities between SCE, the communication companies and the
contractor caused the contractor to work in the Santa Ana River after September 30,
2011. The costs are to compensate the contractor for removing his equipment daily
from the river bed, as required by the County. (PCO 14).

2. While installing the northern half of the bridge deck reinforcement, it was determined
that the required lap length could not be installed as designed for the closure pour. The
existing southern half of the bridge was in the way, so the deck steel was cut short and

to compensate the contractor to install 1000 couplers to extend the reinforcement for
the closure pour's required lap length. (PCO 20).

3. After installing Stage 2 traffic control for the construction of the southern half of the
bridge it was determined by Traffic Engineering that the traffic control needed some
adjustments to provide safer movements for the side street traffic. The costs are to
compensate the contractor to sandblast, restripe, and install additional delineators per
the revised traffic control plan. (PCO 23).

4. While forming the MSE wall cap located at the northeast corner of the bridge it was
determined that the designed planters within the wall cap would not fit. The
concentrated amount of reinforcement within in the cap could not be moved or cut_ The
costs are to compensate the contractor to form and pour a new planter on top of the
wall cap. (PCO 24).

5. While laying out the new sidewalk, curb and gutter and asphalt where the street joins
the existing mobile home park, located at the northeast corner of the bridge, it was
discovered that there was a bust in the elevation. In order to effectively join the new
street with the private property the existing curb needed to be realigned. The costs are
to compensate the contractor to remove and replace a section of asphalt and curb and
gutter at the join between the street and private property_ (PCO 25).

6. During a preconstruction meeting with the City's Water Department it was determined
before the contractor ties the new water line into the existing a thrust block would be
needed around the existing valve, if one did not exist. The costs are to compensate the
contractor to pothole and verify that there is an existing thrust block_ (PCO 26).

7. After making the modifications to Phase 2 traffic control plans in PCO 23, the mobile
home park located at the northeast corner of the bridge advised the City that traffic
control modification restricted its residents from entering and exiting the mobile home
park. This restriction was causing some motorists to make unsafe movements. It was
determined that the contractor's work area could be adjusted to accommodate the
installation of a turning pocket at the mobile home park. The costs are to compensate
the contractor to revise its construction area by relocating the K -rail, removing some
curb, patching the area with asphalt and restriping the street. (PCO 27).

1. The contract documents show artificial turf as the median landscaping on both sides of
the bridge; ETAC has reviewed the artificial turf as a landscaping treatment and has
recommended switching to drought tolerant plants. In order to establish the drought
tolerant plants an irrigation system is required. The additional costs compensate the
contractor to delete the artificial turf system and to provide and install a new irrigation,
including new valves and appurtenances, and new drought tolerant landscaping. (PCO

City Council has requested that a new bronze plaque be added to the southwest corner
of the new bridge. The plaque is to be inset into a pilaster at the beginning of the
decorative bridge barrier rail. Due to the size of the plaque the pilaster's size needed to

equipment to fabricate and install a new bronze plaque and increase the size of the

3. During an inspection of the PCC channel pavement (liner) in the river bed by Orange
County Public Works, it was determined that the portions of the PCC liner needed to be
replaced adjacent to the new pier walls. Additionally, O.C.P.W. requested to increase
the size of the aggregate for the PCC liner from 3/a inch rock to 1'/2 inch rock. The
additional costs compensate the contractor for all labor and equipment to saw cut and
remove portions of the PCC liner, the additional PCC for the replacement, and costs
incurred to increase the size of the aggregate. (PCO 35)
AGREED COST = $9,720
4. Due to the project's two year duration the northern half of the bridge was constructed
the first year and the final irrigation and landscaping on the north side could not be
completed until the end of the second year when the southern half of the bridge was
built. Therefore the condition of the planters and areas located on the north half of the
bridge needed to be addressed in advance of the final irrigation and landscape. The
additional costs compensate the contractor to remove the weeds from the planter at the
northeast corner of the bridge, and to grade and install sod in the areas back of walk.
(PCO 36).

5. Due to the widening of the bridge, the new drive approach installed to the property
located at the northeast corner was approximately six inches higher than the existing
adjacent pavement. Therefore the adjacent pavement needed to be lowered to meet
the elevation of the new drive approach. The additional costs compensate the
contractor for all labor and equipment to remove approximate eight feet of pavement
behind the drive approach, grade and place AC pavement to the new drive approach
elevation. (PCO 36)

6. Adjacent to the west side abutment, there is a 60 -inch Orange County Sanitation
District (O.C.S.D.) reclaimed waterline that is shown on the plans. During construction
it was discovered to be eight feet closer to the abutment than as shown on the plans.
Due to the vibration while installing the piles for the new abutments, O.C.S.D.
requested that the pipe be surveyed to verify that it did not move during the pile driving
operations. The additional costs compensate the contractor for all labor and equipment
to excavate and expose the line for the survey, then backfill and compact once the
surveying is complete. (PCO 36)

7. Due to several rain events, a significant amount of sand and debris was deposited by
the storm runoff onto the construction area in the river bed. To facilitate OC Flood's
inspection of the PCC liner they required the City to have the Contractor remove the
sand and debris. The additional costs compensate the contractor for all labor and
equipment to remove and dispose of the sand and debris. (PCO 36)

9. During the course of the bridge construction, excessive graffiti was continually
encountered on adjacent property walls and buildings. In order to mitigate the graffiti it
was recommended to remove the graffiti regularly. Graffiti removal is outside the scope

and equipment to remove the graffiti. (PCO 36)

10. After the new sound wall was installed at the northeast corner of the bridge, the
adjacent property owner informed the City that the sound wall restricted motorist's
vision of oncoming pedestrians and bicyclists when exiting the property. The City's
Traffic Engineering Section reviewed the situation and recommended 15 -feet of the
wall be removed to improve sight distance. The additional costs compensate the
contractor for all labor and equipment to saw cut, remove, and dispose of the 15 foot
section of wall. (PCO 37) %

11. After completion of the bridge, at the southwest corner, the property owner informed
the City that the new barrier rail was to close to their home's roof which sacrificed the
security of their property. After a careful review, it was recommended to increase the
barrier rail height to seven feet by adding a 48" high CMU wall to the top of the barrier
rail. The additional costs compensate the contractor for all labor and equipment to
install a 148 foot long CMU wall on top of the barrier rail adjacent to the property. (PCO
38)

12. In advance of building the MSE wall located at the southwest corner of the bridge it was
determined that the excavation for the new footing would undermine the adjacent
property wall. After reviewing the issue with the property owner it was determined that it
would be more cost effective to remove the existing wall and extend the adjacent
property fences two feet to abut the new MSE wall. The additional costs compensate
the contractor for all labor and equipment to extend two block walls, two chain link
fences, one wood fence, one wrought iron fence and the parking lot pavement two feet.

13. The contract documents show construction of new sidewalk at southwest corner of the
bridge with variable in widths from 8 to 15 feet. After careful review, the City's Design
Engineering Section revised the plans to move the curb and gutter back to create a

Increase the contract with Powell Constructors, Inc., for the construction of the First Street
bridge replacement over the Santa Ana River by $250,000 for a total estimated contract amount
of $8,065,000, and authorize the City Manager to execute change orders in an amount not to
exceed the authorized contingency.
DISCUSSION
On March 21, 2011, the City Council awarded a construction contract for the First Street bridge
replacement over the Santa Ana River to Powell Constructors, Inc., in the amount of $6,010,329
plus a contingency amount of $1,202,066, totaling $7,212,395. On January 17, 2012, the City
Council approved an increase of $602,605 which raised the contract total to $7,815,000.
The additional costs were related to a significant redesign of the bridge foundations that
eliminated conflicts with interfering power lines, resulting from the inability of the utility company
to de- energize and relocate its lines. The restriction of constructing the bridge one -half at a time
and only during the dry season (six months), as determined by the Orange County Flood
Control District, caused scheduling delays that also affected contract costs. Other extra costs
were attributed to added enhancements to the bridge, including architectural details to the
railings, erecting sound walls, and for general unforeseen underground conditions.
Fortunately, due to unpredictability of the highly competitive construction market, the original
construction bids were significantly lower than the engineer's cost estimate. That resulted in
making additional grant funds available to the project for eligible scope expenditures. Even with
major redesign efforts and cost increases to the project, approximately $500,000 in grant
funding is still available for this bridge construction project.

Staff is recommending using these grant funds to complete two additional improvements: (1)
Install streetlights and required appurtenances, including upgrading the lamps to energy
efficient LED lamps, which will provide significant annual savings to the City; and (2) install a
planter with vines along the concrete masonry wall located at the southwest corner of the
bridge, which will help suppress graffiti.
At the time the bridge was under design, streetlights were not part of the scope due to funding
constraints and, therefore, the construction contract did not include streetlights. However, the
positive financial position of the project would allow completing the streetlight installation, since
this project has designated grant funds still available. Staff has designed structural
reinforcements for each streetlight location on the bridge, and the cost of those structural
retrofits can be covered within the existing contract. However, the cost to install the 20
streetlight standards, conduit and wiring, lamps, controller, and the site improvements will
exceed the current Council- approved contract. Since these improvements are eligible for grant
reimbursement, it is recommended that the contract be increased by $250,000 to complete
these project enhancements and close out the project.
ENVIRONMENTAL IMPACT
This is no environmental impact associated with this action.
FISCAL IMPACT
Funds for the contract increase of $250,000 are available in the Measure M Street
Construction Fund (Account 03217660- 66220) and the Select Construction Fund (Account
05917660 - 66220).

JUSTIFICATION
1. Increase limits of asphalt removal and replacement including the cost of traffic control.
Relocate an existing water meter to behind the new curb and gutter to meet City
Standards. At the request of Orange County Public Works Department, install redwood
headers adjacent to new pavement on access ramp to Santa Ana River Bike Trail to
prevent future damage to the pavement. (PCO 40)

2. After Southern California Edison poles and streetlights were relocated as part of the bridge
widening, it was determined that there were not enough streetlights adjacent to the bridge
to provide adequate lighting on the bridge for pedestrian and motorist safety. In keeping
with the Council's request to maintain the historical integrity of the bridge, 20 vintage style
streetlight posts will be installed along both sides of the street on the bridge and the
approach to the bridge. The pilasters on the barrier rail along the bridge need to be
enlarged and reinforced to accommodate the new streetlight poles.
On the southwest approach to the bridge there is a 6' high block wall that is prone to
graffiti. It has been determined that to best mitigate the graffiti, a planter should be
constructed, irrigation lines installed and vines planted along the wall. (PCOs 41 & 42)

3. Prior to the completion of the installation of the electrical service pedestal intended for the
point of connection for the irrigation controller, Southern California Edison revised the
installation requirements for electrical service pedestals and conduits. The pedestal had to
be removed, the conduits modified and the cabinet reinstalled. (PCO 43).

JUSTIFICATION
While laying out the new planter located at the southwest corner of the bridge it was
determined that the design did not have sufficient reinforcement for the loads. Therefore
the reinforcement was modified for the existing conditions. Additionally while installing the
new streetlight it was determined that embedment depth for the streetlights needed to be
increased to accommodate code requirements. (PCO 44)

2. After completing the improvements in front of the mobile home park located at the
northwest corner of the bridge, the owners of the property informed the City that there may
be a conflict with the bike traffic and the motor vehicles exiting their property. The City
